Casey Anthony Lawyer Raced To Hospital After Inserting Foot In Mouth! Or, is this how Jose extricates himself from the case?


Oh good lord, Jose Baez has really done it this time or maybe he really wants to be disbarred!

After filing a motion to seal taped phone conversations with career criminal and current inmate Robin Lunceford claiming he had no idea the conversations from the prison were recorded, we now learn from prosecutors that Mr. Baez is full of foo-foo dust!

Baez requested a protective order placed on the phone conversation, insisting he was not aware he was being recorded (uhhh, Florida law, bud!) and that the discussion represented “work product.”

According to a response filed by Linda Drane Burdick today, “The assertion in the defendant’s motion that Mr. Baez was ‘never made aware that the call was being recorded’ is simply untrue.”

The prosecutor’s response says the Baez Law Firm received two calls from Lunceford, an inmate at the state Department of Corrections’ Lowell facility near Ocala. The first call came in at 6:34 p.m. and was answered by a Baez legal assistant. That call started with a recorded message, according to the filing.

The message states the call is a “prepaid collect call” from a state inmate and that the call “is subject to recording and monitoring.”

An arrangement is made for the caller to call back at 7 p.m. to speak with Baez directly. At 7:01 p.m., inmate Lunceford calls again and “Mr. Baez hears the same warning detailed above and accepts the call,” Burdick’s response states.

After Burdick told Baez the warning occurred at the start of the call, she said Baez filed a supplemental motion saying he had “absolutely no recollection of hearing any recording by the correctional facility.”

“Regardless of the state of Mr. Baez’ faulty recollection, it is clear that the call was not an unlawfully intercepted communication under [Florida statutes],” Burdick argues. “It takes little imagination to envision that calls being received from a prisoner in a correctional institution are being recorded negating any reasonable expectation of privacy Mr. Baez may believe he had in the call.”

Baez claims no recollection of the message saying calls from the prison were recorded. He notes the second call was transferred by his secretary to his cell phone.  He has no idea if his secretary heard a recorded message.

Well, the easiest way to clear this latest boondoggle up, is to drag him and his secretary in front of Judge Perry and have both of them swear under oath they are telling the truth!

Sophomoric, unethical and probably illegal Jose, but I sure as hell don’t expect much more from an ‘alleged’ attorney who spends his time crying about bloggers disrespecting him instead of acting like a professional lawyer.

By the way Jose, you may want to – quick like a bunny – have someone measure the length of your nose!  That’s how we bloggers caught Pinocchio in his lies!

Your honor, I request you to instruct Mr. Baez to remove his foot from his mouth...

    Jose Baez was obviously so excited to be getting a call from another potential scapegoat/witness/liar that he forgot his lawyer hat. That happens when the lawyer hat is nothing more than a beannie with a pinwheel attached.

    If I read Baez’ motion to seal or protective order (whatever) correctly. It seems he thought just because the state was able to seal the letters to Casey’s penpals and have time to investigate them he was entitled to the same. (He even mentioned that IIRC) I’m beginning to think some of those letters were a “plant” whether her idea or his IDK?

    This has definitely got to be the dumbest thing he has done so far. Not just the fact he had to know a call from jail was recorded, but the call was in May for cripes sake. That should have been plenty of time to investigate. (What’s to investigate….criminals are liars…..the fact remains his client wrote those letters.) He can claim he doesn’t remember the message the call was recorded, the simple truth is likely he just didn’t think about the DOC giving it to the state. And then to say it may have been from a contraband phone….Dumb azz!

    Donchais, I knew you would come up with a spiffy title for this one!

    Fact is, this particular Robin would be shredded on the stand, more so than your average snitch. Heck, she’s Florida’s “Snitch Queen of the Century”. Didn’t Baez Google her before taking her call? Does he really think this would help the case, or is he as desperate as he seems?

    What she has to say just isn’t worth all this trouble he’s getting himself into!

    Tomorrow, I’m going to put my microscope on all the motions, addensums to motions, replies, and replies to replies and try to put it all together! This whole thing is a big playground fight for Baez. Did so, did not, did so, did so!

    Add in his temper tantrum over the Facebook picturs and his pending home foreclosure, oh… and a capital murder case, his plate is full!

    it’s revolting that he expects the court (and everyone else) to give him a pass on this. We’ve all learned that this irrational thought process is par for the course with his client but cmon, we used to demand a little higher standard for attys.

    What was I left to say that you haven’t… uhhh, mhhh, (add Patrick’s photo from Spongebob drooling) JB suffers from the same of Cindy’s illness SMS, “Selective Memory Syndrome”. Now we have a “faulty memory lawyer”… what else has his peanut size brain has forgotten???
    As far as his FB temper tantrum (oh boy oh boy!!!) I don’t think he felt the same when he sold Caylee’s videos/photos to pay for his fees, did he? Oh, that doesn’t count right? What a scum bag this guy is!!!!!!!!!!!! Hope he loses his home and has to move into Suburban Drive, KC’s room is empty, for a mere $1,000 a month I bet Cindy would accept him there. So sick of these people.

    I have tried to check upon JB’s foreclosure and found nothing… maybe his house was in foreclosure last year, not anymore. Just trying to be fair… so, I take back JB is going to have to live with Cindy… that would be the ultimate punishment, wouldn’t it??? *wink wink*

    Aside from the fact that his poor money decisiions (lease car vs. child support)led to a long delay in his acceptance to the Bar, he has not learned money management at all!
