Casey Anthony Hearing – ‘Tempest in a Teapot’

In what had probably been the most anticipated hearing to date, the defense didn’t fail to deliver a mountain of bull manure for the court to dig through!

Much of what led to the high anticipation were the baffling antics of the defense.

Take for instance Cheney Mason’s very public and childish meltdown over Kathi Belich.  Couple that with Mark NeJame’s blistering response to the TES motion by the defense that contains the very descriptive bad behavior of Mason and what have you got?

An embarrassing portrait of a rude, arrogant, egotistical person who, for lack of a better description, has the maturity level of a spoiled two-year-old! 

But wait!  We aren’t done yet!  Mason again went beyond the pale with his nonsensical motion to keep the evidence reviewed by defense experts from being released to the public.  Ok, it wasn’t so much the public…his diatribe was really just railing against the media and had no legal precedence behind it.

Just what is up with Mason?

So, the entire ‘happy family’ is in court today however, even though they are sitting together the emotional distance amongst them is huge.  George basically kept his focus on the ground and the scowl never left his face.

Judge Perry wants to deal with The TES issue first and Baez asks for a quick sidebar.  That ‘quick’ sidebar lasted about 15 minutes during which Judge Perry was rather animated.

Ultimately, the defense withdrew the motion and Judge Perry ruled they may review the documents again and Mark NeJame and Jose Baez must work together.

Perry said he would appoint a special magistrate to oversee the review and in what came as a surprise to me, the defense may take notes!

Next on the docket are the infamous 911 calls. Cindy was called to the stand and Judge Perry sent Lee out of the courtroom for the duration of her testimony.

It seemed to me that the past few weeks were busy for Cindy as she came off as well rehearsed and she was able to remain calm and in control of her anger.

Baez took Cindy through all three 911 calls before Linda Drane Burdick took over on cross.

There were no explosions, but several things really struck me.  During the entire time Cindy was on the stand Casey just stared at her.  Casey attempted to remain stone-faced, but the stare was beyond icy and her disdain for Cindy was all over her face!  Several times Casey wrote notes to Mason and Baez and while she was writing quickly, it was with anger and fury.

Cindy totally threw everybody for a loop when she announced from the stand that, till this day, she believes Caylee is alive!  A lot of folks want to know why then did they have the memorial?

“Smells Like a Dead Body in the Damn Car.”  Burdick led Cindy through her experiences as a nurse as well as George’s experience in law enforcement and whether they could recognize the smell of decomposition.

Next, an older looking Lee took the stand and mouthed, “I love you” to his sister which made Casey go into her crying (but where are the actual tears) routine.  What was humorous was Linda Drane Burdick’s reaction!  She said, “I assume you aren’t talking to me,” to which Lee replied, “absolutely not!”

The only really remarkable facet to Lee being on the stand was Cheney Mason’s cross.  Now, don’t forget that Burdick had already taken Lee through the events of the 911 calls.

Mason’s questioning goes along the lines of Lee arriving at the house and (paraphrasing) what George was saying, and there wasn’t excited activity going on…. Lee had to correct Mason by saying when he arrived at the house, he was the only one there.  So, Mason is pretty clueless as to the facts in this case, he apparently hasn’t reviewed much of anything.  Heck, we all know more about this case!

All of this is moot because ultimately the State only wants the calls in to show how Casey progressively manufactured the Zanny story over a period of time.

Judge Perry ruled call #3 was an excited utterance – and all the calls come in!

The defense won one, as Perry will keep the evidence review list sealed. The discussion focuses on whether the two-dozen or so items the defense really reviewed, out of hundreds, are work-product. No biggie, the entire evidence logs have already been disclosed.

While I have pages of notes, this is a pretty quick wrap-up of the highlights of the day – the hearing went on for over 3 hours, the feed from the court had to be chased around because different sites would drop it at different times, but we really didn’t see the ‘Tempest in a Teapot’ that was expected.

What is incredibly sad is the hearing occurred on the two-year anniversary of little Caylee Anthony being reported as missing and she has yet to see justice.

    MC acts terrible. He must be taking lessons from Bozo on how to act like a spoiled child!

    I bet the tension when Cindy was testifying was thick enough to cut with a knife!

    First of all I want to address CM… boy oh boy!!! Okay, deep breath… what’s going on with CM? he has no clue of what he is doing. As you said we know more about the case than he does and this is a fact! Hello!! Why did he call Debbie Polisano to testify in the first place, that lady was terrified and in my layperson opinion she didn’t help the defense at all. I would suggest for him to drop the booze. Just kidding! CM is just coming as an arrogant spoiled child to me as well. He didn’t impress me and certainly CM is not helping “convicted felon indigent KC’s image” at all. We have now “smirky JB” and “arrogant CM”, take your pick… what a pair!!!! KC is more screwed than ever. Can I say screwed? Hope so.
    LDB did a tremendous job yesterday, she knows what she is doing and so does Mr. Ashton.
    I am not sure Cindy is trying to look insane or if she is insane. What are the reasons behind her saying she thinks Caylee is alive? She should make a decision because she was helping defense to dig dirt out of Mr. Kronk and pin Caylee’s death on him.
    Here is the thing, George testified in front of the grand jury and KC was indicted for murder. Cindy made the 911 phone calls KC was arrested and the calls will be admitted in trial. Now, if the Anthony’s could step up for their granddaughter it would be very peaceful for them instead of trying to blame everybody else for Caylee’s murder instead of admitting the inevitable. If they really think that profiting off Caylee’s photos and use National media to point the finger at somebody else is certainly not helping their daughter, neither helping their image as a family. It would if it weren’t for Florida Sunshine Laws.
    BTW, JB was with IIRC her name Beth Caras (InSession) during the JVM show last night, hiding from the cameras. How surprising!!
    I am very pleased the 911 calls will make to trial, it is a day to celebrate. Caylee will get justice.

    Lol FRG! It truly was a long and strange hearing.

    As much as I have issues with Baez, I do find Mason’s weak attempts at humor (notice he’s the only one who laughs at his jokes), and his fumbling and mumbling not only annoying but hard to understand!

    Who knows, maybe he realizes this is a lost cause and wants to get fired so he can concentrate on the big political case he signed onto in June!

    I am happy you said that. CM really believes he is funny! His attempts to make jokes are pitiful, can’t laugh at his jokes, they make me more annoyed. Yep, he is the only who laughs.
    Talking about wanting to be fired, where is LKB??? Will she be the next to exit???
    I forgot to mention “giggly boy”, if you allow me. Well, what’s there to say about Lee Alexander Anthony? He has a girlfriend Mallory… Cindy is her mom… he wears tube socks. May I pass on that??? I better leave it to the professionals. LOL

    Donchais, thanks for the post. It was an exhausting hearing for some reason… As I’ve been napping through today’s InSession during the commercials mainly, it is becoming obvious to me that in order to defend their insistence that the third 911 call was made after an extended period of reflection, they had to put on a case for the State! Linda Drane Burdick had an easy time with Ms. Polisano, Mason got all the information from her she could have wanted!

    As far as the smell of a dead body goes, I don’t understand why the defense was trying to establish that Cindy was told by George. The State had any number of references in LE statements that Cindy knew that particular smell. The questions about that by Baez were laughable. Obviously, the smell of decomposition will be “different” in a auto trunk where a dead body has decomposed in the Florida heat over a period of days. It will be a lot STRONGER than in a refrigerated condition such as one finds at the morgue and, IMHO, in the underheated rooms at funeral homes.

    Interesting that it was Lee’s overture to Casey that brought her to tears. I don’t know if she cried real tears or not; I did see her dab a kleenex to the edge of her eyes.

    Loved Burdick’s reaction though, lol!

    Any thoughts donchais, on whether the defense is in a better position without Ms. Lyons?

    Casey learned that kleenex dabbing from Cindy, lol. Poke your eye a few times and it turns red and ya may get a tear or two! I actually don’t know if Casey can cry. With her years of fake cry practice, she may have forgotten how to really cry.

    When Andrea Lyon left, I’m sure the ego clashes quieted down. Mason, as DP qualified, will have to take over the mitigation now.

    Not being funny, Mason wears 2 hearing aids and still has trouble hearing the proceedings and I don’t know if he had a mini-stroke or what, but he rambles and mumbles to the point of distraction.

    So, is the defense in a better position? Can’t say, but Casey sure as heck isn’t!

    You know Donchais, that’s one of the things I really like about reading here….you do not mince words!

    I was disappointed we didn’t get to hear Mark NeJame argue his response, but I’m sure the judge and the defense got the message. Judge Perry must have felt it necessary to protect the integrity of the court by not allowing that slap down.
    Any bets if the defense will even bother to go look at those files? They may do it since the judge appointed a special magistrate, although a date wasn’t set.I wouldn’t be surprised if they change their “strategy” based on the forensic experts examination of the evidence.

    Baez and Mason were smirking and pretty smug about Perry’s ruling on the TES files, but I am truly hoping that NeJame DOES file a bad faith motion as the defense has wasted NeJames time!
    Gee, I don’t know…does the defense have a strategy???

    FRG, I think as long as Casey can get a “supposed” jury seated this “Chewbacca defense” is their best defense! Thanks for the bonus too…..I learned how to make the Chewbacca noise from another video on that page.
    Thanks to Musicman and Ritanita we were at least able to see NeJame’s argument in print…..no wonder Mr. Baez rushed to the bench to withdraw their motiom.

    If NeJames were to file a “bad faith’ motion what kind of sanctions could the defense face, if any?

    I am sorry, I thought you hadn’t seen.
    That’s what I thought. If everybody can have access to you FB it’s because you “allowed” those people, right? Now, that’s the lowest of the low!!!! As you wrote on Val’s… “Doesn’t Baez have other things he should be doing?”… Absolutely!!!
