Jodi Arias Murder Trial – Penalty Phase, Day 4

05/21/2013

I re-watched yesterday’s proceedings (I know, crazy me).  I t was bad enough that Nurmi whined, the court didn’t prohibit TV cameras, the court didn’t sequester the jury, the defense witnesses have been intimidated by the State and the public…on and on.

He was downright rude and offensive to Juan Martinez and the judge.  The ‘court’ is Judge Stephens, you idiot and when you have to appear before her on any other case, you can bet her memory of you will serve her well!

When he didn’t get his way for a mistrial, he changed tactics and said, well, we don’t want to play anymore.  We want to withdraw as counsel.

Having lost their only two dubious mitigation witnesses, we are now left with Arias to begin her pity-party…God help us!

Isn’t it sad, in all these years, the mitigation specialist couldn’t find a single stand-up person to speak on Jodi’s behalf?  Speaks volumes as to the true nature of Jodi!

Waiting to see what tomfoolery the have up their sleeves today!  The ever-popular, faux migraine?  The oops, we found a new witness, but need a day to prep them?  Nurmi passes out at the defense table?  So many options!

9:42, all in chambers, Arias mom taken to a side room by the Mitigation Specialist…good indication Jodi may ask for DP!!!

Podium set up in front of the jury box.

Screen shot 2013-05-21 at 2.25.09 PMCourt called in session at 10:52.

Jury in at 10:54

Judge tells jury Womack not available and State cannot cross her statement.

Jodi starts with her, lifelong friend, Patti Womack, couldn’t be present due to threats of harm to herself and her child.

When I arrived in jail, my hair was below my waist.  When I cut it, I donated it to an org that makes wigs for cancer patients and will continue to do so.

My mom said she left court one day and was sitting in traffic and the next car was the Alexander family.  She told me that family had been through hell and I know that’s because of me.

Claims the Alexander family statements undid her.

Also claims until 2 weeks ago, she didn’t know Travis’ grandma had died.  She was the glue of the family.  My actions may have contributed to that.

The reason I haven’t committed suicide is over there, my family.

Before prison I didn’t realize I still could make a difference.  There are work programs.  I have been asked to teach folks Spanish.  I couldn’t before because of my pending case.

With permission, I could start a prison-recycling program that could make a difference on the environment.

I would like to start a literacy program.

You may not believe I’m a victim of domestic violence, but that is your opinion.

She whips out the “Survivor” t-shirts she’s been hawking!  OMG!

When I arrived in prison I’ve realized I can make a difference.Screen shot 2013-05-21 at 2.47.36 PM

Now showing photos of family life.

So, bottom line, the biatch is pleading for LWOP.  So much for her claims she wanted death.  Too bad the jury hasn’t seen those interviews!

Now quotes Dickens!

I may just be physically ill!

I’m not going have children of my own.  Because of the choices I made.

You’ve heard I’m an artist.  I will never paint another painting.

I will never spend the holidays with my family again.

It’s never my intention to drag Travis’ reputation.

I loved Travis and looked up to him.

This is the worst thing I’ve done.  The biggest mistake I’ve ever made.

Mistake???

The day of the verdict, her mother told her, her father cried like she never heard before.

Uh, Jodi all of us know your mother was turned away at the jail that day?

Asking for life in prison, not the death penalty.  Please don’t do that to my family!

OK, don’t put me to death because I’m a vicious murderer, but spare my family!

This is the same loving (abusive) family she threw under the bus!  She must think the jurors are pretty dumb!

No tears from Jodi, just a big lie, pity party!  Also, only fake tears from her family!

Alexander family, like me, looks like they want to spew!

So, sorry and remorse are foreign concepts to Jodi!  She never said sorry, but damn, she’s so special she can teach other prisoners!

Think Jodi just said to MS, well that went well, dontcha think?

Jury sent out.  Bench conference.

Jury back.

Jury given copies of juror instructions and Judge Stephens reads them to the court.

Early lunch and jury to return at 1:15.  We will have closings and then rest of the instructions before jury deliberates!

So, her whole statement was filled with many mis-truths because Juan couldn’t cross!

Court returns at 1:18.

Willmott up…

People are far better than their worse deed.  Jodi Arias if far better than her very worse deed!

The State of AZ doesn’t require you to decide death.

We have to prove the mitigating factor.  Each jury can come back with a different mitigating factor.  It’s your choice to find a reason to find value in Jodi’s life.

It is your own moral choice.

Lying is not a capital crime.

Mitigator factors have nothing to do with excusing that crime.  You already found her guilty of murder.

She made so many people happy in her life.

She has no prior criminal history.

She tried to better herself.

She has the ability to help people while in prison.  She has goals to achieve while behind bars.

Okie dokie, Jenny…the preponderance of evidence of cruel, heinous murder far outweighs any of the mitigators!

Parents thrown way far under the bus again…good job Jenny!

Defense really has to believe the jury is low IQ!!!!

The abusive by Travis is not an excuse.

Duh, where did you prove there was truly abuse?

She will be haunted by what she did to Travis, his family, and her family.

This is gonna blowup.  Jenny blaming Travis, and Jodi’s family…not gonna sit well with jury, methinks!

Boy, they think the jury is dumber than dirt!

You can still show mercy and show she still has value in her life!

OMG!  Two wrongs don’t make a right.  What a cliché!

Woot!  Juan up!

To his family, Travis Alexander will be forever young.

Travis, to his family will always be 30-years old!

But, they can’t forget what happened to their brother.

They can’t forget his death was especially cruel.

Juan moves to place a death photo on the screen and Willmott immediately yells objection…sidebar.

Damn, the family is crying….

Juan won the fight!

Mr. Alexander is dead.

You are not investigators of mitigating factors.  Yes, you could say after what she did to him, he’ll never get cancer.  You are not there to be advocates!

The entire Alexander side of the court is crying.

You were told that life could mean the rest of natural life, but there could also be parole after 25 years.

Her being an artist doesn’t mean she should get preferential treatment.

They said you she was only 27-years old.  Last I looked, age of majority was 18.  People go off and fight wars at 18.

She was 27 and is now 32-years old.  Mr. Alexander was only 30 and will remain forever 30.

She told you about memories, family memories.  Mr. Alexander has no more memories.

Willmott objecting left and right.  Waiting for Juan to go into linebacker stance and take her the f*** out!

Juan goes into Jodi’s history of perjury.  Maybe she wasn’t convicted, but it’s still a criminal activity.

Juan totally blowing up the defense arguments!!!

Jodi, looking down, doing arts and crafts again!

Judge Stephens is overruling objections left and right!  Yeehaw!

Methinks Jenny from the hood is making big mistakes on all these objections!!!

Juan will be serving hash browns with defense scramble at break!

15-minute recess called…back at 2:45…

Juan was beyond brilliant!

Back at 2:49…

Sadly, Willmott up again.

The simple question is do you kill her?  You found her guilty, but do you kill her?

What she did was awful, but doesn’t her life have value?

She’s begging for her life because she can contribute to this world.

She does not need to be put to death for her lies.

Her family is here, but they were not there when she was growing up.

Ummm, uhhh, errr…she freakin ran way from home!

You heard Jodi likes to play the victim.  She does not like to play the victim.

I just spit up a little in mouth.  Hasn’t she played victim through this entire trial????

Your conviction of 1st degree murder should give Travis’ family peace.

We are asking you to find mercy and find value in Jodi’s life.

Back to finishing the instructions…

The jury can set their own schedule with approval of the court…

We are done and we are on penalty watch…

How does Jodi know there’s no recycling program at the AZ prisons? Most state institutions DO have recycling programs. Does she really think SHE is the first person who thinks of recycling waste? It’s like her brain stopped developing when she was 13. I hate her.

Yes Bubbs, she was, but the judge has mandated that the Jail not permit any media at all until further notice. But we can count on JA using her 1st phone call to line up her interview as soon as possible!

      • Wren
        05/21/2013 at 8:51 pm

I keep thinking about these supposed mitigating factors… I keep thinking of how they apply to Travis. HE was young, HEE had no criminal history, He wanted to help others, HE was creative. Jodi arias considered NONE of these when she decided to take his life.

    • 05/21/2013 at 11:25 pm

It seems she shouldn’t be allowed but as we speak, she is giving interviews in the jail. Joe Arpio said so. 4-1/2 hours worth. She demanded they buy her makeup and they did. She checked a list, crossed off some names (probably HLN lol) and OK’d others. I believe 48 hours, NBC and the guy from Az. who interviewed her last week and an Az. newspaper. It’s all too bizzare. Like a reality show except that Travis was killed 3 times over. She is a disgrace.

        05/21/2013 at 6:54 pm

Janna, Sorry you are stuck on that, I know how you feel. I think Womack and Darryl know she is guilty, their morality stops them from going on. They will get grief their entire life if they showed up on the stand. Perhaps I’m just fantasizing but it helps me.

    • 05/21/2013 at 6:43 pm

Anniefreeze.. try to imagine yourself not having a conscience, not feeling empathy with anyone because you don’t have inside you what they have. That’s her. She does NOT feel as we do and she does not know how to.

        05/21/2013 at 7:00 pm

Syn. Thanks for the concept. I’m so extremely empathetic that it is very difficult to grasp. Ok then you are saying that if she gets DP she will not really feel pain like normal people do? Ok is her suffering is only a shallow coat that we might feel?

      • 05/21/2013 at 7:03 pm

she will find a way to justify what she did she will not feel remorse in the way we do because she has no conscience. It is not her fault she felt she had to kill him it is his fault. Plain and simple

On Dr Drew they used the exact words I’ve always used in my husband’s case…Jodi believed Travis had it coming. So she has nothing to apologize for. My ex has never apologized nor shown remorse for the exact same reason, he believed I had it coming. It’s how criminals think.

In AZ, the jury HAS to find the mitigating circumstances outweigh the aggravation. If not, HAVE to give death. If they are, HAVE to give life. It’s been described as mathematical.

    • 05/21/2013 at 6:44 pm

if that case.. if they understand it as you presented it then. To me they have no choice but to arrive at DP verdict.

I care very much if she gets Life. I don’t believe she should have *any* opportunity to take college courses or have a job or more privileges. I want 23 hour per day solitary. I want no face to face visits or 6 times a year weekend picnics where family can bring her the food that she misses and likes

I want visits only conducted through glass, food eaten in her solitary cell. If there were a penalty that allowed that without eventually *maybe* getting the needle then that would satisfy me BUT we DON’T currently have that option. I want all the fuckery with Twitter and T shirt selling and incorporated art selling scams to immediately stop. I want the death penalty because she truly is deserving of it.

I can’t tell you how freaked out and really shocked I was to see her purposefully giving Samantha the throat slit gesture! I had to watch it several times because I just had such difficulty in believing what I was seeing. SOOOO manipulative and totally EVIL. There is not even a smidgen of contrition in her soulless shell.

I agree with you Nancy. I don’t want her getting DP to be killed necessarily.. but to me it is a MUST because of who and what she is and to her she wins if she gets less. She should be locked up with no rights at all and from what I hear the 23hours lockdown with minimal access to amenities is the ONLY way she will feel punished.

Nancyb…Yeah, I concur, but my anxiety stems from this fact. death row can be reversed and the prisoner can socialize with guards. Here is a personal true life example, my sister lived in Brewster Ny. Her next door neighbors were like second family members to us. Matt, the man of the of the house, works in Danbury Conn. prison. Matt explained the dynamics of death row. prisoners play cards and games with the guards, they socialize while eating their meals. The guards get board and form social relationships. bottom line she will socialize.
wish DP Inmates didn’t cost the tax payers so much. If only public hangings were vogue. There is no question of her guilt so why do they give convicts a second chance? Same thing for serial killers…speed up the penalty. Stop the appeals and quit the expensive burden.

      • 05/21/2013 at 8:32 pm

When the corrections business is getting huge pay-offs from all those incarcerated, there is little to no likelihood of the system being changed.

      05/21/2013 at 7:23 pm

The very minimum requirement for a Locks of Love donation is 10″ of hair.

CMJA said she’s donated 3 times since being in jail. NO FRKN WAY!!!! That’s 30 inches of hair in 5 years.

      • nyccowgirl
        05/21/2013 at 8:35 pm

of course she’s lying. i’ve donated hair before and 10″ is long, especially when you have to discount any layers. her hair was still long when she did the 48 hrs interview. even at waist length when she entered prison, she would have had a bob cut. hair grows about half an inch a month so mathematically it’s possible if you already had long hair coming in. hair hair just wouldn’t have been long though at the start of this trial or during other interviews that she’s had over the years.

The Sheriff has always had an open door policy for any inmate to do interviews. If you think about it, the more an inmate talks, the more it usually hurts their case. I think it’s smart. Equal access for anyone and everyone…knowing it usually gets used against them in the end. Smart.

Her hair was always swept up and thrown away, THIS is what is so “big” of her. Of course, a similar claim could be made for her feces. I think the whole shebang–the snooping into lives and consultants and the search for the lowest common denominator has to simply stop. A system of impartial jurors mixed with random, not screened citizens who would be in the minority, must be a better way. Countries are changing. The small claims courts in the country has to get much bigger while the educational system provides a working use of the law to use in these larger courts without “lawyers” who can be kept for the big finance jobs and criminal cases. Delayed and expensive justice is not a good.

Once I can get assurances like the new laws are providing, I can get more comfortable with the DP. Just ordered a Scott Turow non-fiction book about the debates on the death penalty. I think a DP and then 23 years spent on appeals like the last AZ prisoner is a bit insane.

killing Travis was the best thing she ever did.. no wonder she feels no remorse.. she’s too busy congratulating herself!

Somehow, we have lost a sense of shame in this country. We play by rules in one corner and then pretend to play by rules in another. The defendant had the right to a fair trial. Not a career boost or a clemency campaign or the most of everything her defenders could hope to grab. The citizens have rights and victims have rights and the press does not have a greater right than either.

It’s not a constitutional right to do network tv interviews when you’re a convicted killer. Someone tell #jodiarias that.

I guess since she didn’t go on and on and on when she spoke to the jury, this is her change to go on and on and on ad nauseum. :-(

  84. Susanne Fischer
    05/21/2013 at 7:48 pm

The most glaring example of her self pity party (read victim) was that she STILL did not say she was sorry for killing Travis. Oh, she skirted a little around the issue, saying she now realized the pain she caused his siblings AFTER their victim impact statements. This didn’t occur to JA before this????? And yet she continues to try and backhand his ghost to the jury for his total lack of appreciation of her fineness. (read imaginary abuse)

And I do stand in total awe of her self righteous belief that ONLY she can clean up the environment due to the negligence of the prison in not managing a proper recycle program, teach the illiterate to read and write, help the deaf learn sign language, teach prisoners Spanish (that ought to come in real handy in the chow line) and produce a fine line of future Michael Angelos.

Thank you God, I hope this is the very last that I will see of this sorry excuse for a human being.
As I am lacking a decent bottle of red wine to celebrate, I will scrounge in my kitchen where I will blow the dust off the neglected bottle of cooking sherry and retire to the

  85. 05/21/2013 at 7:50 pm

ok Ive watched Juan and I don’t know what else he could have done… he seemed to cover everything in his usual style. He kept in on point and reminded them the mitigating circumstances had to outweigh the extreme cruelty. That she’d had a full life up to 27 and you can go fight wars at 18. That she was not to be trusted and simply had no friend willing to stand up for her despite what they may have heard from her on the stand.

That Travis will never get to have a photo album depicting life passed 30, that she had been 27 when she killed him and now she is 32, Travis is and always will be 30.

He stepped through the mitigating factors .. wiping of the relevant slate one by one and he did it in a cool, controlled no nonsense manner.

To me.. I see absolutely nothing wrong with what he did. He seemed to have the perfect balance of sombre vs forceful. Reflecting the nature of the proceedings.. that this was serious, that it was the jury being asked to weigh up the heinous nature of the crime to what had been presented to them as mitigating circumstances.

Robherrrrr and others thinking he was somehow below par…..exactly what more did you expect from him?

She was talking about how Steven said he did not want to see his brothers killer anymore. She said if you give me life that will happen. The first thing I thought when I heard that was that it was a threat that if she gets death, she will never go away, keeping this tied up in the courts for as many years as she can, making them miserable and prolonging their suffering.

Either way her case will be tied up with appeals for years. Her case is big enough so that she will always have representation of some sort. When I was at the Appeals Court last week I felt so bad for an entire family that was there cuz a convicted murderer was trying to Appeal his conviction. I thought to myself that no matter what, victims are never given peace with our system. Never! It sucks.

Even though she’ll have some inmates fawning over her, if she gets LWOP, there will be others who will not appreciate her “better-than-you” attitude, or will want to make a name for themselves among the other prisoners, or who really have suffered terrible abuse and know she’s full of shite, who wish they had had a good man like Travis, and I don’t think that’s going to bode too well for Miss Murder.

Its part of the whole culture. The divorced wives of Atlanta and Beverly Hills and shows on fat and small people. Shows on people who clean. News that takes 10 minutes. A billion dollars of ads spent on campaigns for essentially the same party of the 1%. It’s the emphasis on the superficial on vipers like the Kardasians or octomoms or the “doctors” that feed them on TV.
The whole culture is faux impressed because the windows that are shown to them are fake, It like a Margritte painting when you look at you see a painting. Orthe “artist” in a Ne wYorker cartoon that was in th emidst of absolute splendor in nature and he was painting a self portrait. We’re sinking as a culture.

As much as I hate this murderer, I hate Wilmott and Nurmi equally as much. Heres hoping a big fat dose of karma bites them both in the ass! And I dont want to hear that they were doing their jobs, shes entitled to a defense, blah blah…They conducted themselves despicably throughout this trial. A human being would not do to the Alexanders what those two helped to do. At this point I want death for her mostly because those two will feel its a victory for their side if she lives and will have no problem showing it to the Alexanders in open court.

Dewey, I’m totally with you on that one. I only WISH they were eligible for the DP along with their client. Couldn’t believe how obnoxious and strident Wilmott was today, although why I’m surprised I don’t know. Still, I just couldn’t believe she was still playing Jodi off as the victim and trashing Travis. And Nurmi’s whining yesterday. I agree, they’re despicable. Though despicable isn’t really a strong enough word for the two of them.

Sorry, but my morbid curiousity (gee, heard that before?) was intrigued to watch Hodi one last time (in her element), thinking the burden of a death penalty might have shaken her out of the fog. She has a large herpe coming up on the lower lip that Shurf Joe’s makeup couldn’t cover, and she’s still playing with the cameras and attempting to be coy. Barf!!!! Praying for the ultimate DP so the Alexander family can finally grieve.

  119. Robert exits Rotterdam
    05/21/2013 at 8:41 pm

Ok Im hitting the books. No TV No more wobo. I’ll read you all later tonight and tomorrow about any reports of wobo as the new Barbara Walters. They’ll probably start a TV show in prison with wobo as host–something she always wanted. All she had to do to get it was become a “celebrity” by slicing up a good guy. Cameras shouldn’t be allowed; but if so, no one should be interested. The media is th eone who shoves it down the throats. The same media that sold the idea of a single gunman in Dallas. Americans used to ask more questions and hold higher standards. No more.

    • Lisa M
      05/21/2013 at 9:21 pm

You know what we all need to do? Watch the movie Chicago. That musical completely encapsulates the rabid interest of the media in “celebrity” murderers and reminds you that it isn’t something new, and that we can always look forward to a new star to take the place of the old one. (HLN is already teasing the trial with that other woman who murdered her BF– although she’s a little bit like sloppy seconds– and I don’t mean that as a compliment to Jodi even if it sounds that way, but this other woman looks a little worse for wear) I mean, I never thought in my wildest dreams anyone could replace Casey Anthony as the media darling everyone loved to hate, until along came Jodi. So unfortunately, or fortunately, there’ll be another Jodi, and eventually no one will want her interviews, because she’s like a broken record. How much more can she reveal? She can’t continue fabricating stories about Travis forever, can she? I wouldn’t put anything past her, actually, but won’t people stop listening eventually? Her 15 minutes will end — maybe not in the next 15 minutes, but eventually, the world will go on without her as she rots in jail. And believe me, she’s not going to look pretty with grey hair. So her looks will start to go too. If it weren’t for the Alexander family, I wouldn’t care if she got LWOP; I just feel like they need more than that to give them some separation from her. Oh, and I love how she said she hoped the verdict will give them some closure. Like she’d ever allow them any closure while she’s breathing this air.

    • Lisa M
      05/21/2013 at 9:28 pm

The worse thing about having cameras in the courtroom is how they always focus on the defendant’s empty, soulless face. It was excruciating to watch Jodi just like it was to watch Casey. Still watched though! :)

  125. Lisa M
    05/21/2013 at 9:01 pm

You know what the irony of this case is for me? I remember during the verdict watch for Casey Anthony. At that time I pretty much assumed she’d be convicted (silly me.) Anyway, before the verdict came in, HLN was showing the crowds outside with signs for the death penalty for Casey and basically yelling for her head, and I remember feeling a little bit uneasy with the whole scene; it seemed a little bit barbaric to me. And believe me, I HATED Casey Anthony with a passion. (Ah, the good old days!) So at that time, I didn’t want to be a part of a crowd all yelling “Off with her head!” or throwing stones, and saw that as less than honorable.
But now, I actually feel proud of being part of the crowd shouting for her execution. I was so on the fence about the DP for her at the beginning of the trial, but I have come around to see it as the only way to stop her. After seeing that post-verdict interview she gave, I just knew she would never stop torturing this family and desecrating Travis’ memory, I want the DP just to make her shut up. And maybe she’ll still be able to give interviews, but it will take some of the sting out of them for the family, I think.

it’s like a lot of narcissists and psychopaths who are con artists.. they take jobs that make them look oh so caring.. or befriend invalid’s or work in aged care where they can befriend the frail.. then rip them off.

Hey, Yall. I’m good on the painkillers. Meaning I took three when I’m prescribed to take two. Don’t worry. If anything they make me mellow. And I needed mellow. I was pissed square. You should have seen me. If there is anything I’m really good at it is cursing like an epic storyteller. But I don’t do it here out of respect for the folks on here and our gracious host/s. Which is kinda funny…but anyway. I remember now that I was like this for OJ. Robert Blake no. Specter, no. Casey Anthony, no, tho there was outrage. But this, and her lies, and mercilessness…does she not think the jury is aware of her interviews and bullshit? Juror 8 just said on Dr. Drew, that when he came home today his wife was screaming at the television. I’ll keep my opinions to myself on this matter, I’ll just say that jurors have spouses, who know where they are everyday, and who have internet, and inside scoops. Who sometimes may just whisper in the dead of night, their head on the pillow, “She’s fucking evil…”

BTW: I wanna party with Dan Gibb; Juror 8.

Glad to hear you were kidding, but be careful with the extra one. . Ty for being a gentleman in front of us women!

      • 05/21/2013 at 10:31 pm

Hey, it’s funny. The VA sends me so many bottles of pills I need a storage locker to house them. I have so many prescriptions its crazy. I really only take three everyday, two for regulation purposes, and one or two for sleep, which I take on an as needed basis. The painkillers I kind of stockpile just because they come in so fast and often I just put them away.

I appreciate ya’lls concern. Thank you. Pills, or drugs, have never been an issue for me. And I am not a suicidal type. Not to say I haven’t tried just about every drug known to white man, or American Indian, at least once. But being 42 now, the heaviest thing I get into might be a toke or two from some marijuana. So I guess you could call me Johnnie Pothead, if you must.

In Afghanistan I gave a local native 10 bucks to get me some hashish; they don’t know from pot there; sure it’s all around, but with it they make hash. The guy gave me so much I had to give most of it back when I left. They loved me. Maybe that’s why they never tried to kill me, even though I had them convinced I was the local mythalogical creature that would kill them if they didn’t pray 5 times a day. I’d wear vampire fangs and growl at them in the night. The Balloo…No Zen.

My biggest problem, ladies and gentlemen, is alcohol. And what better excuse to drink, for me, than this maddening trial. But I’m at the point where I’m like: Jesus! I’m letting her kill me too. And it’s not that I take chances like driving, or walking on skyscraper ledges, I just be as productive as I can be. I might just cut my hair and donate it to cancer mice.

I didn’t mean for this to be a confessional. But what the hell? I’m not going to sit around waiting for Jodi and her make-up to give me an interview. And I am touched that ya’ll care. So there you have it.

I know that if I was in the service and saw and been through what u guys have, I’d have a drinking problem too. U guys have probably seen things we can only imagine. Just being in another country and never knowing who u can trust and being on guard every second is enough. Please know that people care about u. U have done the ultimate duty to this country and I can’t thank u enough. Take good care of yourself and I know what u mean by not sitting around waiting for jodi. • 05/22/2013 at 8:35 am

Bubble…I can appreciate your story…coincidently, i just celebrated 1 year of sobriety from addiction to pain/narcotic pills (Vicodin/Percocet/Soma/Xanaz..u get the point). It was the hardest, most horrible, challenging thing I have ever been thru in my life! It’s a rough road stopping. I was addicted for 9yrs. I took them for a back problem I had. Then my dad and grandfather died in close proximity. It unfortunately happened while I was in recovery from a major back surgery I had (and still had another 6 months of recovery to go). Long story short…started out taking the pills for back pain…ended up taking them for mental pain to deal with the deaths and my new life post surgery. I could no longer do all the physical things I once enjoyed in life. Devastated me. Last year on my son’s 12th Birthday I had an overdose and Dr.’s said it was a true miracle I lived. That was the day I decided to give my kids the mother they deserved to have. So, here I am. 1 year later.

I miss them now because Jodi has driven me so crazy I’m ready to blow lol! However, I won’t let this 3 hole wonder get the best of me!! :) Hubba Bubba….

I feel the jury as already reached a decision, but needs to sleep on it. I’m not worried, and after today’s epic Death Penalty PowerPoint, I know that she is not winning even if she thinks she is. I own my mind and emotions and she can’t have them. Other than that, I have to say that I found her elocution to be flat out hil.ar.i.ous. Really, SNL could not have done better. Jodi and DT were totally throwing the Mormon church under the bus today. That will backfire, as most know Mormons one way or another and don’t think them cult like. Nor will the jury believe that it wasn’t free will on Jodi’s part.

Where does life with possibility of parol after 25 years come in? Is that if it goes to judge after two juries can’t decide?

    • Kristy
      05/21/2013 at 10:33 pm

Judge decides at some point, I can’t remember now. But, there is the possibility of bringing in a new panel if there’s a deadlock, and that’s why Jodi’s doing the interviews, to poison the well so to speak.

    • NancyB
      05/21/2013 at 10:38 pm

No, even with LWOP she is elgible for being considered for parole after 25 yrs as Juan said today in his closing. She would get credit for the 5 yrs that she has already served so she could be out in 20 yrs!

      • truejustice
        05/21/2013 at 11:28 pm

In AZ – life with out parole (or natural life) is never eligible for parole. * of course the governor commutation, pardon and reprieve

      • truejustice
        05/21/2013 at 11:50 pm

Also , arizona no longer had a “parole board”. When she is eligible there will not be a panel reviewing her case to ensure that she has “changed” or is “no-longer a danger to society”

Release is based on criteria (minimum time served, education, good behavior, etc).

Yes but today if you re-listen to Juan’s closing he told the jury that with LWOP that she would able to be paroled after 25 yrs. JW objected – side bar – and then Juan continued to remind the jurors that on Dec 10th when they were filling out their jury questionnaires blah blah blah – Let me know if you hear the same thing, OK?

      • truejustice
        05/22/2013 at 12:41 am

I couldn’t find today’s video. My guess is that is why the defense objected. — I think jm just wanted them to know if the jury’s decision was Life having the “intent” of LWOP — she could be out in 25 – cause the judge may give her the possibility of parole.

here is the Arizona sentencing guidelines (in az judges required to follow) you can search the work Murder (upword recommended) –

They can come on by, stay til midnight and the jail will provide makeup free of charge. Does she get paid for these interviews?

No … that is why we need to get her hauled away ASAP. Prison is a whole different place! You have to put visitors on a list. They get a background check. Mail is censored, packages have to be shipped from outside vendors, there are limits on commissary, how much you can spend in a month, telephone calls are ALL long distance, etc….. I am sure she knows all this and was jumping up and down to do her interviews now! Time is now ticking for her. Tick..Tick…. Imagine any of the other high profile prisoners … we hardly ever hear about them! Her podium is nearly demolished.

Not at all “brilliant”, but Jodi never showed affection for anyone but herself. She did not even thank Wilnot today for trying to save her life! She may have smiled at Brewer. Do you mean if the jury had seen Jodi actually hugging her family? I doubt it would have impacted them. But, the jury was always called and dismissed with Jodi neatly tucked away in her seat.

Hi guys, I haven’t been able to catch up on the comments for ages but am so relieved that the case is nearly over. I do think it’s possible Juan erred in his closing when he quoted the poetry re “every death diminishes” because one thinks, every death, even hers? I do think that despite our gut feeling wanting revenge and the DP, I don’t want us to be killers like her! I feel sorry for the jurors having to make that call. My preference is for LWOP, and solitary confinement with no media. Like what Australia did with Martin Bryant, who we never ever hear from, who is rotting away in prison with no attention whatsoever. That is what she deserves, I think. To spent 70 years essentially on her own, reflecting on the horror she caused. I think DP will only provide a very temporary feeling of relief. But for LWOP to be an effective punishment it must contain a gag order…somehow…there must be a way, if Australia can manage it so can America.
Last week during the cruelty phase I was so horrified because I suddenly realised that she didn’t lie about the fog: surely Travis’s hot shower kept running the whole time she attacked him, surely neither of them stopped to turn it off, therefore the bathroom would have been full of steam, the mirror where Travis tried to see what had happened to him would’ve been fogged up, just imagining what he must have gone through, in that fogged up bathroom, just made me want to vomit…worse than usual. Oh poor, poor Travis. It’s as if I can feel the knife going in an out, and can see her psychotic deranged face….oh Travis, I hope you found there was a God, and that you can rest in peace knowing the world knows who you really were.

I believe (can someone verify ).
The jury has 2 sentencing options – life or death.
If the jury sentences her to life – the judge will decide if she is eligible for parole. In az life with parole requires inmates to serve no less than 25 yrs.
If the jury cannot agree – typically the judge will send them back and tell then to try again.
If they still cannot agree – a second jury is called and it is a retrial (penalty/mitigation phase only).
If the second jury still cannot decide … the judge will decide life or death. (if life same as above).

I have read and re-read the AZ code and I am so baffled! Here is a link to the actual code: http://www.azleg.gov/ArizonaRevisedStatutes.asp?Title=13

The relevant chapters are 7.1 and 11,

Here is what I think may be going on. (And, it explains why the jurors had to identify whether they thought Jodi premeditated, committed a felony, or both) Jodi was convicted of 1st degree premeditation. This, alone, calls for either DP or Natural Life. (AZ defines Natural Life as Life without any possibilty of parole, ever, LWOP). 7 jurors also found Felony murder. This is eligible for DP, Natural Life or Life. (AZ defines Life as 25 full years, she has already served 5).

TrueJustice: As to the above, the jury must unanimously agree on Death or unanimoulsy agree Death is not appropriate. If they can not agree unanimously, after trying, etc, then a new “jury” is impaneled. If they still can not decide unanimously, then the judge decides but between LWOP or Life. Only a jury can decide for Death.

I think, and I could be wrong, the Life and the LWOP issue grew out of the decision JM made to include the felony murder …. Given that all 12 jurors found premeditation, I think Life is pretty much out of the question.

13-1105, 1st degree Murder classification. Jodi convicted of A. 1 – premeditation, and A. 2 – burglary. 13-751, State filed for Death, Jodi convicted of 13-1105, A, 1 and over 18 years. WOBO is the biggest liar….. I’ve only become aware of how widespread interest in the trial is, but I know that a jury would be tainted if we had to redo the penalty phase…. Those things are contradictory.

BTW, in none of my interactions with my friends has anyone brought up the trial. I purposefully haven’t in order to see what others think. In fact, a friend brought up traveling next spring with the author of 1000 places to see and never mentioned that the book was part of a trial!

While I’m interested, I wait to hear someone else bring it up before discussing.

    truejustice :
I believe (can someone verify ).
The jury has 2 sentencing options – life or death.
If the jury sentences her to life – the judge will decide if she is eligible for parole. In az life with parole requires inmates to serve no less than 25 yrs.
If the jury cannot agree – typically the judge will send them back and tell then to try again.
If they still cannot agree – a second jury is called and it is a retrial (penalty/mitigation phase only).
If the second jury still cannot decide … the judge will decide life or death. (if life same as above).

I have read and re-read the AZ code and I am so baffled! Here is a link to the actual code (link provided in next post, as now I am in MODERATION AGAIN!! SORRY!!)

If WIS comes by, here are my notes and we would love some clarity! Thanks!

Nancy: I heard him too. That is what I am trying to explain above. I think it happened as a part of the felony murder. Recall the jurors had to specify premeditated, felony or both? Given that all 12 voted for premeditated, I think it very unlikely the Judge will sentence to anything less than LWOP.

        05/22/2013 at 1:58 am

Thanks :) did see the part if jury not decide 2 times , judge only chooses life or natural life. Good catch!

I think where the life option comes in is in 13-752 – (Q) it does talk about things the court must consider – evidence in trial (all phases) and aggravation /mitigation factors. There is

I thought the reason they had to announce if premed was 1st deg or Felony — is a right of the accused. There where 2 charges that basically lead to the same outcome but she has the right to know what she has been convicted of.

      • HJ Madison
        05/22/2013 at 2:25 am

True: I think 13-752 Q has to do with sentences which are overturned. If the State did not ask for the DP, or they did ask for the DP and it was rejected, then the resentence must be either LWOP or Life, based on 13-752, A … and we are back at premeditation vs felony. Crazy!

Oh for sure … and like one of the recent articles suggested, we know Travis was conflicted about this sexual behavior and his faith. No doubt that is a big reason why she lured him in again for one last “sin” and then may have taunted Travis with it while he died! What could be more cruel! She truly is satan’s spawn – and I am not even religious!

I am not offended by Jodi doing the interviews. I mean, I am and I’m not. My feeling about it is that it only hurts her in the end. The jurors are certainly not immune from knowing that she is doing this. Like someone said, they have spouses, kids, etc. When criminals open their big mouths, it only hurts them. “Whatever you say can and will be used against you…” Even when I was the crime victim the prosecutor strongly advised me to not talk about the case until it was completely over. Do you see Travis’ family talking? No. They are protecting the case. Jodi is so stupid. Let her talk. The Sheriff is not stupid. He’s a good sheriff. I’ll admit I’m not happy about the makeup, but other than that, let’s allow this to play out and allow the jury to bring back their verdict of Guilty! All’s Well That Ends Well!

Okay. I’m gonna break on my facebook posts. I probably lost a few friends along the way. But as I see it, about a hundred thousand folks’ll see my post by morning. Ever seen Anchorman, Taladega Nights? The director is an old friend of mine. And he’s an activist, with 5000 friends. I posted my plea to about 100 people with 5000 friends or more or less.

Make those calls please. If you tweet, tweet. I’ll be in touch with Huff Post in the morning, after I make my calls, and I’m brewing a scathing report about the whole f-ing fiasco. Fuck this.

We are strong, and we are legion. We must think outside the box now, and we must at least try, AT LEAST try! We must put an end to this torture! For the beautiful young man who brought us all together: Travis Victor Alexander, and the honor and dignity of his family. NO MORE! WE MUST TRY!

Call everyone! Hassle everyone! The phone and the keyboard are our weapons. Call ABC, FOX, NBC, Arizona Republic…En Masse. Call CNN, and alert them of our fight! Are you disgusted? Then please join me. We are an army for justice. I’ll do all I can, but I can’t do it alone. You guys want her to shut up? Then help me! How can we let this evil just roll over us, and more importantly, the Alexander Family, and not do a thing but sit around and ask the same limp ineffectual questions. Want some action? Then lets go to war; lets put motherfuckers on the spot!!!

Someone asked, “What do I say?” Say what you want, but no threats. How many of us are on here? A hundred? Then a hundred people will call the governor and the attorney general, and the jail, and on and on. We need to be pro-active, people! We need to rise from helpless spectators to empowered activists. Our battle cry: NO MORE BULLSHIT!

We need to find out the names of the interviewers, call their networks and stations, and shame them. You’ve seen the crowds outside the courthouse. Do you doubt we could reach them? They’re waiting. They have time.

Instead of saying, man what a case that was, I’d rather say, man, we crushed their balls like peeled grapes. Imagine years from now someone says, “remember that trial?” and you know you helped throw a monkey wrench into her works.

One thing I know, folks, is that I’d rather die trying than laying down and letting life roll over me. At the very least, we have the power to TRY. And if, or when, we fail, at least we tried.

Tomorrow I’ll wake up and continue my assault. I have one friend and after I hang up they will start calling. And I will be typing. Then I will make more calls. District Attorney’s office. We MUST protest! And we have to be swift. Because overnight, those interviews she did will be edited, and teased through the day. Lets see if we can stop it!

    Here is my Facebook plea:

Jodi Arias, convicted killer, now on a media blitz while jury deliberates her death sentence. This devil mercilessly slaughtered an angel, Travis Victor Alexander. Please call AZ Governor Jan Brewer: 602-542-4331 and voice your disgust. And if you care, why not call Attorney General Tom Horn: 602-542-5025, and suggest he get a handle on this circus, whose master is a psycopath bent on slandering a good man’s name. Remind them their state is being held hostage by a convicted killer, and “America’s Sheriff” is abetting it!

Lets go ya’ll. Get pissed! Help me. Back me up and I’ll lead the way! You want some action? Follow me!!!

Bubble: I will call! But I don’t think I can ever say “I crushed their balls like peeled grapes!” Yikes!!

Listen though, as soon as that jury comes back she will be toted off to prison. And in prison her little games will end. When was the last time any of us heard anything from any prisoner? Even OJ, except for his recent hearing, we haven’t heard from him. So, take heart, justice, real … hard-core… forever… justice is coming for her. It is just a matter of time now. And, the most important part is that at long last Travis WILL rest in peace and be a part of our hearts forever. 😌

I am so mad. I got served with more legal papers from my ex-husband, Shawn, today. He’s asking for $65,000 more in legal fees and I think he’s asking for spousal support again. Even though I passed the new law in CA last year making it illegal for someone convicted of felony sex crimes against their spouse from collecting financial awards, nothing stops him from continually harassing me in court by filing these motions. Thank God we do have a new Judge now. We go to court on these issues June 4. I filed a previous motion now that the law is changed to ask that I stop paying on the court ordered legal fees of $47,000. I pay him $300/mo currently. I want to stop paying. Oh—and he wrote in his declaration that I stopped paying on the court order months ago. That is a complete lie. I’ve never missed a payment ever, up to and including this month. How do people just get away with lying like that? Why do I bother paying if I’m just going to be accused of not paying anyway? I just wish he would leave me alone. I don’t want to pay him money, and I don’t want him to pay me money. :(

It’s unfortunate; made a mistake, married the wrong guy, had kids, left him, now he’s gonna fullfill his promise to destroy. And me, the knight on the horse, ends up swept up into the horror. Which to me, so sorry to say Crystal, I view as a game of chess; out smarting evil. But that’s my game; war. It fucks up all but him. Because he has no concept of humanity, and all trapped in the crossfire suffer. And that is real PTSD. Jesus. And here I want to save you. And In my mind, I can. Today.

So sorry Crystal. Very very frustrating. How in the heck does he accomplish all this tomfoolery from prison? Are you currently responsible for paying for his lawyer? Do you have strong confidence in your lawyer? What does your lawyer say about the new judge? Better than the previous fool? Barbara Bentley sure would understand the enormous stress that the legal motion “stalking” takes on someone’s day to day general wellness. My heart goes out to you. You will ultimately persevere and win. In the meantime just maybe he’ll make someone mad enough in prison who will knock the living daylights out of his thick vindictive skull. One can hope.

I know earlier everyone was talking about the sneaky digs Hodi was dropping during her mitigation. There were 2 that got me thinking the last couple hours. I don’t know if I can explain it like I’m thinking it but ill try.

#1. Sam said Travis was the glue that held the family together. She (Sam) went on to commend him for keeping them together and keeping them strong. What does Jodi say? That Travis told her his gramdmother was the glue that held them together. I think Jodi wanted to dismiss Sam’s claim as to say-“No Travis wasn’t this great guy who glued them together like Sam says. He was abusive. The glue was his grandmother, NOT Travis…Travis said so!.”. Jodi wanted to once again take the spotlight and positive points away from Travis. ( In her mind-No, you got it all wrong! Travis wasn’t the glue, it was his grandmother)

#2. Sam told the story of Travis’s grandmother becoming ill then passing away because Travis’s death sent her in a downward spiral. In Jodi’s mind that can’t be possible..no way could she have been responsible for that! Not innocent Jodi. Sooo, once again she had to tell the story of the grandmother getting sick and Travis being worried she wasn’t going to make it…as if to say “see? She was already ill and not well long before I killed Travis so that wasn’t my fault!”

How did either of these stories have anything to do with her mitigation? Nothing! There were subtle hints and digs pertaining to things that she tried to clear her name of.Things Sam brought up in her VIS. I’m sure there’s more we will find as we watch it again.I hope these make sens…if not, ignore me ;)

  166. NancyB
    05/22/2013 at 2:18 am

We don’t really know why the defense didn’t put Darryl on cause he gave a media interview yesterday and was sitting front and center in court today. PP was a no show yesterday and the defense claim she changed her mind due to threats against her and today the skank in her allocution to the jury mentioned that PP wasn’t there because threats were made against PP & her 11 yr old child.

The judge read a statement today that outlined what PP would have testified to if she had been available or something like that. ABC claims that PP notified them that she had 2nd thoughts because she could not say that JA had an abusive homelife and she felt badly because she believes JA has wonderful parts of her but also feels badly because Travis is gone.

Juan stated on Monday when PP didn’t show up that when he had questioned her last week she wanted to plead the 5th regarding questions concerning her drug convictions and also he exposed that all the $$$$ that she got from the licensing fees from the TV networks; she failed to disclose that information to CA Dept of Human Services and she is required to report income bi weekly because she is on public assistance.

The defense got her a lawyer to advise her last week and that’s why I think she was a no show but of course the defense spins it to look like witness intimidation and files another motion for mistrial, requested to get off the case which were all denied. Why the defense did not put the family on is probably for the same reasons they didn’t use PP. With either mom or dad Juan could prove through the video’s with Det Flores that JA had been a huge problem going back to her early teens, with major displays of temper, acting out etc. which JA and defense did not want revealed. This re-cap is all just my interpretation.

This abbreviated “interview” is ridiculous. Her father was no more “fired up” to plead for her life than I am, and her defense team is NOT the one who decided against having her mother testify, because as we all know, WOBO is running that show. And who is this mystery cousin we have yet to even hear of who suddenly appeared and talked her out of begging for the death penalty “for [her] mother’s sake”?

The only time she told the truth, though she doesn’t realize it, is when she said “Oh, I just don’t think about it” when asked how she can live with the image of Travis’s slit throat in her mind. She is the same with all the images, and all the thoughts of what she did. Anything she doesn’t like, she just has the attitude, “Pfft, doesn’t concern me, so I just won’t think about it.” Co-workers said she was that way at work all the time; if she was in trouble for coming in late (or not at all), breaking something, messing up an order, it just rolled off her back because “that doesn’t apply to me. I am above that.”

The WOBO is the very individual for whom the phrase “She couldn’t tell the truth about the time of day.” was coined.

She did manage to get the word “contemporaneously” into the conversation so we can all be impressed by her vocabulary! (See convo between doncahis and myself earlier.)

WURMI MENTIONED A CERTAIN CASE LAW AS THOUGH IT CONTROLLED THIS PARTICULAR CASE. It does not. It seemed as though this criminal lawyer had put his feelers out, to see whether he could use [to his benefit] his own interpretation on a re-lie of the Case Law of Strickland vs. Washington, and Rule 6.8 of the Arizona Rules of Criminal Procedure, titled Standards for Appointment and Performance of Counsel in Capital Cases. While the use of this factor remained unknown, he pounced (in order to strike fear into our hearts and try to make a power play). This criminal lawyer had seen our reaction to the threats that had ben used [to keep Court watchers in line], and it was possible that [gauging from the reaction] there was still more taxpayer money to milk — even though almost two million dollars had already been drained out of the Treasury for the defense of his psychopath client. From his whiny opining, one would have thought this specific Case Law and this particular Court Rule would have been able to show how he could do what he wanted under the threat to Judge Stephens of a mistrial. This criminal lawyer [playing a Jodistein] threatened to derail the case, whining about how his client was being forced to have her constitutional Rights violated, when getting substandard treatment (by the criminal lawyers, themselves, no less) who could only provide ineffective assistance of counsel — NOT the real thing, for which they had been paid over one million dollars (through the generosity of the people of the State).

A Florida case, that originally arose from Miami-Dade County (in the Eleventh Judicial Circuit of the State of Florida), is the case cited by a member of the State Bar of Arizona [Wurmi], as he has laid the groundwork for his client to try to escape the death penalty, under a claim of ineffective assistance of counsel. The case is Strickland vs. Washington, 466 U.S. 668, 104 S.Ct. 2052, 80 L.Ed.2nd 674 (U.S. 1984). In that particular case (that made its way through the federal Courts to the United States Supreme Court), a decision was eventually made in regards to the provision of an attorney in a death penalty case, that involved an opinion as to when the services of an attorney are so inadequate that there would be a violation of the Sixth Amendment to the United States Constitution, due to an ineffective assistance of counsel claim. The particulars of the case have been detailed below:

In Strickland, an Indictment had been issued charging David Leroy Washington with three capital murders, among some lesser offenses and morally repugnant ones [like torture]. His Court-appointed lawyer seemed to think it was OK to let his client allocute to avoid cross-examination. There had been no request for a pre-sentence investigation or psychiatric examination by defense counsel. In addition, there was no real preparation for the Sentencing Hearing. So, there were no witnesses to help present certain mitigating circumstances to the Circuit Court Judge, after Washington had plead guilty to the commission of the crimes. Due to these decisions made by Washington and his Court-appointed lawyer, he had been sentenced to death for these murders and was placed on Florida’s Death Row (in Raiford [the same place where Ted Bundy met his end]). Washington applied for relief by filing a Petition for the Writ of Habeas Corpus, after his State Court remedies had been exhausted. The case, filed in a federal Court, in the United States District Court for the Southern District [of the State] of Florida, laid out an ineffective assistance of counsel claim, showing his lawyer had not sought any character witnesses and had not requested a psychiatric evaluation in preparation for his Sentencing Hearing. Because the denial of the Great Writ had been reversed by the Eleventh Circuit, the State of Florida appealed, and the Superintendent of Prisons for the State of Florida was named as the plaintiff party, when the case proceeded to the United States Supreme Court as Strickland vs. Washington.

Because Washington had made a decision to enter into a plea colloquy, waiving his Right to a Jury Trial, and also waiving his Right to an Advisory Jury at the Capital Sentencing Hearing, the Court-appointed defense counsel was hamstrung in preparing a viable defense. The defendant had chosen to be sentenced by the Trial Judge without a Jury recommendation. At least the State was prevented from cross-examining the defendant on his claim and from putting on psychiatric evidence of its own because of the decision to enter into the plea colloquy. Unlike the case brought against Jodi Arias, the defendant (in the Strickland case) could argue that the defendant’s remorse and acceptance of responsibility justified sparing him from the death penalty. In support of the claim of ineffective assistance of counsel, the defendant was able to submit fourteen Affidavits from friends, neighbors, and relatives stating that they would have testified (if asked to do so). However, as recognized in this Case Law, “The affidavits submitted in the collateral proceeding showed nothing more than that certain persons would have testified that respondent was basically a good person”. Thus, all of these Affidavits would not have had any effect in establishing ineffective assistance of counsel on the circumstances shown to the Court.

Justice Sandra Day O’Connor delivered the opinion of the Court, in the case of Strickland vs. Washington, by initially providing the description that “This case requires us to consider the proper standards for judging a criminal defendant’s contention that the Constitution requires a conviction or death sentence to be set aside because counsel’s assistance at the trial or sentencing was ineffective”. Then, writing for an 8-to-1 majority, the Court formulated a simple, two-pronged system for establishing incompetency claims. In the first prong, the defendant must prove that the criminal lawyer’s performance is so shoddy that it falls below “prevailing professional norms”. In the second prong, “the defendant must show that there is a reasonable probability that, but for counsel’s unprofessional errors, the result of the proceeding would have been different”. However, the establishment of the new two-prong test (that defined the constitutional right to effective legal representation in criminal cases) did not help David Washington, in that the aggravating circumstances of this defendant’s crimes were so overwhelming that the lack of the presentence report and dearth of psychiatric evidence [that had been omitted because of the worry held that the evidence would hurt the defendant’s plea for mercy] would not have changed the decision (as the aggravators would have outweighed any factors that might have been offered in mitigation).

The majority’s disposition of the [Strickland vs. Washington] case does not favor the claim made by Wurmi in the case of the State of Arizona versus Jodi Ann Arias. The [Case] Law was established, that “A convicted defendant’s claim that counsel’s assistance was so defective as to require reversal of a conviction or death sentence has two components. First, the defendant must show that counsel’s performance was deficient. This requires showing that counsel made errors so serious that counsel was not functioning as the “counsel” guaranteed the defendant by the Sixth Amendment. Second, the defendant must show that the deficient performance prejudiced the defense. This requires showing that counsel’s errors were so serious as to deprive the defendant of a fair trial, a trial whose result is reliable. Unless a defendant makes both showings, it cannot be said that the conviction or death sentence resulted from a breakdown in the adversary process that renders the result unreliable”. [466 U.S. 668, 688.] (To the detriment of any scheme being dreamt by the criminal lawyer, Wurmi,) The conclusion by the Justices (that had finally established the system that is still in use today) was that “Failure to make the required showing of either deficient performance or sufficient prejudice defeats the ineffectiveness claim”. [466 U.S. 668, 701.]

Whatever Wurmi has planned, by the use of this particular case, does not seem to suit what is believed to be his goal. He has taken many steps to protect his client from a death penalty, willing to even find a way to describe his services as ineffective assistance of counsel. Today or the next couple of days will prove out whatever the scheme is. However, one thing is certain. Wurmi has misread Strickland vs. Washington. He can not use this case to benefit Jodi Ann Arias. Additionally, the Court Rule he has tried to pass off as also being helpful to his cause is in the same category as this case. It does not and will not work for his client’s benefit, no matter how much he twists himself to make it appear he has or has not been effective to fit the scheme he has planned.

I BELIEVE THAT WURMI DOES NOT HAVE A LEG TO STAND ON WITH HIS THREAT THAT HIS CLIENT WOULD NOT BE PROPERLY REPRESENTED, WHEN USING THE CASE LAW [DESCRIBED ABOVE] AND THE COURT RULE [DESCRIBED BELOW]. All right — So, how does this particular Rule of Court benefit this criminal lawyer (and his client)? What a toad. Sorry about this post [that takes up a lot of space], but I thought it necessary to reveal that which Wurmi believed was his saving grace. (I waited until late in the evening so it would not cut into the flow of the comments.) Now that we know that it is a mere Rule governing standards of appointment for defense counsel involved with capital cases, it kind of loses its spookiness.

I don’t know how to post that little snippet, where Wurmi warns all of us about the power of this Rule 6.8 [and the Strickland case, to knock him off, and put Jodi Arias in charge]. If anyone can post that little snippet where he is pontificating about these matters (of the unknown [Case Law & Court Rule], that were supposed to strike fear into our hearts [yeah -- right]), that would be appreciated. That way, everyone would be able to see the way that Wurmi has threatened us, believing we would not look up what he was claiming as his back up in his fight (that was supposed to somehow devastate that which the Court would have to rule [properly]).

Rule 6.8. Standards for Appointment and Performance of Counsel in Capital Cases.

    a. General. To be eligible for appointment in a capital case, an attorney

    (1) Shall have been a member in good standing of the State Bar of Arizona for at least five years immediately preceding the appointment;

    (2) Shall have practiced in the area of state criminal litigation for three years immediately preceding the appointment; and

    (3) Shall have demonstrated the necessary proficiency and commitment which exemplify the quality of representation appropriate to capital cases.

    b. Trial Counsel.

    (1) Lead counsel. To be eligible for appointment as lead counsel, an attorney must meet the qualifications set forth in section (a) of this rule and the following:

    (i) Shall have practiced in the area of state criminal litigation for five years immediately preceding the appointment;

    (ii) Shall have been lead counsel in at least nine felony jury trials that were tried to completion and have been lead counsel or co-counsel in at least one capital murder jury trial;

(iii) Shall be familiar with and guided by the performance standards in the 2003 American Bar Association Guidelines for the Appointment and Performance of Defense Counsel in Death Penalty Cases; and

(iv) Shall have attended and successfully completed, within one year prior to the initial appointment, at least six hours of relevant training or educational programs in the area of capital defense, and within one year prior to any subsequent appointment, at least twelve hours of relevant training or educational programs in the area of criminal defense.

    (2) Co-counsel. To be eligible for appointment as co-counsel, an attorney must be a member in good standing of the State Bar of Arizona and shall have attended and successfully completed, within one year prior to the initial appointment, at least six hours of relevant training or educational programs in the area of capital defense, and within one year prior to any subsequent appointment, at least twelve hours of relevant training or educational programs in the area of criminal defense. Section (b)(1)(iii) applies to co-counsel.

    c. Appellate and Post-conviction Counsel. To be eligible for appointment as appellate or post-conviction counsel, an attorney must meet the qualifications set forth in section (a) of this rule and the following:

    (1) Within three years immediately preceding the appointment have been lead counsel in an appeal or post-conviction proceeding in a case in which a death sentence was imposed, as well as prior experience as lead counsel in the appeal of at least three felony convictions and at least one post-conviction proceeding that resulted in an evidentiary hearing. Alternatively, an attorney must have been lead counsel in the appeal of at least six felony convictions, at least two of which were appeals from first or second degree murder convictions, and lead counsel in at least two post-conviction proceedings that resulted in evidentiary hearings.

    (2) Have attended and successfully completed, within one year prior to the initial appointment, at least six hours of relevant training or educational programs in the area of capital defense, and within one year prior to any subsequent appointment, at least twelve hours of relevant training or educational programs in the area of criminal defense.

    (3) Shall be familiar with and guided by the performance standards in the 2003 American Bar Association Guidelines for the Appointment and Performance of Defense Counsel in Death Penalty Cases.

    d. Exceptional Circumstances. In exceptional circumstances and with the consent of the Supreme Court, an attorney may be appointed who does not meet the qualifications set forth in sections (a)(1) and (2), (b) and (c) of this rule, providing that the attorney’s experience, stature and record enable the Court to conclude that the attorney’s ability significantly exceeds the standards set forth in this rule and that the attorney associates with himself or herself a lawyer who does meet the standards set forth in this rule. Section (b)(1)(iii) and (c)(3) shall apply to attorneys appointed under this section.

I wish I had enough money, I’d buy a huge, prominent billboard along the route that JA is transported to/from court. On it I’d display that pic of her hairy azz (I think even the city of Mesa would forgive & allow it).
Would love to see her face if she had to pass that & know that it was there for the world to see. I don’t think even her inner most narcissist would be happy to be in the public like that (but then, you never know, she might love it).

Oh gawd! If you do decide to put up that billboard be a buddy and let me know before hand so I can change my route lol! U too funny!

I hope JA get’s the DP, but if she does get LWOP instead, I wouldn’t be that upset… To think of her locked up alone, for 23 hrs aday- forever- makes me feel good.. She will soon be forgotten..And when we do see her again ,for her appeal, we’ll say “OMG, what happened to her”?, like we just did with OJ last week.. .. My beautiful grandaughter donated her hair when she was 9 yrs old and again when she was 11..I never thought about where the hair came from . I wouldn’t want JA’s hair for my wig if I needed one..If she doesn’t get the DP and gets life, I will email the judge and give reasons why she will kill again.–.9mm gun ,a couple of knives and another road trip planned in a rented car?? Who was next??

She is STILL going on and on about her being abused. She has completely convinced herself it really happened. I feel so so bad for the Alexander family. Everytime they turn their tv on her ugly face will be there spewing these horrible accusations over and over. Stabbing them in the heart over and over just as she did to Travis.

I just can’t fathom how and why this is able to happen after being convicted, especially for 1st degree murder. The jail actually purchased the makeup for her. What kind of sick shit is that? I thought All rights were revoked once convicted? I wonder if there are other jails that disallow this to go on? Are there loopholes because of the 5th amendment? If so, why not verbal, written interviews instead of videos and makeup? Sooo, basically, she is going on a media tour now. Doing Interviews to make women aware and encouraged them to document all their abuse.

Did anyone see when the interviewer asked her how she felt about being the most hated woman in the world?… Her response? Oh, i had no idea about that…i feel very loved.. the people that write me blah blah blah… what a loser! If the jury does the Alexanders wrong there is going to be a serious uproar!

I’m dying to hear what everyone on here thinks when they wake. I think today is another stressful, aggravating day. :( sighhhhhh

I could not agree with you more…it is disgusting. Makeup? Really, sheriff? It is disgraceful that you allowed this circus but also have the stones to have everyone acquiesce to her makeup demands, too? Beyond repulsive.
I just watched a piece of her ABC interview on GMA and I am happy to report the makeup did not help. No soft lens on this interview — in contrast to the first one aired after her verdict. And I don’t think she did herself any favors telling the interviewer (forgot his name) that she didn’t realize he was a “hater.” Awwww, little skank was pissed he didn’t throw her softball questions. This is a farce … and I think today will be another stressful day as well, BG. :-(

Bailey stop torturing yourself with the interviews. Youre listening to the rantings of a lying murderer. Dont buy into it.. watching those interviews could make you go blind!

  177. 05/22/2013 at 8:27 am

Hi Bailey – its mind boggling that she has been given so much leeway to do these interviews and demanding make up … wtf?

Her giving interviews right from the beginning is why this trial is as big as it is – she was the catalyst that created it. If she hadn’t done the 48 hours i know I wouldn’t even know about, same with Syn. It came up in a YouTube suggestion email to me right around the time the trial started so I’ve been watching ever since. Her crap about not getting a fair trial because of the media is hypocritical because being “famous” (or really infamous) is the best thing that has ever happened for her in her view.

Her backflip on wanting the DP was amusing. All the more controversy to fuel the media interest. Is her script being written by a TV Soap?

I am so hoping for a really quick verdict of DP. I think that “see my t-shirt I designed for other survivors like myself” was the unmitigated disaster of her script. To me that was a slap in the face to the jury or giving them the finger, however you like. “You didn’t believe my defence of self defence but i’m sticking with it whether you like it or not”. If I was on that jury i’d be really pissed with her and shows she hasn’t owned her responsibility for her actions. If she can’t take ownership and acknowledge what she did was wrong then she does not deserve any mercy. Having heard so many juror questions, they have been pissed with her from the time she was giving evidence, so I really hope that she just gave them the easy edge to give her death. Her smart arse attitude will be her downfall – GOD I HOPE SO.

  178. 05/22/2013 at 8:39 am

Oh and before I go to bed, that bitch WillNot needs a good slap from the Bar Association. How can she get away with saying to the jury that they will be “killing” her? They will decide her fate according to the law which allows for the death penalty for a crime where she killed an innocent man. She is not innocent and she is being tried for that crime which has the death penalty as the ultimate penalty. She did it to herself, not the jury. Geez Louise !!

I have not watched any interviews, nor will I. As far as the makeup, was it said specifically the jail bought it for her, or just that she got it from the jail? She has purchased mascara from the commissary in the past, and it is standard for basic cosmetics to be available for purchase even in prison. Prisoners have to purchase all their own hygiene products such as shampoo, conditioner, soap, etc. I’m sure there isn’t a great variety, but at least the taxpayers aren’t paying for it.

Did the Judge lift the injunction against her giving interviews? I wasn’t watching yesterday, so I’m a little behind.

  182. 05/22/2013 at 9:49 am

Well, I watched Jodi’s little speech this morning on YouTube and it’s all I can do not to hurl. Random thoughts swimming around inside my head…the problem with giving Arias a life sentence is that she would not be “a force for positive change” in the general population. No, it would be just the opposite. It would enable her to spin her evil web of lies & deceit & create psychodrama after psychodrama after psychodrama for years to come. She will be Queen of Cellblock C. I am against the death penalty, but I would like to see her on Death Row for about 30 years then commute her sentence to LWOP. A few decades in solitary would fix her little red wagon–oops, make that a white one. Red stands out. ;) BTW, her lame ass statement yesterday was as loaded with delusions of grandeur as it was tone deaf. To hear her tell it, she’s a real Renaissance Woman! Awesome Jodi is an environmentalist. Awesome Jodi is a teacher. Awesome Jodi is wise. Awesome Jodi helps cancer victims. Awesome Jodi can communicate with the deaf. Awesome Jodi is bilingual. Awesome Jodi is an entrepreneur. Awesome Jodi can counsel other survivors of domestic violence because she is the Greatest Survivor of All. Awesome Jodi is an artist. Awesome Jodi is wise. Awesome Jodi is kind. Awesome Jodi can grow hair. Awesome Jodi would be a benevolent force for good amongst “those criminals”. See, Jodi isn’t really a criminal because she was the true victim, get it? Awesome Jodi would be the most awesome, awesomest mostest awesome mostest mostest awesomest inmate EVAH!!!!!!!!!!!! Why, she’s practically Mother Theresa! The only difference is the inconvenient waist & ankle shackles.

I am not a supporter of the Death Penalty, but I would like to see her get it if for nothing else than to spare her fellow inmates from a lifetime of manipulation and lies.

The DT conveniently embraced Dr. D’s DX of Borderline Personality Disorder as a backdoor to show an abusive childhood and to absolve JA of any responsibility (this, after dissing Dr. D. on the stand will not be lost on the jury–another boneheaded move by the DT). I just can’t bear to watch these interview of hers for any length of time. Does any brave soul out there know if she is using the diagnosis or was that just a one time ploy by the DT?
