Casey Anthony Clowns Do It Again And Turn Hearing Into A Three Ring Circus

If you are in need of examples of bad lawyering, you don’t have to look much further than Orlando, Florida and Jose Baez and Cheney Mason.  As if acting from a never-ending script, they once again proved arrogance and stupidity do nothing for a client facing murder charges.

Baez had his annoying color charts with him and went into his bizarre explanations of pending depositions.  Example: Tony Lazzaro – Baez tells Judge Perry (you need to listen carefully) during his rambling, that a depo is scheduled and within minutes the story changes to well, it’s not really scheduled, but that’s the day we set aside for it!  This occurs during the first minute of the hearing.  You can also hear the Jeff Ashton whisper, “That’s past the deadline!”

Baez speaks of Dr. Neil Haskell’s depo.  He claims it was scheduled, but it had to be rescheduled, due to other depos. You can also hear the Jeff Ashton whisper, “No!”

Dr. Haskell is the entomologist we have known about for two years and his report was published over a year and a half ago!

Jeff Ashton states Dr. Haskell’s depo has NEVER been scheduled.  There was some discussion that his depo would take place in June, but that was never followed up on!

Baez now comes up with all kind of silly excuses as to why Dr. Haskell hasn’t been deposed.  Dr. Huntington hasn’t reviewed the bug evidence yet.

Now, hold on a minute…I distinctly recall the State’s offer to send the bug evidence to Dr. Huntington last year!!!

After asking multiple times how many expert witnesses have yet to be deposed and Baez talking in circles multiple times, he finally concedes to Judge Perry there are seven and they may be able to complete them by the end of November!

What’s pitiful is watching Baez go page-by-page through his colored charts making little tick marks with his pen and Drane Burdick can immediately come up with the number!  She is better prepared with the defense information than the defense is!

Baez makes an insane statement that they are fully booked for the next couple of months and they are not just sitting around…preparation for depositions means going through 23,000 pages of documents!

Are you telling me you read all 23,000 pages for each depo?  Are you telling me you have yet to identify, sort and catalog the documents?

The defense is trying to convince Judge Perry to push back its deadlines for questioning witnesses.  When Baez can’t think fast enough to make up an answer, he – as witnessed in the past – looks over at the prosecution and blames it on them for submitting more discovery! Over and over the prosecution points out how the defense has been dragging their feet!

I am very disappointed the Judge Perry has extended the expert witness depos until November 19!  I understand the fear of mistrial, but I am sorely disappointed the bad boys got away with it!

Now Pinocchio Baez gets caught in a lie!

He claims Dr. Haskel is scheduled for deposition for October 21.  Jeff Ashton is immediately on his feet saying he just spoke with Dr. Haskel this morning and there is no deposition scheduled!

Baez says he was scheduled but now he isn’t!!!

Have to wonder if Baez actually believes if he says it out loud enough times, it makes it true!

Next is a discussion of the defense going to the jail to depose eight corrections officers.  They were involved in the investigation into Casey’s jail pen pals.  Baez wants Casey to be there because she doesn’t know the guards by name, only by face! He also makes a snide remark about he’s not sure what the jail is up to now!

Judge Perry – “You want your client to be present during the depositions?”

Baez  – “Yes sir,”

Judge Perry  – “What does the rule say?”

Baez  – “I have to file the motion,”

Judge Perry  – “But, generally speaking, what does the rule say?”

Baez  – “Upon good cause,” Baez

Ok, I see this as highly problematic and probably creating even more delays!  My gut is that Judge Perry has some of the same concerns I have.

The defense says it will file a motion asking the judge’s permission to let Casey attend the depositions, but the judge does not seem to be leaning that way.

There is some discussion about the deposition of Amy Huizenga.  Like Tony, Amy has beat it out of Orlando and is working for a cruise line out of Miami and I’m happy she is getting her life back to some semblance of order!  According to Linda Drane Burdick, Amy’s ship is in Miami for the day on Saturdays and Amy’s attorney will make her available for deposition.

You can see Baez and Mason getting pissy about Miami and Saturday!  Judge Perry reminds them they have a deadline for non-expert depositions and evenings and weekends will be utilized to meet that deadline.  The fact that Perry reiterates the meeting of that deadline several times is an indication an extension is not happening here like it did with the expert depos!  Knowing that Amy’s in Miami on a Saturdays is acceptable to Perry and he asks what the problem is.

The ever arrogant and annoying Mason practically runs to the podium, almost shouting, “I’ll tell you what the problem is!” He proceeds to say that Amy has nerve to expect him to work on a Saturday and she should be forced to take time off and come to Orlando to be deposed!

Well okie dokie then!  One, any of you who have had the pleasure of taking a cruise, know the ship is usually on the move with the exception of some hours in various ports-of-call.  The longest layover is usually at home port – Miami in this case – as the crew readies the ship for the next cruise.

That, there, Mr. Mason, is your window of opportunity to depose Amy.  Get over your damn self!

Two, Mason has just telegraphed to the world he doesn’t give a damn about his client.  He cares so little what happens to Casey, he won’t give up a few hours on a Saturday to insure he can ‘walk out of court with Casey on his arm.’  Well done, Mr. Mason!

Oh, and while all the chatter about having a deadline for depositions is going on, both Baez and Mason get picked up on mic whispering about they each have another trial in a week or so!

Judge Perry seemed pretty dismayed that Amy hadn’t been deposed for the check fraud case!

That depo should have been done two years ago!

The defense filed a motion – bet you already figured out it was just filed yesterday morning and Judge Perry hadn’t even seen it yet – requesting permission to send Caylee’s shorts and the laundry bag that were found with her remains, out of the country to be tested.

Am I the only one who recalls this was brought up at the last hearing and it was pretty much decided…no way Jose?

The defense says its DNA expert, Richard Eikelenbloom from the Netherlands, has his own lab and that’s where the defense wants to send Caylee Anthony’s shorts and the laundry bag to have them tested for touch/trace DNA.

“This is the area of which Mr. Eikelenbloom specializes in,” Baez said.   Short of that, Baez admits the Eikelenbloom’s new lab in Colorado is being set up and should be completed in a month and the items could be sent there.

Prosecutors objected because the Netherland lab is not accredited in the United States and sending key evidence out of the country risks damage, loss and the ability to subpoena lab workers to testify.

Judge Perry ruled, “I will not be authorizing evidence to be shipped outside the United States.”

Hey, would that be JUNK SCIENCE?

Jeff Ashton makes a very valid point in court. The stalling and foot dragging by the defense is making the State’s job difficult to complete. Baez and Mason are pretty much jerking the prosecution around and putting the State in a precarious position in terms of meeting their court imposed deadlines.

Linda Drane Burdick informs Judge Perry that the defense is late or hasn’t even submitted known evidence and interviews by the deadlines laid out by the court.  She gave as an example the tape of David Lohr being interviewed by the defense investigator.

Surprise, Baez jumps up and says he has no idea what the State is talking about because it was attached to the motion!

Just gotta say, I have doubts that the TAPE was attached.  A transcription, maybe.  If I were Drane Burdick, I would have very little faith in just how accurate the transcription might be!

Oh yeah, several of the LE depos still need to be taken, Yuri Melich’s depo isn’t complete and John Allen’s has to be rescheduled!

Remaining true to form, Baez and Mason continue to be painfully unprepared and wastes the court’s and State’s time. In their arrogance, they allow the State to show them up and make  fools of them at each and every hearing! The only consistent thing about this defense is their repeated need to shoot itself in the foot!

There was so much more nonsense at this hearing, but I got a headache all over again today!

For those of you who have masochistic tendencies…

That was the most painful and embarassing hearing ever for the DT, and there is no way I would want either one of them defending me in a capital case!! Baez looked so incompetent, illprepared, and immature swiveling around in his chair….WOW!!! Didn’t Cheney learn anything from Nelson Serrano?? LOL!!!!

    Venice –

It was like watching a car crash…over and over!

What stuns me is they obviously don’t care what the world thinks. They have to know the videos are available to the public – maybe they need to be forced to watch them, lol!

  3. Venice
    09/28/2010 at 10:59 am

It was BAD! Baez does nothing but LIES…and he WAS LYING when he said he gave the State the recorded statements of their lay-witnesses. He just lies his way out of working!!!! Is this what our legal system has boiled down to??????

  4. Venice
    09/28/2010 at 11:02 am

NOTHING has been done in over TWO YEARS, and NOW they have to CRAM it ALL IN before December. Amy should have been deposed a year ago!!! Enjoy all the WORK Baez. Who takes on a losing case pro-bono?? LOL!!! What a way for Cheney to mark his legend!

  5. donchais
    09/28/2010 at 11:07 am

No Venice…our legal system has not boiled down to that! There are many fine and committed attorneys.

A lying, two-bit, lazy punk accidentally got past the Florida Bar.

Trust me, his career in law is over!

  6. Venice
    09/28/2010 at 11:13 am

How he conned the Bar is what I want to know!! With all the complaints filed against him, why is he still practicing Law????

    09/28/2010 at 11:27 am

You know what just boggles my mind?? These people who are picking this case apart find unethical behavior in the State and NOT Baez. Where has all the common sense and logic gone in the world?? It is a scary thought! Man…some people must have really been burned by the Government!!

If this is the way they are now, I can’t wait see what fools they make of themselves during the actual trial. I know they’re going for the DP, but with the amount of money being spent on this case, I just don’t know the State doesn’t keep pressuring Baez to offer Casey Life Without Parole if she owns up to it. They’ve got to know she’s not going to be found innocent. Then the State can get on to prosecuting Cindy for obstruction, etc. THAT will be the real fun trial.

    Hi jon!

If I use my fingers to count up the number of people that need to be prosecuted after Casey, I find I use more than one hand!

Casey will NEVER own up to anything – the defense knows that, I’m sure.

What is most sad is a beautiful baby girl died in a brutal manner and most seem to have forgotten that!

    09/28/2010 at 1:42 pm

This is not a murder trial anymore to get justice for Caylee. This has turned into a discrimination trial for Casey and a Law Enforcement bashing trial. SO SAD!

Make that two headaches! I’m about half done with my report and working on another one today.

What a pair these two lawyers be.

Guys, the judge warned you! Guess you didn’t listen!

Sorry ’bout your headache…Baez and Mason are running out of rope and hit a brick wall yesterday! They have nothing and they know it! I predict it will only get worse from here on! The lies are blatant and mounting faster than we can keep count of.

donchais~~thanks for yet another great Post!
I don’t comment much any more and just mostly stop by some of my favorite Sites here and read the Comments, some would call it lurking but I really don’t care.
Myself I am at a Point now that I just want to wait patiently till the Trial starts and the Truth finally will come out.
I will never stray away from what this Case is all about, the Murder Victim Caylee!
There is so much Game Playing in this Case, mostly by the Defense Team.
It is sickening to watch what is being done and said just to try to establish reasonable Doubt and/or confuse the Public in Hopes that the People won’t remember the established Facts in this Case.
Any one with some kind of common Sense can put two and two together. I don’t have to study all the Documents and know the Page No. or whatever in Order to make
my Opinion known like some of the People who write Posts on this Site suggest to be worthy to make a Comment. That is just BS in my Opinion.
I follow this Case very carefully and have from the Beginning and will follow it to the End when Justice finally will be served.
Casey Anthony has more than a few Attorneys to defend her, obviously they are not that good at it but that is beside the point. It is not my Job to defend Casey A.
The above mentioned Hearing was a joke when it came to Mr.Baez and Mason. I agree
they both were arrogant, whining and ill prepared which really was no Surprise.
I also agree with Venice this Case has turned into a future discrimination trial for Casey and a Law Enforcement bashing which is sad but again not surprising.
Judge Perry’s Ruling on taking Evidence in this Case out of this Country by stating
“I will not be authorizing evidence to be shipped outside the United States.” is correct, It is laughable to think otherwise. JMO

I was almost going through my compter screen to choke JB and CM, specially when CM had the guts to say AH was involved in a crime. W-H-A-T???? The only person involved in a crime is his convicted felon client, the one sitting in jail eating hot peanuts, breathing the same air as we do!!!! Boy, I get mad at these foolish lawyers.

What a great summary of the Hearing….as far as being masochistic…LOL….I watched again for the amusement of these “so called Lawyers” Mr Mason is Baez’s Mentor now…Any competent Atty would have had all interviews, depos from LE,friends and Family from the get go…..Baez must have paid somebody for his eighth shot at passing the Bar….I see some sanctions and contempt charges on the horizon.
