Christian-Newsom – Legal Wrangling Continues


Defendant George Thomas’ retrial was scheduled for October 22, but that date became doubtful as prosecutors fought Judge Blackwood’s order for retrials for Lemaricus Davidson, Letalvis Cobbins, and Thomas.

The Tennessee Supreme Court overruled Blackwood’s order granting new trials, but Blackwood again ordered new trials on June 5th.  Once again, prosecutors called foul and filed to have Blackwood recuse himself.

On June 20, Blackwood issued a new order throwing out retrials for Davidson and Cobbins so he could review the trial transcripts and will issue another decision on August 17. Blackwood also said he would announce his intention on recusal, but that hearing is scheduled for October 8.  All of the confusion indicates Thomas’ retrial will probably be pushed off until next year.

Now, adding another new wrinkle, Thomas, through his attorney Stephen Ross Johnson, is saying he has a right to a speedy trial and wants no more delays which may effectively prevent the Knox County District Attorney General’s Office from challenging Blackwood’s ruling again.

In Johnson’s motion, he wrote, “The potential additional delay that the state could continue to cause in this case through multiple extraordinary interlocutory appeals certainly impacts all of the dangers with respect to unconstitutional delay enunciated by the United States Supreme Court.”

    These monsters don’t deserve new trials. They all deserve the needle.
