Casey Anthony – Docs Are Gone!


So, we know from Jeff Ashton’s MOTION IN LIMINE AS TO TESTIMONY OF MENTAL HEALTH EXPERTS, neither Dr. Danziger or Dr. Wietz, the defense mental health experts, has given a diagnosis of Casey .  Ashton explains the  experts’ opinions are based entirely off Casey’s statements.  Oh yeah, the defense doesn’t want anyone talking about the reports!

The defense filed DEFENDANT’S RESPONSE TO MOTION FOR EXAMINATION BY MENTAL HEALTH EXPERT .  In it they claim Danziger and Weitz are only there to rebut the State about consciousness of guilt.  If Judge Perry allows the State to examine Casey, the defense demands to be present.  The part I like best was item 5, “Should defense mental health experts, Dr. Danziger or Dr. Weitz, not be called to testify…”

Now, according to The Orlando Sentinel, “the defense withdrew Danziger’s name as a witness on Wednesday.

What the heck?

I do recall Ann Finnell proposing Danziger and Weitz for the guilt phase as well as the mitigation phase.  So, is Danziger only going toward mitigation or did he refuse to do what the defense wanted him to do and took the first stagecoach outta Dodge?

Interesting, Finnell not in court!

Jeff is arguing for the State to be able to examine Casey, but agrees with the defense that they would limit questioning to the areas the mental health experts covered.

Baez claims there isn’t a law that allows the State to demand to examine Casey.  He brings up the example of the State wanting to use Casey’s tattoo toward her consciousness of guilt.

Perry says the depositions of both doctors contain impressions based on what the defendant said to them.

Baez says they had much more information than just the conversations with Casey.

Perry asks what the diagnosis is?  The reports refer to traumatic stress?

Baez says there is no mental health defense, they will be discussing behavioral science.

Then what would the be testifying to, Mr. Baez?

They can give alternative opinions without leading to guilt.

Man, Baez is tripping all over himself!  Remember how Finnell really stumbled when asking for these two experts for both the guilt and penalty phases?  She was not her usual confident, well-spoken self.  Have to wonder if the defense totally pissed her off with this ploy and she said screw it, she would just do her mitigation piece?

Perry can’t get a solid answer out of Baez and tells him he doesn’t want to be sending the jury in and out like Pop Tarts!

Baez wants the experts to testify to alternatives theories.

Perry asks again, what they will testify about.

Can you say hearsay?

Ashton says they did not make a diagnosis of Casey with PTSD

Perry says both the Sate and the defense called him during Danziger deposition and Perry called a halt to the deposition!

Perry says that you all know what was in the deposition…he stops and calls them to the bench!

So, did Danziger pretty much give the defense a diagnosis????

After the sidebar, Perry called for a 10 minute recess.

Casey not looking so chipper today.  Think she gets the implications here!

Perry returns to the bench and Baez asks to approach!

Wowzer, Dr. Weitz is now removed from the witness list also!

We move on to the photos now.

Baez wants to exclude the tattoo, party pictures, the sticker pictures because they have nothing to do with the case.

Ashton says the sticker photo will be testified to regarding residue that was observed, so that motion is premature.

Baez counters that Yuri Melich made that assumption.

Heart stickers allowed presently till some foundation is established.

The tattoo photo allowed until proper foundation is established.

A photo of Casey and Caylee in the Morales apartment wearing the shirt that was found with Caylee.

Baez wants that out because of the shirt and the possible black eye or bruise by the eye.

Ashton says the shirt was not known by Cindy and George so it was exclusive to Casey’s possession.

Perry says if the photo is allowed a stipulation about the bruise can be struck.

Baez also wants to crop out Ricardo’s bedroom from the photo because of what the jury might speculate!

Next a photo of a smiling Casey.  Baez says not relevant.

Linda says that photo was already introduced to so that Casey was cooperative and happy with LE on July 16th and not under duress.

Baez claims a smile doesn’t mean Casey is happy.

Perry sustained the objection until time of trial where it will be fair game.

Party photos are not evidence of flight and the State will say they were after the crime.  Irrelevant to a 1st degree murder case.

Frank George says these photos are from 2 nights are a relevant to her state of mind.

Baez says the crime was over at the time of the photos.

Objection denied till foundation established.

Autopsy photos…will be allowed and dealt with at trial.

Jury selection…

Baez – change of venue is in order…Defense doesn’t think 5 days of selection is enough for this type of case, but the court’s idea to come back to Orlando is hurtful to their client.

Perry says there is also Saturday, Sunday and Monday.  The press will be all over this process.

Baez wants restrictions placed on the media.

Perry says we don’t live in Egypt or Libya and there is a thing called the 1st Amendment.

Baez wants the cameras turned off.  Perry reminds him that the Florida Supreme Court allows cameras in court and asks if there is any case that happened in.  Baez replies the State vs Casey Anthony may be the first!

Baez is such a whiner!

Baez now wants more advanced notice as to where the jury selection will take place.

He also wants to know how the people will be called for jury selection.

Perry says the same way they’re picked in Orange County…driver records.

Now he wants to know the location so he can determine how many of their folks can afford to go.  Perry tells him if he can’t find a hotel for $50, he’s in trouble!

Clarification by Jeff Ashton – Danziger is gone from both guilt and penalty phase..Weitz will only be used for penalty phase so Ashton requests they be allowed to use his deposition and report to prepare.

Baez call for another bench conference and they break for a in-camera hearing issue.

Now Perry wants both sides to meet and agree to a statement of fact to read to the jury to give them some background on the case.  That needs to be done Thursday.

Perry says he’s available for hearings next week.

What I really find highly disturbing about Baez whining about finding an impartial jury is the defense – past and present – team’s unusual, immoral and unethical behavior in cooperating with sleazy CBS and 48 Hours special to air Saturday!

One, Richard Gabriel, an Anthony defense consultant, leads the focus group. Does that look right?

CBS said Gabriel was not compensated for his efforts

Second, former Anthony defense attorney Linda Kenney Baden says Anthony lied about a nanny kidnapping the toddler. “I think everyone knows that that was a lie,” Kenney Baden says. “Her actions have been her own worst enemy.”

Baez and Mason also spoke with CBS!

So much for attorney-client privilege.

So much for not tainting a potential jury pool!

They should all be disbarred!

And, I won’t tell ya what I think of CBS!

    “CBS said Gabriel was not compensated for his efforts”– I don’t, for one second, believe this. He was paid, somehow, by someone. The networks have gotten away with “we don’t pay for interviews” for years by hiding behind “licensing fees” and whatnot. Anyone willing to associate themselves with this case and the people involved are not doing it because they are Good Samaritans.

    So it seems the end result for the day, as far as the defense is concerned is that they have ONE PHOTOGRAPH that’s out, unless they open the door by saying that Casey was under duress on July 15-16 by the big bad policemen!

    All that would take would be for Baez to ask Melich, Allen, or Wells one little question about that previously hotly contested issue!

    As bad as Baez saying the dogs didn’t alert the 2nd time to the spot where they KNEW there was a dead body!
