Great news! I’ve been at tennis this afternoon and keeping watch on Twitter then sitting at the pub with my phone waiting for the picture of the seal to change. Such a relief for Alexis and Rachel and Michele’s sisters. Didn’t see any expression on MMs face. Wonder how Dipsy is feeling? Nervous I hope because they may come after her now. Is that a possibility? The deal was not in relation to this matter.

OMG! Wow! I was really worried the lack of a homicide finding by the MEs would bring back an acquittal. I’m shocked the jury came back so quickly. So happy for the family.

Just read about McNeils son Demian. I had no idea he committed suicide. That is so tragic. The wreckage this guy has left in his path is just unbelievable. This verdict has to be such vindication foe his daughters. The fact that they lost their brother and their mother and have had to fight for McNeils indictment on murder against the ME’s findings, I mean these women are heroic. Then to have to withstand the defenses attempted vilification becauqse of mental illness. Wow. I hope they finally feel get some peace now.

I feel asleep next to my laptop, shortly after 1am last night. I am thrilled this morning, thrilled that Justice was done!. I hope this verdict provides the survivors some measure of peace although it won’t bring back their Mom/sister.
This sociopath belongs behind bars, thank you Utah! I was really worried about the verdict after hearing about the “bobble head” Juror who was agreeing with everything the defense said. I read somewhere that he did this the whole trial and that maybe it was some kind of tic?
Thanks so much everyone for their insightful discussion but mostly thanks to you donchais for your daily trial summary.

Jean C always looks for something positive to say about the defense. I was so disappointed that HLN kept her and not Beth.. But I admit her report did concern me too.

Congrats to this jury. Clearly this was not the Anthony jury…..thank goodness. I hope they read about all the evidence that was kept from them. No doubt they did the right thing.

I’ve just finished catching up from where I left off at 6 PM last night. I got home from a quick dinner and set up my feeds and settled in to follow on (gulp) HLN. Never made it past 6:30. I was so relieved to hear about the guilty verdicts.

I have time now blocked out for the Jan. 7 sentencing hearing. He will also go on trial on December 3 for sex charges filed by Alexis. It’s not over for him yet.

Being a felon with a few of them and prison time under his belt, I expect him to get more than the minimum of 15 to life. I want this scuzz bag to die in prison, afraid to talk to anyone about anything after learning what a “snitch” can do to him. God bless those men and I hope they all get some consideration and turn their lives around after having done the RIGHT THING.

This is an EXCELLENT blog, and the only one I follow for these trials. I read every single entry, Donchais, and every comment, too. Please don’t discontinue your effort to bring insight to these complex trial proceedings. You do an awful lot of good work here, and I just want to THANK YOU for doing this for your readers, I know the time commitment is enormous, but so worthwhile. Whereas, this trial failed to generate the thousands of comments that the Arias trial did, I think part of that was due to the toll that trial took on all of us when the jury couldn’t reach a verdict. Talk about frustrating! This one was speedy, in comparison, and produced a much better outcome. It renewed my faith in the jury system. I sincerely hope you persevere and continue your valiant efforts to keep us informed through your stellar trial coverage.

Oh yeah, RIGHT ON, RIGHT ON, citizens of the Provo community which gave us this jury. Ring them bells! This devil has finally been given his due. I can’t imagine the fortitude those daughters of his had to have to continue to fight for justice for the dear mother they lost at his hands. Talk about a heavy heart! Mine goes out to them. And what an loss for their families for generations to come. They will suffer forever. Thank The Lord the jury wasn’t afraid to hand down an absolutely JUST verdict.

Remember, folks, it’s not over yet. Stay tuned at 1:00 PM MST, 3:00 PM EST for the sentencing hearing! I am awaiting the victim impact statements from Michele’s daughters, sisters, nieces. I don’t know how many will speak, but I will be there in my heart with them.

Also, December 3 is the date for the next MacNeill trial with Alexis facing down her father for sexual molestation. While I have my doubts it will be broadcast, I’m hoping to follow the coverage, at least.

Thank you Marilyn~ calendar marked. Just don’t know if I can ever get his goofy face out of my mind. Will he be representing MM for his next case with Alexis, do you know? So glad for his guilty verdict and would be so good if the same happens again for Alexis.

I’m just wondering if he’ll just plead guilty in that case since Alexis got his admission on tape. Claimed he thought she was Michele… RIGHT! NOT!

Also, when on HLN After Dark, Gillian did say that, while still living in Orem, MM touched her in “weird” places. She told Michele, who took her to speak to her therapist about it. Nothing was ever mentioned to MM. Michele must have been so very afraid of him and didn’t want to deal with this accusation with him.

Marilyn — I think this is some of the info you wanted about MM’s upcoming trial. The charges are criminal, not civil. He will be tried on one count of forcible sexual abuse and one count of witness tampering, which are second- and third-degree felonies, respectively. The charges were brought by an “adult relative” — I’m assuming Alexis — who said MM put his hands down her pants, then tried to make her sign and have notarized a statement saying he did not touch her.

The charges were originally filed in 2007, but dropped just before the case was originally scheduled to go to trial; they were refiled in 2009. The trial will begin 3 December and is expected to take only two days.

The excerpt below is from a very informative 2010 article from The Deseret News. Because of the age of the article, much of the info has now been covered in the murder trial and by Donchais’s excellent reporting; however, it did clarify (for me) who all the kids were and what happened to a couple of them. I think MM should thank his lucky stars he isn’t in even bigger trouble than just the murder and obstruction charges in the death of Michele, and the sexual abuse and witness tampering charges from Alexis. He is a pure predator. (I’m sorry I can’t figure out how to italicize the following to show it is a quote. The link to the entire article is at the end of this excerpt.)

(Quote) Since her mother’s death, Rachel has received dozens of phone calls from people who say her father hurt them. Many women have called to say Martin either propositioned them, had sexual relations with them or raped them. Some have cried on the phone to her for hours.

“It’s horrifying to hear their stories and how their life has been affected by my dad,” Rachel said. “He really knew who he could take advantage of. I thought I had an idea of who my father was, but I had no idea. The father that I knew was a fictional character. It was an act the whole time.”

One of the women from their LDS ward told Rachel she was propositioned by Martin over the Internet. Another man said he witnessed Martin raping someone years ago when Rachel was still a toddler. Rachel wishes these people would [have] come forward earlier, because she believes her mother would have left him. “To think if my mom would’ve known, her life would’ve been saved.”

Karen Wright, now 56, was the first woman to call Rachel. She claims Martin took advantage of her 14 years ago when she was his patient at the BYU Health Center. Wright had eight children and told Martin she was recently divorced and an “emotional basket case.” She remembers Martin telling her he was not only a doctor but a lawyer and that he drove a Jaguar. He said he didn’t have a good sexual relationship with his wife and that she was beautiful.

“He manipulated me,” Wright told the Deseret News, “but he managed to do it in a seductive way. I didn’t tell anyone because I thought it was my fault. I think he knew I wouldn’t report it. That’s why he made me think I was so attractive.”

Wright said Martin also had sexual relations with her a second time in his office shortly thereafter. She said these assaults had a profound effect [sic]on her life. She was wracked with guilt until she found Rachel’s contact information on the Internet and learned more about Martin and his history with other women.

But the alleged abuse wasn’t just outside the family. Martin also has a case pending in court for sexual abuse of Alexis.

“Alexis stated there had been two incidents where she had been fondled by her father” within three months of her mother’s passing, a police report states. Martin admitted in a recorded phone call with Alexis that he inappropriately touched her while she was sleeping because he thought Alexis was his wife.

“Mr. MacNeill was reported to have told his daughters that even though his wife is dead, he is still a sexual person and has desires that need to be met,” according to Pleasant Grove police records.

Alexis wants to protect her family and others from her dad. “I don’t want him to hurt anyone else.” (End quote)

Marilyn, you are right about there being a civil suit between Alexis and MM, but I can’t find any information on that.

During deliberations, there was a question sent out by the jury regarding a surviving spouse automatically inheriting the estate of the deceased. There was a discussion between all parties about how to respond, and there seemed to be some confusion about what the jury was really asking.

The female defense attorney took that opportunity, however, to publicly take a swipe at Rachel, as well as reveal what was said at a sidebar while Rachel was testifying. She was talking about MM giving three of the kids $5,000 each at Easter, and then going over his will with them. She (the attorney) said something to the effect of “Remember, we asked to approach, and I said ‘Rachel is a loose canon’ and I was concerned about that. I was afraid she was going to bring something up which she wasn’t supposed to, but she spit it out anyway before anyone could stop her.” Rachel just rolled her eyes, shook her head, and chuckled. One can tell these girls are well used to MM and those acting on his behalf to never pass up an opportunity to be rude and condescending, and they will be glad when they never have to be in the same room with him ever again.

    From The Deseret News . . .

Prosecutors were thrilled with the jury’s handling of a largely circumstantial case that was fraught with hurdles, not the least of which was an investigation that wasn’t started until years after the woman’s death, despite her pleading family.

Grunader said his office studied other cases around the country where multiple medical examiners . . . failed to find physical evidence to conclude their victims had died as a result of homicide. But one similar case from Texas stood out because the suspected killers had obstructed justice by tampering with evidence and manipulating a crime scene.

“We had evidence of that [happening] here,” he said.

That seemed to be what convinced the MacNeill jury to convict, said Cluff, who met with the panel along with prosecutors and her family members about 1:30 a.m..

“A couple of them said that (MacNeill) destroying the evidence was really key,” she said. “It just speaks so loud.”

Grunander declined to discuss the substance of his conversation with jurors, whose names have not been released and so far have not responded to requests made through the court to speak with media.

“They were very convinced,” Grunander said.

    http://www.deseretnews.com/article/865590264/Jury-convicts-Martin-MacNeill-of-murdering-his-wife-in-2007.html?pg=3

All that scheming MM did — planning his actions and his reactions, insisting on Michele having plastic surgery, having another physician prescribe the cocktail of meds he wanted Michele to take, over-medicating her, making Alexis return to school when she didn’t want to, establishing his alibi at work, forcing Ada to discover the body, draining the tub, calling in the neighbors as witnesses, calling colleagues to inform them he was running a code, disposing of evidence, manipulating the scene, etc. — and that is precisely what proved to be his undoing.

I’m so glad that this monster was convicted. He’s done nothing but leave tragedy, death, and destruction in his wake. I so admire his daughters for having the courage to recognize what a monster their father is. I can’t imagine how shattering that must have been for them. You know we’re wondering as well if she could be charged as a party to the murder or co-conspirator, however, it was mentioned during the trial that all the text messages could not be recovered, only the record of incoming and outgoing records. We bet the content of those messages could very well have had evidence that she KNEW this murder was taking place. On the day he did the deed he did text her as the phone records indicated so as evil as both of them are, we’d be willing to bet that he said something to her in those text messages that IT was done. There is no way they didn’t talk about this in their text messages. Her hands are just as dirty as his. We even think she was at the house with him that day before Ada got home. Michele’s pants didn’t walk off by themselves! We think she was there and may have taken some things with her! She may get away with her involvement in all of this, but eventually she’ll get hers too!!

Yes…that’s correct. MM and Dipsey stole her identity after he shipped her back to the Ukraine. They were found guilty of identity theft as well as Federal Fraud charges and went to prison. She did 2 years and he did 4. During the testimony of one of the daughter’s (think her name was Sabrina) she mentioned Giselle but that she had not seen her for quite some time and did not know where she was living. She’s probably kept a low prophile because she feared retaliation from MM if he got out. Hopefully the family will all come back together now that he’s been found guilty. They probably all lived in fear of him!

She says in her interview that marriage was not for her…..Hah….then how come she wound up with a 4.5 ct diamond engagement ring from MM?!! She did not walk away empty handed….her Sugar Daddy gave her a BMW, paid for her education, paid for her bills, gave her a bank card that he paid for, we know she had Michele’s blazer because she soooo blatantly wore it (and what other wardrobe did she take?), 4.5 ct diamond ring, his will left everything to her, and then moves right in Michele’s home and lives her life as if nothing ever happened!! How sick is that?! She probably trades men more often than she changes her underwear!!

Catbyte4~ sibling Giselle was on HLN this week past. She said she was living in Las Vegas trying to get her life in order. She had previously contacted Alexis but felt it was not a warm reception and decided to not contact anyone further. I have also wondered about Elle. Have not heard anything about her at all. Anyone know if she is still in this country?

    • Schaeffer
      11/12/2013 at 12:06 am | #45

When Giselle first came back from the Ukraine, she was placed in a structured foster home to help her deal with what happened to her. Michele’s sister Linda, who testified in the trial, is now Giselle’s adoptive mother, but I also heard Giselle say she has no contact with any members of the family, and now lives in Las Vegas. I’m not sure what her relationship is with Linda, but I definitely got the impression she has nothing to do with her adoptive siblings. I wonder if the cousin Jill, who went to retrieve Giselle from Ukraine, is Linda’s daughter? Also, I know Giselle has had a lot of problems with her credit because of Gypsy stealing her identity; yet another example of the collateral damage those two caused.

I also heard Gypsy’s married name, from an early previous marriage — the one that produced the daughter she ditched — was Gypsy Jill Jensen. No wonder Alexis and Michele thought she was a stripper!

She was interviewed on HLN. Their website has some excerpts of it. She ended up living with Michelle’s sister but for some reason that wasn’t explained, she has never been in contact with any of her adopted sisters since returning. I guess they don’t have family functions? She was in Las Vegas during the interview.

Jodi Arias Trial Update Today: Judge Sherry Stephens denied a motion by Jodi Aria to fire her lead attorney. This is the second time Jodi Arias has been denied a request to fire Kirk Nurmi. She attempted to have him removed in June.

During a closed-door hearing today, Maricopa County Superior Court Judge Sherry Stephens issued a brief order saying she explained her reasons for denying the motion by convicted killer, Jodi Arias. Jodi Arias says Jennifer Willmott, her second-chair attorney, has been doing most of the work on the case.

Jodi Arias said Nurmi has no “people skills” and treated her ‘like an interruption to his day.’ Jodi Arias said she no longer trust him.

Jodi Arias delivered a twelve page handwritten letter saying that she no longer trusts her lawyer Kirk Nurmi. Arias says that she hasn’t seen the Nurmi since the end of the first phase of the trial on May 23. Jodi Arias’ complaint says he “does not listen or respond to my concerns.” In the motion, Jodi Arias wrote “Mr. Nurmi, however, in his utter poverty of people skills, simply said to me with contempt, ‘You’re not going to get your way just because you throw a tantrum.’ Judge, this was no tantrum. Far from it. This was a full-blown emotional meltdown. I wasn’t throwing a fit, I was falling apart. Having known me for 3.5 years at that point, Kirk Nurmi should have easily discerned this, but his failure to do so shows he lacks the capacity for empathy and chooses anger over attempting to understand any impairment his client may be experiencing in direct relation to the case and court proceedings.”

Jodi Arias continues “Mr Nurmi has forgotten more about my case than he remembers, and therefore the breadth of knowledge one would think he has after four years on this case is lost to him,” she writes. “He seems unable to access the majority of this knowledge via his own memory.”

The jury found Jodi Arias guilty of killing her ex-boyfriend Travis Alexander, but could not decide whether to sentence the former waitress to death or to spend the rest of her life in prison.

In the complaint, Jodi Arias wrote that Nurmi has “no tolerance for my emotional and psychological shortcomings.”

Arias is waiting for a possible retrial on her death sentence

Jodi Arias was convicted of first-degree murder in the 2008 death of Travis Alexander. Defense and prosecuting attorneys have been working out the new sentencing phase

Hi Bubble! Good article…thanks for sharing! If JA isn’t careful she’s going to get herself the death penalty just because everyone is SICK OF HER AND HER WHINNING!! Even her attorney is showing outward signs that he’s tired of her running the show. JA identifies herself as having “emotional and psychological shortcomings”….HAH! No shit….ya think?!! Get over yourself woman….you don’t seem to have any shortcomings when it’s time to get in front of the cameras when your attorneys say NO! 12 pages of a lot of nothing!! Shut-up and go away…..far far away….like to HELL where you came from!!

      • 11/12/2013 at 9:25 pm | #50

Yeah, poor Jodi. Her attorney had “no tolerance.” Just as she showed no tolerance for her dog, or being broken up with.

Yea….and she certainly didn’t show any tolerance when Travis was walking out on her!! Remember JA….what goes around comes around!! You didn’t show tolerance and now….you’re NOT GOING TO GET ANY IN RETURN!! This is YOUR Hell only YOU created! Live with it now!!

While flipping channels the other night, I stumbled on Juan in the process of convicting yet another Phoenix criminal. This guy murdered then hid the body of his girlfriend, and it has never been found. I got in on the show just at the end, but the criminal was on the stand, and it was obvious he could give WOBO a run for her money in the lying department. (He was good, but WOBO is better.) Juan was doing his usual rapid fire questioning, and then he suddenly said “I have nothing further” and sat down. He can imbue that simple phrase with so much disdain and disgust, it is if he is saying “I have nothing further for this witness who is such a liar and a loser, I won’t waste another minute of my life with him. He doesn’t deserve it. Just fry him now.” That is exactly how he said it during WOBO’s trial, too, and he does it so well.

Unfortunately, I didn’t ever catch the name of the murderer or the woman he killed, or else I would share it.

Well that sounds like it might be an interesting trial…:)

Oh, I loved to see Juan in action again. Where did you find this show? Please share.
      Thanks

Sorry, I was just flipping channels and saw it, and the program was in its last 15 minutes or so. It was probably on one of those channels that recycles news shows like Dateline or 48 Hours. I could tell the trial predated WOBO’s based on Juan’s hair color and glasses, and the fact they didn’t refer to him as “the prosecutor in the Jodi Arias trial.” If I ever see Juan in action again, I’ll try to get the info.

ritanita and essem58,thank you so much for posting those juror interview links. It is gratifying to listen to their conclusions and know that common sense (and justice!) prevailed. Having read the comments from Spencer about being too exhausted both emotionally and physically, to try the sexual abuse case filled by Alexis made me laugh. I am sorry Spencer but can you imagine how emotionally and physically exhausted Alexis is? I wonder if Martin may have a basis for appeal because of incompetent counsel!

No media coverage for sentencing retrial for JA

    http://www.facebook.com/Justice4Travis/posts/562810040461809

JA probably doesn’t want people to see how ugly she has become since her conviction and has lost her cocky smart arse attitude so can’t face the cameras. Miss Picture Perfect needs some air brushing?

Ritanita – Thanks so much for all of the links. Disappointed that Judge Stephens is not allowing any media coverage.

Thanks for those links Nancy, disappointed about no rolling cameras but the big picture is that it has negated her request for sequestration and thus improved the potential jury pool.

What is presented at a sentencing retrial? The Judge predicts will take 2 months! Given the guilty with cruelty verdict is set and it is only the penalty sentence to be determined, what is the trial procedure?

Thank you for all the great links! We’re just getting caught up with our reading. Wow what a smart jury! They did everything they were supposed to do and applied the circumstancial evidence very methodically. Using the cause and effect common sense method laid it all out for them without any doubt. This was a well run trial. Good job Judge in keeping control of this trial and keeping it moving forward!! Now if only Judge Stephens could get a clue!!

Beans – If you read this, could you let me know if MMD is OK? It is highly unusual for her to disappear just days prior to the conclusion of the trial. If you speak with her, please let her know I miss her comments and hope everything is A OK. Thanks.

Been out of town and came back to the news about Judge Stephens’ decision. To tell you all the truth, there are other trials coming up soon that I’d like to follow. I’ve seen every painful moment of the trial and will be just as happy to get my news from accurate MSM links with a tinge of What’s His Name’s slanted press as well… you all know I’m a glutton for punishment. :)

Based on the amount of interest in the case, I’m also hoping there are local bloggers in attendance.

Just saw a promo, and Dipsy will be on Dr. Phil Tuesday. Too bad the jury didn’t ask Dipsy for her definition of “skank” because now we know beyond a shadow of a doubt she is one!

For someone who claims to have moved on from MM she certainly is making the interview rounds! She wouldn’t open up on the stand and now she can’t keep her mouth shut@
