Christain-Newsom Murders – George Thomas Retrial

05/08/2013

OMG!  Violating the Judge’s orders, the media has leaked the jury selection area!

Per Jamie Satterfield, Knox Sentinel reporter, “it kind of sucks that the tv media already announced it will be in Nashville.” yeah they are violating Judge’s order!

Damn!  There hasn’t been enough bs in this case????

Disgusted!

Donchais … this whole case just defies logic! It was bad enough that the first judge was souped up on pills and everything got tossed! The facts here are chilling and gruesome! Those poor families! And why in the hell would the media let something like that out — just stupid — and to what gain? Unbelievable!

I don’t understand how that could have possibly happened. Those media outlets should be sanctioned and shut down immediately!
These poor family members and friends…

Donchais, I never heard of this case until you mentioned it in the arias post the other day. I read about it the other night and I was appalled at the horrific nature of the crimes against the 2 victims. They suffered so much. This case is a true travesty of justice, from the bottom all the way to the top. You seem like the type of person to get emotionally invested on a case and I hope you take care of yourself as the arias case is still going on, Trayvon’s murder case is around the corner and this all can be overwhelming both physically and emotionally.

I hpe you don’t mind me saying this, especially since I’m not a regular commenter. Have a good night and thank you for all you do

  7. 05/09/2013 at 1:17 am

Omg you just have to be kidding me!!!

  8. 05/09/2013 at 1:18 am

I have attended both of the Vanessa Coleman trials, two sentencing hearings and one motions hearing. Yes, it was as bad (or worse) as what you read.

Two defendants (Cobbins and Davidson) as of now, will not be tried again. Thomas’ retrial is supposed to be the last trial in this case. The torture-murders of Channon Christian and Christopher Newsom took place on January 7, 2007.

Why won’t those two defendants be tried again?

It’s a long story, but I’ll give a brief summary. The first (of three) judge on the case, Richard Baumgartner, was forced to resign from the bench (and is now in federal prison for six months) for buying drugs from a probationer under his supervision.

Baumgartner was having sex with her in the judge’s chambers during breaks from trial.

In Tennessee, a judge is supposed to affirm a verdict as “13th juror.” Through four verdicts and four sentencing hearings, Baumgartner never acted as 13th juror, which under Tennessee law a judge is supposed to do.

Because of Baumgartner’s stupid criminality, the second judge, Jon Kerry Blackwood, granted new trials to all four defendants. The Knox County DA’s office accepted a retrial for Vanessa Coleman, but contested the other three and appealed to the Tennessee Supreme Court to remove Blackwood for a “lack of objectivity.” Blackwood still presided over Coleman’s November retrial.

Judge Walter Kurtz replaced Blackwood. Kurtz took a second look at the case and ruled the verdicts for Letalvis Cobbins and Lemaricus Davidson would stand. The reason is there was overwhelming DNA evidence against these two, which enabled him to act as 13th juror in those two verdicts. As to how their DNA was on Channon Christian, I advise you to read accounts of their trials, especially the medical examiner’s testimony.

Judge Kurtz ruled he could not act as 13th juror for George Thomas because there was no DNA evidence against him. This means he had to hear the testimony in a new trial.

This case always breaks me up. I hope the nightmare will soon end for the families so they can get on with healing and the rest of their lives. Unfortunately, the appellate process for Davidson is going to take a decade.

If the bare facts of the crime don’t give you enough insight into what kind of animals perpetrated it, just watch Letalvis Cobbins sentencing statement.

    I’m in Lawrence County.

Since the Jody Arias proceedings have been shut down until Wednesday, maybe HLN can pick up the live stream (assuming Judge Kurtz allows it) from this trial to have something on Monday and Tuesday.

David, I’m just outside Knoxville. I though Baumgartnervis still out, pending the outcome of his appeal. Am I wrong on this?

Baumgartner recently decided to go ahead and get his six-month sentence over with. He realized his appeal would most likely fail anyway.

watched the link above that covers L Cobbins statement in court, way to minimise your involvement.

  18. 05/13/2013 at 9:19 am

since the charges include all 4 perpetrators…. how come they weren’t all tried together? Just too huge logistically.. ie too many attorneys and too much evidence for the jury?

Thank you Donchais. I am all researched up and watching the trial live now. What has bothered me greatly is watching Channon’s father. He is still suffering greatly and I worry about him because I see so much rage. My thoughts are with both of these families and you Donchais. Be strong…

Gary is full of rage, hence so many officers standing front row…they are afraid Gary will lose it and go for the defendant.
