Jodi Arias Murder Trial – Day Fifty-Three


Yesterday was a good day for Travis.  Juan moved quickly through several rebuttal witnesses and punched major holes in Jodi’s testiphony.  Nurmi was absolutely brutal to Deanna Reid, but she held her own.  He was especially cruel in tearing down Travis’ family and the pain was so evident on the kid’s faces!

Court reversed itself and is holding the hearing behind closed doors…accckkk.  I’d like a dollar for every minute of my time the court has wasted!  I can’t imagine being a juror in Arizona!!!

OK, all this jerking around and sad side-show, (if we ever get started here, wanna bet we start with a sidebar?) Court officially reconvenes at 1:43.

Jodi’s grandmother in court today!

Trial schedule…tomorrow 9:30 for a short while.  OMG May 1st they are to arrive at 9am till they finish and maybe after 5pm.

Jury instructions on Thursday, closing arguments on Thursday and Friday!

Surrebuttal, on Wednesday obviously!

State calls Robert Brown.  Mesa Detective in computer forensics unit.

He examined the Helio phone and recovered photographs.

He identifies photos taken on June 3rd 2008.

Juan shows a photo that Jodi took of herself she has brown hair!  Shows a second and she has brown hair.

So hair colored from blondish in front to brown June 2-3!

Can you say premeditation?

Juan done.

Nurmi up and asks how Brown knows the photos were from the Helio phone.  Brown goes through the mechanics.

That’s it!

State calls Det.Flores.  He returned to Travis’ house this year and did the investigation of the closet!

They never found a holster or gun case or bullets in the house during the original investigation!

Flores identifies photos of the closet area.  The spacing of the shelves is the same except for 3 shelves that he moved to the original positions and describes the metal pins that hold them in place.

We all have had those kinds of shelves and know what happens when ya lean on them!

This is what happens!

8 feet to the ceiling of the closet and 7 1/2 half to the top of the shelves.

Jodi truly looks like she knows her goose is cooked!

Juan done, Nurmi up…

Flores didn’t measure the shelves individually.

Doesn’t matter, we still knows what happens if Jodi stepped on it.

Nurmi on, did you measure this, did you measure this, did you measure this?

Why didn’t you measure?  There was no need.

I didn’t ask you if there was a need, did I?  No.

Nurmi struggling really hard to say all the shelves were not where Jodi says the gun was kept.

Didn’t Jodi say top shelf???

OMG, Nurmi just brought up the Hughes saying Travis was addicted to Jodi!!!!  That’s not up for discussion!!!

Judge has them approach.

Nurmi comes back with the same question…Juan objects for hearsay.


She can’t be letting this crapolla in????

Do you remember doing an interview with 48 Hours?  Yes.

You told that correspondent something provoked Ms. Arias…

Objection, beyond scope…


Nurmi trying to sneak all sorts of crap in that has nothing to do with rebuttal!  He’s trying to say provoked to go for manslaughter!

Jury sent out for recess…

Think Nurmi is having a meltdown…he’s got nothing left and is spinning wheels!  He’s a fish flopping around on the deck of a boat that’s sinking!

Court back at 2:54 with the ever-unpopular sidebar…

Nurmi asks Flores if he didn’t investigate how the closet shelves would react if one hit another?  No.

Juan…why did you concentrate on the area you did?  That’s where the defendant said the gun was.

Juror questions…

Any record of a gun registered to Travis?  No.

Was anything out of place in the closet?  No

Did any roommates have a gun permit?  No.

Jodi said she helped Travis store things in the attic, did you find anything?  No.

There are beams you could set something on, but the rest is dry wall.

Juan has nothing…

Nurmi lumbers to the podium…

Registration of weapons, is registration required?  No.

You checked the attic or did someone else search the attic?  Under my supervision.

So again, you did not search the area yourself?  No, it was reported to be standard construction.

Jury sent to jury room again!  Counsel called to chambers!

I would lie my azz off to get out of jury duty in AZ!!!

    an astute caller just phoned in and made the point (Juan, please take note)… how, during the interview with flores, when the ho was telling the ninja story, how she said Travis would just not die. As the caller points out… who would think THAT?

    U mentioned u don’t think there will be sur rebuttal, but the judge said they won’t meet til next wed because of witness scheduling. Could that mean dt might have their sur rebuttal witness?

      I posted this earlier…I think May 1st is going to be the surrebuttal . Sounds like JM plans to finish his rebuttal tomorrow, thus the short day and then Wurmi & Wingnut need to prep their witness or witnesses for next Wednesday. Also, question?? Are the jury instructions given before or after closing arguments????? Anybody?????

    We still do not know whether the judge has allowed their sur-rebuttal but if Geffner’s allowed to testify I really won’t understand. That DeMarte Dx JA with BPD is NOT new. The defense has known this info for ages. DeMarte testified that she wrote a detailed report and I’m sure they deposed her as well. Also, Dr Doofus testified in response to a smart juror question, that he did Dx her with some personality disorder from the results of the testing but that he didn’t pursue it.

      Hi Nancy! 🙂 I’m on the wagon with the folks that now think there will be a (limited) surrebuttal case – the indication from the court that Weds is likely to be a marathon session is the reason I’m thinking this – JM’s rebuttal witnesses have been very quick, and the defense has had no choice but to limit their cross of them – A (limited) surrebuttal is the only thing that really explains next weeks schedule (coupled with that comment from the court)…

        I have to stick up for Vinnie. He’s 100% against Jodi, a former prosecutor (not a defense atty), and as far as I’ve seen always on the side of victims. Give the guy a chance. 🙂

    It’s odd because Jodi’s grandma was reacting like I expected her mom to have been reacting all along. Her head down, rubbing her head and the look of what seemed almost like shame

    I’m a little worried about the juror question about how tall Jodi is from her feet to the tip of her fingers when her hand is outstretched above her head straight up. Anyone have any idea what this juror might have been thinking?

      To me, it just seemed like the juror was trying to remove all doubt that JA could have reached the gun without stepping on the shelves… The bathroom was a category 5 disaster area after what ever happened, happened – no reason to believe the closet would not have been disheveled too, if it was part of the ensuing bedlam…

    Donchais, thanks for the recapps 🙂 This is the first trial I’ve followed, I am curious about how long jury instructions take. And actually what jury instructions are…. If testimony by Alyce LaOlivette was to be stricken would the judge have told the jury then or at the end?

      Jury instructions are long and confusing because they are written by lawyers and not in lay-man speak…cause a lot of confusion on juror’s part. Think ‘reasonable doubt’ They can be very long and tedious as I expect they will be here…this is where the jury sinks or swims.

      They will be told what they can or cannot consider.. opening and closings arguments are not to be considered, but ya can’t unring that bell. It’s pretty much a crap-shoot as to how bright the jury is…that’s why jury selection is so very important!

        Jurors can’t consider opening and closing arguments? Really? That’s so strange. I guess I can understand the opening but the closing is a summation of the evidence presented in court, isn’t it? So why would it not be allowed? It seems so silly. It’s basically the last thing they hear, how can they not consider it?

    Hello Everyone!! ( Curtsies to Donchais..) .. I couldn’t wait to get back in here to de-stress and mingle with all of you. This case is giving me a tumor on the brain. Was very very pleased lizard neck looked so worried today. Even poor JW’s helmet went flat with all the worry they got now. Justice for Travis is so close!!!! While watching wormi I couldn’t help but think of Eeyor from Winnie the pooh…. okayyyyyyyyy dddddiiiidddddd yyyyyooooouuuuu meeeaassssuuureeeee tttthhhhhiiiissss shhheeelllffff.??.. great scott!

    Great recap. You perfectly reflected three things I was thinking about/noticing today. First, that Jodi looked more downcast than I’ve ever seen her and like you said, chambers obviously didnt go her way for a change. Closing arguments are next week and the reality is finally hitting her. Secondly, that Juan had a great day yesterday. Yes he did!! And thirdly, when you said Nurmi lumbered up to the podium. Lol. Exactly. Perfect word to describe his movement.

      You actually said it was a great day for Travis yesterday not Juan but you know what I mean. I thought Juan hit all his marks yesterday like the master marksman he is. He basically showed the defense how its done. A witness doesn’t have to be up on the stand for 18 days unless she’s got tall tales to weave. Likewise for ALV and Samuels. Juan kept his rebuttal short and sweet and has made the crucial points he needed to make. Over and out.

        *i shudder* at thought of his hands. Small and Wurmi . However JW and ja’s hands have creeped me out since the beginning. JA’s particularly .. They’re like little claw hands. I. Skeeve every time she picks up her styrofoam cup to drink her water.. She holds it with her hand curved over the top. It’s just a really weird grasp and it weirds me out, I can’t watch her drink. I know I sound nuts and I have no excuse. JW also has little claw like hands and uses them a lot during her questioning, they kind of flutter around as though she’s trying to grasp at something. The entire defense team has weird weird hands. As for me , I just get Weirder very day I watch this trial. ,. GAH.

        Nurmi is always whipping his wrist. What’s up with that. It’s like he’s trying to shake something off his teeny, weeny hands! Haha

    Like Jim (above), my first thought when the judge mentioned issues with the availability of witnesses was that she is allowing a limited surrebuttal case on Wednesday. My reason for this is that JM is very tightly proceeding through his rebuttal witnesses and would have his witnesses ready and waiting in the wings, whereas the DT is scrambling to put together a surrebuttal.

    Speaking of the prosecution’s witnesses, who was scheduled to be up next and why the early dismissal today? The defense is opposing whoever it is?

    I’ve decided to assume that Judge Stephens will allow the defense a mini-surrebuttal on Wednesday even though I hope it isn’t true. But, as per her statement, they will have one long day and no more than that. Heck, the defense could drag that particular witness for weeks!

    There are two reasons for my thinking it won’t amount to a hill of beans. First, as Donchais has pointed out, he has been badly impeached before. If you Google Dr. Robert Geffner and look for court cases, they are there. His big deal is domestic violence and he is closely aligned with Alyce L.

    Second, When the jury asked Samuels if he had diagnosed Jodi with anything else, he quickly said, probably hoping the jury wouldn’t notice, that she had a personality disorder, not otherwise specified. He didn’t bother to look into that issue.

    Dr. DeMarte took time to diagnose BPD. Even now, there are experts who disagree and consider she could have anti-social personality disorder, a psychopath even.

    Regardless of any diagnosis, the fact is that there has been so much evidence presented during the trial as to Jodi’s personality traits, that the jury doesn’t really need to know the specific diagnosis Their decision will be made on the facts that they have heard in court.

    Samuels and LaViolette didn’t fare well with Martinez or the jury. What will one more be able to accomplish that the others couldn’t do? To be sure, Martinez will have a field day with him

        I’m thinking the same thing about Judge Stevens. Once she allows the sure rebuttal witness on the stand, and he’s being questioned, what’s she gonna do? Say “you have 30 min to wrap it up?” Of course not…cuz it’s a dreaded Death Penalty case and she so fears the Appeal. So once it gets going, God knows how long it could go.

    Hi all ready to pop my mind here – I am watching Nancy Grace (yeh, I know) and JA is apparently writing a tell all book – she told the National enquirer – She claims now she was pregnant by Travis – WTF – still watching. I need a brain transplant – have no reasoning intelligence left. so much for college degrees Cant believe this.

    I also think the judge is allowing the suributtal witness. And I too don’t think that he’ll fare we’ll against JM. I am so glad they will only give a day for it. It’s a last ditch effort to have the last word.

    SYN! ALERT! You are confirmed a genius! Mike Walker from (sorry to say, The National Enquirer) reported tonight that JA blames Travis for the murder, because HE was sexually arroused by the “Psycho” shower murder scene and HE wanted to recreate it in the shower! And she said that he got “so into” the recreation, that he started playing too rough, and it “got out of hand”!!!!! He claims that this is part of a book that she is writing in jail!

    A thought to throw out here….wouldn’t the top shelf in the closet, where Jodi claims she retrieved the gun, show whether or not there was an object on the shelf by the dust pattern? If a gun was removed from that shelf there wouldn’t be the same amount of dust under it compared to the remaining surface.

      I don’t believe the closet was even focused on by investigators until well after the murder, after she finally abandoned her ninja story. One of the crime scene processors was asked by the jury if they sweep for prints essentially everywhere in the scene, and the crime tech replied that they only focus on certain areas, based on their experience and the appearance of the scene. So that’s why they didn’t dust in the closet for prints–nothing was disturbed and didn’t appear to be part of the crime/struggle [ed note: cuz it WASN’T].

      And did her story about getting the gun off the top of the closet even come out before she took the stand? Because if that’s the case, we’re talking 5 years after the crime. Way too late to go back and look for dust prints or fingerprints. Especially because someone else lives in that space now (*shiver*) and has presumably dusted and cleaned.

    I have been following this case since the beginning and have only recently had the pleasure of finding this site! Awesome recaps!!! I realize that this question may have already been asked, but do you think JM will cover a timeline to piece together the premeditation case? Like from when Travis began trying to rid himself of JA, to inviting another woman to Cancun, to the sex tape recordings, to the intrusion of Travis’ email leading to his strong texts to JA, the alleged break in resulting in missing gun, to borrowing the gas cans, renting the car, changing her hair color…..the horrific murder, attempting to clean the scene, washing evidence, changing the plates, tossing the evidence, seeing the Utah man and the continued behavior????
    Also, and maybe you all can help me on this one, but has it ever been asked of JA that if she were such an avid photographer why she used Travis’ camera that day instead of her own? My only personal conclusion is that she did in fact go there with the intent to kill him, he was maybe affectionate so she thought this may be his chance to redeem himself to her and chose her then when he made it clear that she was not the one he wanted she decided to go forth with her plan.
    I can only hope that JM has some way of being able to explain the killing in the way that makes sense, follows the blood evidence, fits in the 62 second timeline and leaves no room for reasonable doubt.

      Hi Cindi….JM is meticulous! He will stick to the facts that will apply to and prove 1st degree/Premeditation, and felony murder. Staged burglary, missing gun, knives at the crime scene do not match the wounds, gas cans, lack of receipt paper trail in AZ, hair color change, no phone records in AZ, Ron Burns alibi, cut finger, stalking, crime scene cleanup, and anything else that points to Premeditated murder! He will more than likely leave the sex,pedophila, DV, fog, and PTSD for the Duh-fense. We hope that he opens with the 911 tape and ends with the “No jury will convict me….” video. This is just our opinion of how we have seen him work throughout this trial.

      In the beginning when he first presented the State’s witnesses you’ll remember that all the HLN big mouths chastised him for not being more concise with his points he was making. However….he doesn’t work that way…..he laid a foundation in the beginning and now in rebuttal an closing he is connecting all the dots. He did not show all his cards in the beginning! He’s good!!

    I really am starting to believe that Jodi simply decided too keep it short , confined and neat. Stab him in heart in the shower. Maybe a couple more stab wounds and it would be over, hed bleed out on the shower. She could contain the blood and forensic evidence then simply run the shower and evidence down the drain, Nice and neat, she rinses off and blows the joint. But big oops… Trqvis fights back and it got messy. Not part of her plan. He’s out of the shower more chaos ensues along with the.carnage and a crime scene that she could not clean up., she must have been devastated it didn’t go along with her plan. My brain is officially numb trying to figure this psycho bitch out.

        Before I started watching this case, I kept hearing about it–this beautiful woman who stabbed her lover, and the sex, the pictures, etc. I didn’t get around to getting a visual til I got laid up with a small health problem in Early March. I’m not kidding, I was truly shocked when I saw who JA actually was. UGLY! Granted, I know she’s in prison, and may be downplaying for the jury, but there’s a special ugliness about her. As mentioned, you can see that even with her blonde pretty pics, it’s such a fake, contrived beauty, you have to wonder how anyone actually thought she was pretty. Especially when you add her ugly personality on top of it.

    I’ve been a juror 4 times (1st was double victim/double defendant murder case). My standard advice: whatever you saw, heard, processed will be considered exactly oppositely by your fellow jurors.Said another way, ever try to get 12 people to agree on a pizza?! That said, I love AZ allowing juror q’s- even accepting all might not be asking. Gives such a view into HOW they process. I think murder/death. Am I right they do not have to be unanimous for death? We convicted but deadlocked on DP so got life. It was a very notorious case here and the public, press and even the judge trashed the life sentences (juot decision mandatory).

    Just a few comments on the jury deliberation process; LIR actually served as a criminal juror last year in a multiple count/indictment murder case, including second degree murder, first degree felony murder, esp. aggravated burglary, and esp aggravated assault and kidnapping. (male murdered female estranged spouse). After a 4.5 day trial, we began deliberating at 1pm and delivered our verdict at 8pm. The verdict forms are broken down first by individual charge each with multiple subparts, which jurors must unanimously agree on before continuing to the next. I don’t recall how many indicted charges/counts JA has, but just share the above to explain why even though the jury may be of like mind, the paperwork does take time, careful thought and deliberation as the foreperson must sign off on each.

    Here is what we must believe in order to give Jodi Arias the benefit of the doubt in this case:
    1.It really was just a coincidence that a gun of the same caliber, used in the murder, was “stolen” from her home mere days prior to killing Alexander. (Investigator says robbery looked staged.)
    2.It really did take 5 hours to get her nails did. (And, she didn’t get her hair dyed from Blonde to Brunette on the way to Arizona)
    3.That guy at the rent-a-car place is just colorblind and couldn’t tell the difference between blonde and brunette when he said that she was blonde when she picked up the car.
    4.The real reason she didn’t want that red rent-a-car is because she didn’t want to get a ticket. You know, because somehow, a red car controls how fast you drive.
    5.She simply forgot that the whole purpose of borrowing/buying gas cans was so she could get cheaper gas out of the state of California. That’s why she filled up the cans in California. Duh!
    6.Although she bought a gas can from Wal-Mart and paid for it with her credit card, she actually took that gas can back and received a cash refund for it.
    7.It’s just an oversight that Wal-Mart has no records of anyone returning a gas can that day.
    8. A roving band of license plate flippers, on skateboards, flipped her license plate.
    9.Travis begged her to come see him after he called her an evil sociopath and told her that she was the worst thing that ever happened to him.
    10.She lost her charger and her phone went dead just before she entered AZ.
    11.Using her credit card everywhere else but AZ doesn’t look suspicious.
    12.Travis cut rope in the bathroom instead of measuring it to fit the bed in the bedroom.
    13.Travis’s bed was good for tying someone to it, even though it was a SLEIGH bed.
    14.Although she had destroyed his BMW, and he suspected her of slashing his tires twice, dropping Travis’s camera pissed him off enough to want to kill her. (I mean, OBVIOUSLY the camera still worked – oops.)
    15.She was so slick with her ninja-like moves that she ran into the closet, passed a bench, climbed flimsy shelves and grabbed a gun, in a MANIC dash to save her life, and not one thing was shoved, pulled, or kicked out of its place.
    16.Doing number 15 was actually easier than running down the stairs and out of the house.
    17.Doing number 15 made sense, even though she had no clue if the gun was loaded.
    18.She took Travis on 1 vs. 1, with no element of surprise, and only walked away with small cuts on her fingers.
    19.She shot Travis first, although the Medical Examiner said that he could not have been shot first due to the bullet in his brain being debilitating.
    20.She doesn’t remember anything about the stabbing, even 5 years later.
    21.It’s possible to remember how you “felt” during an act even if you have no clue what happened during the commission of said act.
    22.She, coincidentally, “came to” right before hitting a known checkpoint and saw her hands covered in blood and she was barefoot.
    23.She “must have” stopped in AZ to get gas and paid cash.
    24.No one wondered why a women covered in blood was walking around barefoot when she paid for the gas.
    25.It’s reasonable to “just know” you killed someone when the last thing you remember is that they were alive – but, still, you don’t remember killing them.
    26.She magically found her phone charger under her car seat after leaving AZ.
    27.All of those transactions in Utah that look like it was for gas, weren’t actually for gas.
    28.She only lied about not being there because she was scared.
    29.She only lied about the ninjas doing it because she was scared.
    30.Although the ideas of being put to death and/or spending the rest of your life in prison are scary ones, she’s not lying anymore.
    31.“Defending” herself from Travis gave her PTSD.
    32.It is normal for someone with PTSD to willingly be around things that remind them of the trauma; and behave normally – Talking to mutual friends, going to the house the “trauma” took place, asking repeatedly to see the crime scene photos, etc.
    33.Hiding behind and sleeping under your ex’s Christmas tree is normal.
    34.Repeatedly showing up uninvited to your ex’s house is normal.
    35.Peeping through your ex’s windows is normal.
    36.Hiding in your ex’s closet is normal.
    37.Climbing through your ex’s doggy door to gain access to their house is normal.
    38.Sleeping on your ex’s couch when they don’t even know you are there, and didn’t invite you over, is normal.
    39.33-38 is just “normal stalking” and signs that someone is simply not ready for the relationship to end.
    40. It’s not really stalking unless someone files for a restraining order.
    41.It’s normal, NOT jealousy, to drive hours to confront an ex-boyfriend’s new potential love interest.
    42.Travis was stuck in a 1970’s time warp and had to get his child porn in print form.
    43.Everything she said she didn’t like about sex with Travis is true.
    44.Having low self-esteem means pre-signing a manifesto in case you are famous for committing murder one day and thinking you’re Einstein-genius and that your art is good enough to hang next to Picasso’s and Van Gogh’s.
    45.A bunch of other stuff that I am surely forgetting.

      *I’ve been in a DV scenario where I’ve had to make decisions like this. When you really time how fast a man runs and can catch a woman in a small space like a master closet/bathroom, there is NO way it is possible that Jodi could have taken the time necessary to grab the gun without Travis being upon her instantly, grabbing her as she was at the shelves, and thwarting her plan to grab the gun. Her story is implausible.

First, that Jodi looked more downcast than I’ve ever seen her and like you said, chambers obviously didnt go her way for a change.     I’d love to know what some of you think about this question. I know it’s been discussed before, but this is something that really doesn’t make sense to me. Why would Jody make up the lie about a holster when it was something that would be so easily disproven? It seems so illogical. If you’re going to lie about something don’t make the lie more difficult to prove by adding another lie. I wonder why her defense allowed her to testify to a holster when they had to know the evidence would show there wasn’t one. It’s very puzzling to me.

      Jodi doesn’t know when to stop when it comes to a lie. She thinks she has enough truth mixed in with a lie for folks to get doubt. I think Jodi has mixed in her version with certain truths and flipped things from Jodi to Travis. At this point, I think it’s obvious at how Jodi operates. I think her staying on the stand for so long backfired, and the jurors see her true colors, rather than they can see her as likable or not someone they want to convict of murder 1,DP.

      My advice would be to stop believing that Jodi is logical AND to stop imagining that Jodi can keep up with her own obvious lies.

      Her lawyers did not “allow” her to testify.
      She –as the defendant– has a RIGHT to remain silent, and she is the only one who could choose to “waive” that right by opening her mouth (first to Detective F, for HOURS and on separate occasions, even), and then, to the media, and now, to this jury (and all of us who are following the case).

      Jodi really thinks that she is smarter than she actually is, is how I see it.
      IMO, best to give that kind of person a ton of rope, because they typically end up “hanging” themselves.

      There is no doubt in any lawyer’s mind who has tried cases (not just criminal cases, but civil as well) that Jodi is the absolute worst kind of client (because she clearly rejects sound, professional advice, due to her mistaken belief that she is so intellectually superior to the “common man” that she will be able to manipulate the world).
      But the collective common sense of a jury is more, if not most, frequently a lopsided match for a (borderline) psychopath. She is simply not accustomed to anyone holding her truly accountable for her bad behavior.
      She still believes that she can maipulate the world.
      (OK. So did Casey Anthony, but … she had a great helping hand,i.e. her mother.)
      (No matter what the Nat’l Enquirer says– the fact is that Jodi’s mother has not gone on a public relations tour, spewing lies in order to help her daughter escape justice.)
      If anything will help Jodi in this case, it will be sympathy for her mother, and perhaps her grandmother who finally made an appearance in court today.

      Glad to see that the case has finally been scaled down to the point where closing argument dates are now set and with limits, thank goodness. Mr. Nurmi will have to pick up the (verbal) pace if he intends to be heard on all matters he deems significant to his portion (fact witnesses) of the defense.
      Willmott will have to actally prep in advance and get her ducks in order.

      I’m sure no one has any doubt about how preprared Jaun will be.

        Also, Whereisshe, Casey Anthony listened to her lawyers and never took the stand. Things could have turned out very differently in that case had she taken the stand. I think you are right on in everything you said. Her lawyers did not “allow” her to say that…it just came out as another one of her detailed lies.

      She lies soooo much that she can’t keep them straight! She doesn’t tell the same lie twice. The more she tells the story the more she embellishes it each time she repeats it. When she first said it on the stand it was just the gun (Nurm the Wurm questioning her), the second time she said it (JM cross) it was in a box or “something like that” she said, then when the Jurors asked her it was in a holster. So you see same story different facts! Her attorneys have no control over her. Her mouth has been her downfall since day 1.

I think it must be that someone who is a pathological liar and/or a psychopath doesn’t have the ability or inclination to reflect on his/her lies with objectivity. The holster story was just so breathtakingly stupid. It must be her arrogance that prevents her from thinking logically. She thinks she’s smarter than everyone and she must think that the more details she adds the more truthful her lies appear. However she is stupidly forgetting that these lies can be proven as such. You’d think her defense attorneys would be able to curb this stupidity but apparently not.

        I remember distinctly when Jodi testified to the holster. I’m a “gun person”. I can just say, a holster is not used to store a gun in a home. A holster is used to carry a gun on your person. So that made no sense. It was just more of Jodi’s gun ignorance burying her…like not knowing that stealing a rare caliber .25 and using it to commit murder would point an arrow straight at you!

Like when she said she noticed the blood on her hands and realized she had a case of Costco water in the trunk so she used that to wash it off.     I hope Juan brings up the fact that this trial has lasted longer than TA and JAs dating. Sure the were F—-buddies, but in this day and age, that’s normal. Just because you have a sexual relationship, where role playing is the focus, doesn’t mean death is a normal part of it. Travis was so green sexually compared to Jodi that its obvious who brought the deviancy into it. Jodi thought she could manipulate Travis with sex and did. He just didn’t realize what he was dealing with.

    Juan will most definitely NOT try to take the jury through the murder step by step, because no one other than WOBO knows all the answers. To supply a too-specific “this is how she did it” scenario only serves one purpose — it gives the jury an opportunity to say “Well, if that happened, then this doesn’t fit” and away goes the death penalty, and possibly, God forbid, a conviction. Fortunately, the State does not have to prove how it was done, only that it was done. If Juan knew exactly what had happened, he would have laid it out already. Even the points made in the rebuttal, which Juan knew from the beginning, had to be saved until WOBO had committed herself to all the lies she told, both to the experts and in her endless days on the stand.

    There are several pieces of evidence that cannot be explained — the duct tape, why she left the camera in the washing machine, how she talked him into taking the shower pics, how she was able to overpower him, how she managed to move him, to name but a few — and while we may be desperate for an explanation, it is not going to come. Unless WOBO explains all the evidence and answers all the questions, many facets of the crime will forever remain a mystery. Juan will absolutely NOT risk a conviction and the death penalty by trying to explain anything about which he is less than 100% certain.

      I’m not a legalize expert, so I can’t refute that.

      I do think that Juan will move point by point which seems contradictory to what you said. He’ll indicate Jodi’s lies versus all the rebuttal.

      My understanding is that the duct tape was an exercise item that he’d have taken off before a shower.

      The camera in the washing machine could easily be an accident during the “fog” as well as an idea that the camera would be unusable.

      She couldn’t overpower him without something threatening from jodi.

      Moving him…. Jodi weighed 120 when arrested, but her license said 125… She moved a body that was only 70-80 pounds heavier than her, and it’s easy to drag weight. I have a back issue and have managed to lift my 65 pound dog into the back seat of my car on multiple occasions in order to get him to the vet. I’m in horrible shape btw. I guess folks forget about Adrenalin. It makes folks do stuff they wouldn’t be able to do otherwise. I ran a marathon and was dehydrated to the point that I should have been in the hospital, but didn’t realize that until 1.5-2 hours later.

      I’m curious what the other items are since you listed a few…..

        I don’t know why I haven’t heard of this theory from others but I’ve always believed she left the camera behind because she thought if she took it the finger would be pointed at her because his friends knew she’s a photographer. But she needed to get rid of the photos and couldn’t trust just deleting them would do that so she put them through a wash cycle.

        Lisa M – I agree she didn’t take the camera because the police would have assumed someone he knew like her would have taken it. But I don’t think she put the camera in the washing machine to erase the photos – she incorrectly thought a menu erase took care of the sex photos and accidental shots. My guess is that she put the camera thru the wash cycle to get rid of her fingerprints on it

        I don’t recall the duct tape. I think the camera got tossed in the wash because she thought it would certainly destroy any pics plus the camera. I think that is why she is so weird about seeing the pics during the police interview. Also, I wonder if she started to worry about room mates coming home. That bathroom must have been a mess — imagine what her clean up efforts were like.

      I understand what you’re saying Schaeffer. It makes me think of the Casey Anthony case when the prosecutor showed the jury that photo thru created with the duct tape around Caylee’s skull. It was overkill. It spelled out exactly what they believed Casey did but JB was able to poke holes in their theory. I think they got too specific. Of course there’s much more concrete evidence here. I also agree just like with the CA case there are things we’ll never understand. I chalk Jodis actions up to a combination of the illogical workings of her psychotic brain and her panic at the crime scene. She probably was freaking out and just not thinking clearly at that point.

    It is very clear that the evidence logically brings the first degree murder conviction. The above 15 points that defy reasonable belief are obvious and undeniable. So why am I concerned? I’ve been watching trials since OJ and without exception, the popular opinion expressed on boards and in the press on each of those major cases has been guilty as charged. The actual verdicts have been just the opposite. Why? A variety of reasons, but the reasons given, over and over, are that the jury could not find for a guilty verdict GIVEN THE JURY INSTRUCTIONS THEY WERE GIVEN. Another extremely frequently given reason is an incorrect understanding of the words BEYOND A REASONABLE DOUBT.

    I am very encouraged by the questions that we have heard from this jury. What we don’t know is how representative they are of the jury as a whole. In the first Spector trial, there was a hung jury, 11-1, held up by the single juror, an engineer who required that each individual point be proven beyond ALL doubt!! He just couldn’t accept any form of common sense or circumstantial evidence. All it takes is one, as we all know. One of the defense lawyer/talking heads on HLN today said that any verdict less than life without parole is a huge verdict favoring the defense. I, along with everyone here, I’m sure, would be sick at my stomach to see that defendant and her team celebrating while the Alexander family is shredded.

    So why am I being Ms Depression here? I’m just trying to protect myself from the vey real possibility that some “sleeper” on the jury might play the role of that engineer. Even in the Casey Anthony case, the jurors said they thought she was guilty but they could not find it because of the jury instructions they were given. I’ve served on a jury where 16 of us heard all the evidence, and just before deliberations, the judge drew 4 numbers out of a hat and we were excused from the process! What an anticlimax and that was only a 2 week trial! Imagine what 4 people are going to feel next Friday. We can only hope that those 4 include those like the engineer and the other 12 can see the truth through the instructions they are given. The two most important parts of a trial are jury selection and jury instructions and jury instructions! I hope they got those right.

      I agree with pretty much all you say here. I just want to say that as long as this jury doesn’t actually acquit her, ala Casey Anthony, I can live with a hung jury. Here’s why: re-trials have absurdly high rates of conviction. Even as evidenced in the Phil Spector case…they got him the 2nd time. The prosecution learns everything from the 1st jury that went wrong and right, and uses that info to go back and hone their case for precision and a conviction. So even though it would be horrible for all if us to go through a re-trial, we would get through it for the sake of justice for Travis, and Jodi would remain in jail the whole time (as opposed to out on bail like some defendants), and JA would eventually go down hard for what she did.

    That poor old woman….they probably told her they were taking her shopping and then wheeled her into the courtroom! She certainly didn’t look like she was there by choice! As it is when they were arresting JA at their house and the grandparents asked what was going on and were told she was being arrested for murder the grandparents themselves said, “we’re not surprised!” Wow……guess they knew what they were dealing with all along!!

      I think the photo of Travis sitting was taken in error while she had the camera around her neck.
      The ceiling shot is when I think she removed the camera, strap still attached, as it was getting in her way and it fell to the ground. The last two shots I believe were taken when the camera was inadvertently kicked around during the attack.
      I really don’t think that she would have the time to remove the strap during the attack, (unless it was snapped or broken off by force, but I’m thinking there would be damage to the strap holders on the camera if that were the case) so in other words I think she removed the strap during her farked up “clean up”. (I have 2 Sony still cameras and 1 heavy duty camera strap – they can take a few mins to be removed as they are looped thru the holders on the camera.)

    Someone called onHLN last night, said JA during testimony said something about after she shot him ‘he wouldn’t die’, I remember something similar. When these liars mix lies with truth so they can remember it all, now I’ve changed my theory of events. That ‘eye’ photo looks like left arm behind her back holding the gun, she made him shower so it would be clean, he got out, went to chase her she ran as she went to bedroom to find a knife, he chased her to bathroom stopping at the sink she stabbed him, he ran to the hall whet she finished him off.

I think he was just dumb-founded by what happened and then the struggle began. I see no issue with her dragging his body back to the shower and the shot was due to his remains making gurgling sounds.

    I wrote this a while back- and posted here several days ago- But since several more instances of JA’s “bad luck” have come to light… So feel free to now add more examples!

    Poor JA is SO unlucky… (this of course, and all that follows is pure “tongue in cheek”)

    Too bad that neither JA or Travis mentioned even once that they were taping their phone sex call- how unlucky that even after the “sexy talk” ended, they didn’t mention ending the recording before moving onto more trivial, mundane talk. 

    How unlucky that her grandparent’s home was burglarized within less than 2 weeks of Travis’s murder! What amazing odds that a .25 auto was stolen, the very same caliber gun used to shoot Travis in the head… So unlucky! 

    Gosh, if only the rental car place closer to Yreka had had more competitive rates, she wouldn’t have had to drive 90 miles to get a good deal! And drat, that she didn’t just accept the red car, silly to have insisted on a less conspicuous color! If only the rental agent didn’t notice her blonde hair!

    How unlucky that Walmart didn’t have a record of her returning the gas can!  I’m sure they had every other transaction receipts for that day, accept poor JA’s, how unlucky!

    What a shame that those silly detectives and so called computer experts couldn’t find one shred of pedophilia evidence, anywhere in Travis’s home! 

    What bad luck, that none of Travis’s exes were battered physically or mentally! Why just poor JA? 

    How unfortunate that those naughty skater boys just happened to have a screwdriver, and managed to remove one license plate, and turn the other upside down, all in the time it took her to buy a cup of coffee. Gosh, what bad luck they chose her car above all others in that public parking lot… 

    Too bad that her phone just happened to die, AND she lost her charger, shortly after leaving Pasadena. But thankfully, 18 hours later, she found her charger, and was able to get her phone working again as soon as she was well away from the Arizona border!  Phew! (otherwise, she’d never have been able to leave Travis that sweet voicemail, and let Mr. Burns she’d be there soon!)

    What a shame that no one ever saw Travis hit or kick her- if ONLY there had been a witness! If only she had confided in her Bishop, sister or friend! If she hadn’t been such a brilliant makeup artist, someone could have seen those God awful bruises he left! 

    Just imagine if she hadn’t been so noble towards protecting Travis’s solid reputation, never wanting to “de-edify” Travis- if only she’d never heard of the “Laws of Attraction”, she could have journaled the truth about ALL those events, instead of writing “nothing noteworthy to report”, alas, what a shame. 

    Oh, what a run of bad luck to have thought washing the camera (in bleach) would destroy the picture evidence! Who knew those damn digital cards were so hardy? 

    If only she hadn’t been so nimble climbing up the closet shelves to grab the .25 caliber gun, if only she had disturbed the items on the shelves even a little! 

    Too bad no one except JA ever saw Travis’s gun. Only JA knew it was there on the top closet shelf, the one she managed to see 2 times before, or 3? Or was it 4 times?  Damn FOG!

    How unfortunate that Travis put up such a desperate fight, forcing her to cut her own hand, forcing her to leave a bloody palm print! If only Travis had just stayed in the shower!

    Poor little she devil, so very unlucky… And to top it all, she then gets one of the toughest Prosecutors in the State of Arizona, oh my, the luck of it all!

    No one is THIS unlucky.

    OK I have a couple of questions. By the looks of things, it sounds like there is going to be a mini-surerebuttal with the defense calling another psychologist. As to who it is, if it is Geffner, well I think he will be impeached the same as Dr. Quack and ALV. I still don’t understand the point of anyone appearing since many disorders were discussed by Dr. Quack so it’s not anything new. In most cases the experts usually have opposite positions and usually cancel each other out.

    So which comes first, jury instructions or the closings?

    If JM does his closing, then Wurmi – does JM get to come back and have the last word?

    Once a verdict has been rendered, how soon will they start the penalty phase and can both sides call or recall their experts? I know that family, etc will all be able to make statements.

    How long will the penalty phase last?

    I keep hearing that Wurmi is doing the closing? Anyone know if that is true since he is apparently the lead attorney???? (which could make it last until next year)

    While I realize that state does not have to prove motive, in this CSI world, I think that the jury will demand a motive (s). Comments????

    I certainly hope that JM or the judge explains that their verdict should be based on evidence “beyond a reasonable doubt” and that they explain that it is not beyond “ALL” doubt.

    Justice for Travis!!!! Justice for the Alexander family!!!!

      MMD- The jury will be read their instructions on Thursday, then the defense will give their closing arguments. The State gets the LAST word, so I think Juan will “do his thang” on Friday. (I don’t know which will close? Wurmi or Perky – Wurmi is not DP qualified, but Perky is…)

      Jury instructions are written by attorneys and are in complicated “legalese”- it can be very confusing and overwhelming to jurors. Yes, here’s hoping EVERY juror understands “reasonable doubt”-

        Hi Robert 🙂 I think this jury has asked Q’s that prove they’re paying attention – I’m bracing myself for the verdict (I definitely suffered PTSD after the CA verdict!!! But there are striking differences in this trial, JA took the stand and perjured herself for one, and JA didn’t have a Mom that took the stand and perjure herself). I hope this jury doesn’t get bogged down in the juror instructions, the language as well as the smorgasbord of “DP, LWOP, manslaughter, etc. can cause intense debate in the deliberation. You’re right, it’s a very fragile system-

      Hello MMD. Closings come first, then instructions. Because the State carries the burden of proof, JM goes, then the DT, then JM again. Don’t know if it is Nurmi or Wurmi and they might try to divide time and both speak if they ask and the Judge okays. Nurmi is the “death qualified” lawyer on the team, don’t think that will matter but maybe. I would think the Judge would want to get started with the penalty phase ASAP because it is the same jury and they have been at it awhile now. Probably a week pause then it starts. It will go pretty fast but since she is now guilty the tables will turn. JM will have a field day, compared to how much has been withheld from this jury to this point. My guess, it will last a few days. As to motive …. they may actually be instructed there need be no motive shown. All that matters is one question — did she premeditate the killing. All the other details are irrelevant.

The instructions are so directed towards the chore the jurors are about to undertake that it makes sense to have it right before they start to confer.     As discussions of jury times go, I recall when it was announced that the OJ jury had reached a verdict. I had been to the trial, had looked at the jurors and felt, they HAD to know the score. I also felt at the announcement that it was a slam dunk guilty and thats why it took so short a time. I called a defense lawyer I know and started to shout with glee and he said, “Whoa there buddy. My experience with juries is that when someone’s life or freedom is involved, they usually take a lot of time to be comfortable with their decision. I think it’s a bad sign”

    So while I want them to confer for 5 minutes – even just look around and non verbally express ‘slam dunk’ – I wont be upset if they take awhile. Or lets say what a reasonable person thinks is awhile.But if they take too long, not understanding what is “reasonable, then all bets and hopes and trusts in the fairness of it goes flying outthe window!”

    Donchais (or the other legal wizards, when you have time): If JA is found guilty of 1st degree it looks like Arizona rule 19.1 describes an “aggravation proceeding”. If the jury finds “aggravation” then we move on to Penalty phase. Do you know about this “aggravation proceeding”? If JM just says “29 stab wounds, he was alive and suffered” is that enough?

    I have a question for any and everyone. I was unfortunately watching Nancy Grace last night and she had Jean Casarez on with her answering questions from viewers. One caller asked if it could be considered premeditation that Jodi borrowed money from a guy and told him she just “had” to get to Travis in Arizona. Jean C. looked dumbfounded and said that there was evidence of Jodi making bank deposits but they hadn’t heard anything about her borrowing money. Now, I don’t remember if the guy was allowed to testify or he just spoke on the news programs, but isn’t there a guy who was something like a customer in the restaurant where Jodi worked or hung out and she approached him in the restaurant and asked to borrow money because she was frantic to get to Arizona, or am I hallucinating again?

      Paul Stern at the Ventana restaurant. She used to go in there and use the computer for hours and that’s how he met her. There was never anything between them but he did say that she came to him the day before she left frantic that her “boyfriend” was dating other women and she had to get to him in AZ. She borrowed money from him and he was the first (and probably only) she paid back when she returned. He’s been on a few HLN shows in the past.

    Joining me, Paul Stern, who I`d said worked with her. I was wrong about that. He got know Jodi in 2008 before she killed Travis.

    I guess, Paul, she worked at the Ventana Inn up in Big Sur and you were a customer there. She was a bartender, is that correct?

    PAUL STERN, KNEW JODI ARIAS (via telephone): I own a house there. So, she frequented a bar and grill and restaurant every night to get on the computer.

    PINSKY: So, she was not — well, hold on a second. So, she was not an employee of this place. You guys both just went to this inn, this restaurant?

    STERN: Yes. She was an employee of Ventana but I wasn`t. I just lived there.

    PINSKY: I see. And you actually loaned her the money that ended up on the trip where she actually killed Travis?

    STERN: Well, the day before she left, she was pretty frantic that she had to go back and see Travis, and she talked about how he was seeing other people and she asked to borrow money and I gave her money.

    PINSKY: Paul, when you say she was frantic, describe how you — who you thought she was and what you mean by frantic.

    STERN: Well, I spent a lot of hours with Jodi. She would sit right next to me.

    And you know more about Jodi by what she doesn`t say. She never talked about her family, her friends, her boyfriends, her hobbies. And she never talked about her feelings or emotions.

    WALSH: What did she talk about?

    STERN: But she was on the computer constantly and she kept a journal. She would show me pictures on the computer. There had to be thousands of them. I only looked at a few.

    But I really wasn`t interested in time that much in her pictures.

    PINSKY: In spite of her talking about her obsessions — by the way, did she pay you back?

    STERN: She did pay me back.

    PINSKY: OK. And despite her talking about the obsessions about the boyfriend, was she sexually provocative with you?

    STERN: No. No. I have a girlfriend that I`m still with at that time. And I`m not available. And I think she sensed that.

    PINSKY: OK, so fair enough.

    STERN: She would come and sit next to me whenever she was in there.

    PINSKY: OK. Casey —

    STERN: And —

    PINSKY: What, Paul? Finish that up.

    STERN: When you engage in conversation with Jodi and look into her eyes, it`s like looking in a two-way mirror. But Jodi`s looking at the reflective part of the mirror. And her eye beams never really meet your eyes.

    And she`s very coy, enigmatic, and very articulate. And she`s also the same way about how she dresses, postures herself, and what she does without saying any words.

    PINSKY: OK, Paul, I`m going to put you on hold for a second.

    Casey, I see you shaking your head. What are your thoughts on this?

    CASEY JORDAN, CRIMINOLOGIST: Well, a few things. First of all, it`s great to hear from Paul Stern the fact that she had to borrow the money because she was obsessed about getting to Travis Alexander because she was in the middle of a terrible break-up and this was simply not acceptable to her. So his description of her obsession is really on cue with what we know happened thereafter.

    But that blank look in her eyes is what we very often call in sociology and criminology Cooley`s looking-glass self. It`s part of her chameleon and her actress affect. She`s constantly gauging or scanning whoever she`s talking to.

    And without even thinking about it, she mirrors back. We see her do it all the time in court. We see her do it with her defense attorney, even looking like her all the time.

    But she wants to know what will please people. This is a behavior she probably learned in her childhood. The bottom line is, he noticed it even though he wasn`t involved with her.

    WALSH: And Dr. Drew, isn`t that a survival instinct for many people who have survived child abuse?

    PINSKY: That`s right. It makes sense in the context, this kind of abuse.

    But, Casey, what`s it called? What`s the syndrome called? Cooley`s looking glass?

    JORDAN: We call it the Cooley`s looking-glass self. It means we are reflective and reactive. We are constantly modifying and interacting with everyone we communicate with, but some people take it to a much higher level to where they don`t even know who they are or what they —

    PINSKY: That — Casey, all right, Casey, I`ve got to go to a break. But I want you to take me from that syndrome to how we get somebody who is a murderer in your mind.

      In our opinion we thought this would show that she had a “plan” in place to get to Travis. On the stand she said it was not planned that she made a last minute decision to go see him when she was in Pasadena because he guilted her. This guy’s statement clearly shows she was already planning the day before and the intent was there when she borrowed the money. The only thing we can think of is maybe there was something in his statement to the police that may not have been credible to them and for this reason they did not call him as a witness. Who knows……so many players in a bad play!!

        Or the jury! I attended a trial once in Federal Court where the evidence was so gruesome that after the verdict the judge gave the jury instructions on how to contact his office if they felt they needed to spend some time with a counselor — at the Feds expense.

      I thought Mr. Juan did ask the dr. if Travis could formulate words after the gun shot.? And Dr. said no. Maybe I heard wrong. It was so short I can listen again.

      No .. the judge told the jury next Wednesday, all day, until they are finished and because of a witness schedule problem. Thursday and Friday are instructions and closings.

    I mean think about it …. They don’t get the case until Friday, May 3 …. and that is assuming all goes as planned. Then they deliberate …. and if guilty …. then this “aggrevation phase”, followed by a penalty phase …. maybe he just could not sit another month! Wishful thinking, I know!

    I don’t remember this many jurors being bumped during the OJ trial and it went something like 8 or 9 months and they were sequestered!!!!!!!!!!!! That’s DT is soooooooooooo slimy!!!!!!!!!!!!
