      I might have mixed up what actually happened. I recall the pics, covers, and my memory emphasized the way mass media “darkened” the defendant as they “darkened” his deeds, and that that act mirrored the way the trial played out – “race” or “stereotypical” (and offensive)reactions to race, was a issue riding like a train through the middle of the courtroom. Also, white men with money, who were also influential, have been “getting away with murder” since the founding of the country. For a black man to get away with anything big, was big! THAT was a thing to celebrate. Thus, the image of kids clapping.This after the Rodney King incident & riots made it not “more rational” just “easier to understand and compute.”

  2. 05/18/2013 at 12:44 pm

    Im watching the original 48 hours.. and the one thing that still remains is the ‘charge’.. but in this version it Jodi ‘charging’ the female ninja. I am even more convinced this ‘charge’ is real. It has just morphed into the infamous ‘linebacker’ pose.

    She says she charged the female ninja who had a knife. I am so convinced Travis charged her as he escaped, stabbed, from that damn shower – knocked her down and made it to the basin. It makes sense because it would have taken her totally by surprise as she never expected him to be able to get out of that shower after that knife wound and for him to have been able to lunge at her in any way would have sent her flying.

    Footballers here say the impact is far more debilitating if it’s totally unexpected and I have no doubt his lunge at her after she stabbed him was exactly that.. totally unexpected.

    He, however, would have had that split second to see that knife coming towards him and could well have been in the process of making the decision to lunge even a moment before the knife went into him. Hence he impacted her and sent her sprawling as he stumbled out of the shower.

    • 05/18/2013 at 1:17 pm

      I hadn’t thought of this, but it makes perfect sense…great thinking outside the box!

      Hello Syn ~~~~ could not agree more. He went for her and I think it took her by surprise. Must have enraged her to have him out of that shower and she went after him, jabbing him in the back and whacking at his head. God it must have been a nightmare!

      • 05/18/2013 at 1:42 pm

        Morning HJ.. 😀 **waves**

      05/18/2013 at 1:44 pm

      So true. I think many things in her original “story” we’re actually true she just put them in a contex to fit her ninja story. I even wondered if after she shot Travis the first time the gun did jam when she tried to shoot him again. So many things to go over and see how they would fit to the last story of self defense.

      • 05/18/2013 at 1:48 pm

        To me that one goes to if you believe the Dr Horn or not.. I do.. plus the magic bullet casing.. I think the gun to head story comes from Travis’ near death experience he related in that vid where she is bored and flicking her blonde hair as she lays on his lap acting like a 16 yr old not getting the attention she wants

      What a thought provoking scenario, Syn. I’m still haunted by the phrase “I can’t feel my legs”, makes me wonder if at some point TA uttered those words as he was being hacked to death. Maybe not so much a fog after all? So thankful we are nearing the end.

        LIR-I feel the same. That phrase had to have been in the air as she grabbed it and made use of it. Syn talks of that & wow in this case, the thought of it, has lingered in my head.–Along with the image by Shaeffer evoked when describing Travis seeing himself in the mirror & maybe flashing to childhood at that moment. Chilling. Juan used a reference to some of that in his masterfull closing(s) .

      Oh, I agree he lunged at her to save himself. I always thought that had an element of truth to it, even if she switched the reason for his lunging. He may have even said kill you bitch after she stabbed him in the heart. Jodi mixed truth and lies, always flipping her heinous actions onto Travis. It was so appear aren’t during her testiphony that she thought she could mix fact with fiction and folks would buy it.

    My friend had dinner with his aunt last night who is a defense attorney that knows Amanda Knox’s attorney. A group of them had dinner one night after her CNN interview, and were all baffled how her attorney would allow her to do such an interview, especially with Italy trying to extradite her. I didn’t see the interview but now I will have to find it. Anyway, a majority of the criminal defense attorneys are convinced she’s guilty, and even compared her to Stabby. I don’t know enough of the details other than the police fudging things (they needed a Flores), but am curious of the sandbox’s thoughts who have followed that case.

    • ringadingding
      05/18/2013 at 1:27 pm

      I know some people who are friends of the Knox family and knew Amanda. They fully support the parents, but their impression of Amanda is very restrained and hesitant. I couldn’t get them to say much, which spoke volumes in and of itself. A little farther out from that circle, people think she did something, they just don’t know what. Personally, I don’t want to think she did it. But then again, I haven’t followed the trial to know more than what I hear in local media.

    • MMD
      05/18/2013 at 1:49 pm

      I have always felt that she got away with murder. She may not have carried out the act but I feel she knows way more than she is telling. That is why I will not read her book or watch any of the interviews that she is doing/done. just a feeling in my gut

      • ringadingding
        05/18/2013 at 1:56 pm

        It was strange to hear these friends of the family talk…or not talk as it were. Nothing at all along the lines of what a great kid Amanda had been or how outrageous the charges were.

        I’ve got to find that CNN interview. I hadn’t wanted to watch it at the time because in one of the promos, her voice just sounded too insincere and I wasn’t up for it.

    I have very mixed and evolving feelings. While she was in Italy in prison and in court appearances, I was totally convinced that she had been set up. Stories that I read about the vindictiveness of the prosecutor, the treatment during questioning and just the idea of being in this situation in a foreign country where she is unfamiliar with the legal system and barely knows the language made her innocence completely believable to me. Since she has been released, my opinion has weakened and seems go be moving to the other side. There is no specific reason for this at least none that I can point out. I’ve read that her family hired a publicist. I don’t know if this was just now to promote her book……totally understandable and expected…or during her in carceration to manipulate and influence us here in the US. The latter makes me feel uncomfortable. I guess that’s part of the Arias issue of lying and why she is so hated. Not so much the lies, but the feeling that we have been used and manipulated.

    On the Amanda Knox issue, I am just standing by to see what more we learn before investing emotionally.

    • ringadingding
      05/18/2013 at 1:30 pm

      I have mixed feelings too. The family suffered severe financial hardship in order to travel back and forth. I’m hoping (assuming) the book will help them pay off their debts. At the same time, if she’s guilty, then that’s another JA making loot off a crime she committed.

    • Carmen
      05/18/2013 at 5:50 pm

      Hi. I felt Amanda was persecuted by the police, prosecutor and the judge. At the time I felt she was innocent. But then I saw the interview on TV which swayed my opinion of her. I felt she was cold, unemotional and that her answers were rehearsed. It made me wonder if she gave the interviewer a list of questions to ask and not ask. I now tend to think she did commit the murder because of her lack of compassion.

      • Lisa M
        05/19/2013 at 10:18 am

        I believe that she’s innocent but just not a very good person. Having lived in Italy I can understand why what happened happened. I do think that she came across badly in that interview. But what really bothers me is that the proven murderer Rudy Guede only got 16 years because the police cut him a deal so he named Amanda and Raffaele. That to me is the real travesty in this case. I believe he acted alone and because the police were so deadset on going after Amanda they were lenient with a vicious murderer. I admit the interview she gave raised some doubt in my mind but I still don’t think she participated in the murder.

      • Lisa M
        05/19/2013 at 10:32 am

        I think she might have seriously hurt her book sales with that interview. I was interested in reading it until I saw that interview. All my sympathy for her went out the window and I had absolutely no interest in reading it after that. I think perhaps she and Meredith had a contentious relationship and she just doesn’t want to admit it but I think she’d be better off being completely honest.

        Like Robert, I saw the first 3 episodes. It was just a bit too “folksy” for me. The lead is a doll! He even gives Dr. Handsome a run for his money! 😘. Like Robert, I prefer grittier stories. Breaking Bad, Mad Men, the Walking Dead (that yucky zombie killing is a bit too gross, but a good storyline).

      with all due respect to MMD, i’m not. don’t think it properly captures the character of Raylan Givens. i love the books – there are a few with him as the main character. for me it’s about Elmore Leonard’s writing. he started out writing westerns and progressed from there. movies have been made from his work for decades featuring john wayne, charles bronson, and many others. quentin tarantino’s writing of dialogue in every film is a homage to Leonard – whew, i’m done.

    Syn: I didn’t see unanswered questions back there. Lisa wondered about Jodi testifying vs. statement. And you are correct. She can make a statement before the jury and pretty much say anything that is relevent. So, anything that came in to the trial or anything that supports her many impressive mitigators. Or, she can take the stand and be questioned, like George Thomas’ mother was yesterday. Of course, JM can cross and he will eviscerate her. He will be able to ask about anything she has said or done since Flores read her the miranda warnings, way back in July of 2008.

        is a masterpiece of narrative, very poetic and very violent.

        Bugliosi’s book on the 2000 election & on Manson I found impressive. His book on OJ was so after -the- fact, it seemed a bit loud, and a bit Monday-morning-quarterbacking. Maybe it worked better for those unfamiliar with the case.His very short (taken from his larger book) Four Days in November, capture JFK’s death for the newcomer. His latest “magnum Opus” on the JFK death is an absolute gassy overload, in a screeching voice as if his insults and volume will persuade you if his use of the evidence doesn’t. This article –and the video embedded in it– are even more damning.
    The extent of her self-absorption and the even greater depth of her LIES is even more pronounced.
    Look at her preening for this interview.
    Read about how she was almost directing the camera crew. (Stop if her forehead gets shiny and needs a make-up pat-down.)
    In this version of story #2– unlike in the version she told to Detective F– the male ninja actually put the gun to her head and PULLED THE TRIGGER.
    WHA-WHA-WHAT????!
    This reporter says that she retold the story several times, at his prompting, and each time, more details were added,–the hallmark of someone who is making it up as they go along.
    He also sees how she was sort of trying to set up her trial defense– sort of making vague statements about how there was more to the story; how it would all come out some day.

    Typical Jodie.
    Smiling all the while she is spitting out one ridiculous lie after the next.

    My bet is that is cannot wait to address the jury this coming week.
    She will be on stage for all the world to see again.
    That is the only place she yearns to be, and that is yet another motivation for her to claim she wants the DP.
    She knows that if she gets LWOP, she will just be another inmate after a few weeks of behind-bars-notoriety.
    But if she gets the DP, she will get a great deal more press coverage– and she will get a plethora of free legal help, not just from the court-appointed attorneys for her DIRECT APPEAL in the Arizona legal system, but also from lawyers and groups and just general members of the public who are simply anti-DP for anyone, because they are concerned about the potential for an innocent person to be put to death (and not because they care about Jodi) in all of the numerous state and federal appeals that will be available to her.
    I’m not saying she has a shot. I’m just saying she will have plenty of opportunity to keep her name in the press; eyes on HER, and that is what she craves most, IMO.

    I wouldn’t be shocked if she accused Nurmi of making “inappropriate” comments to her in some future “IAC” (Ineffective Assistance of Counsel) argument someday.

    I expect her DIRECT appeal (the first state appeal) to include, among other arguments, some version of the following general categories:
    1. Ineffective Assistance of Counsel (there will be many, separate arguments made under this particular heading; will not guess at what she will allege, because we cannot know how they confidentially advised her at this point; also, it is fairly common for arguments of IAC to allege errors committed during trial, such as the failure to object to the introduction of certain pieces of evidence/the failure to bring forth certain pieces of evidence or to gather certain evidence, etc);
    2. Prosecutorial Misconduct (Do not panic. This is often alleged in direct appeals to no avail. It is par for the course, and here, we have the convicted defendant ON THE RECORD already alleging that JM engaged in official misconduct. Due to her obvious hatred of him, I expect all kinds of nonsense to be alleged. One issue that will likely arise is the disparity in time of the murder sequence. During trial, JM cross-examined Jodie extensively on the amount of time between the last photo of Travis alive in the shower and the photo of his being dragged down the hallway–and argued that there was simply not enough time for her story about being slammed down onto the floor, getting up, running to the closet, climbing up to get the “gun”, etc to take place, because it was only a little over ONE MINUTE. Then, during the aggravation phase, he argued to the jury that Travis suffered for TWO MINUTES–and had everyone sit in silence for 2 minutes to make his point that it was a long period of time to suffer physical and emotional pain. Well… that is not going to help overturn a guilty verdict on Murder 1, but it is her only shot at getting a new aggravation phase– and it is incredibly weak, because even suffering that kind of attack for 1 minute would be sufficient for a jury to find the extreme cruelty aggravator to have been met. In other words, even her best shot is about as strong as a cup of tea made with luke-warm water and a tea bag that had been dug out of the trash after 2 previous uses. AGAIN, it is impossible to predict with specificity what arguments will be made. Lawyers will read the ENTIRE court record and scour it for ANY possible instance of arguable misconduct. Every statement made during Opening and Closing will be scrutinized with a fine tooth comb. Likelihood of success? IMO, 0%. The only issue I caught was the 1 vs. 2 minutes, but, as I opined, that is not going to be successful, because even if the appellate court to find that it was improper to do it, they will still find that it was likely what we refer to as “harmless error” for the judge to allow it, because an entire minute of being butchered is plenty for a jury to find the aggravator exists.)
    3. Juror Misconduct (She is likely to make some argument about some juror question(s) revealing that the juror who posed it must have disregarded the judge’s admonition, because the question somehow reveals knowledge about the case not gleaned via the official courtroom proceedings.)
    4. Defendant was deprived of “Due Process Under the Law” –a whole host of arguments can be made under this sort of very broad category. We’ll have to wait and see how creative Jodi and her appellate lawyers will be. I would expect that there might be an argument about the failure to sequester the jury due to the widespread media coverage and public interest in the case, not only locally, and not only nationwide, but worldwide as well.
    5. Improper rulings on evidence. (Almost all direct appeals include arguments about evidentiary rulings. She will have a difficult time here, because this judge granted the defense a very wide path.)
    6. NEED I GO ON?

      Thank you, as always, for lining that up. My question for you, will the State respond to each argument posed or does the appeal go forward without the State commenting? I ask because I have not ever considered the amount of time a prosecutors office must spend with appeals! Or are they handled by a seperate office?

      • WhereIsSHE

        The State files a Response. So, yes– both sides get to make their arguments.

        05/18/2013 at 3:41 pm

        Typically, there is an appellate division within the prosecutor’s office which handles appeals. Of course they can consult with the assistant prosecutor who tried the case, but it is generally their ultimate duty to prepare, file and argue (if argument is ordered by the court) the response brief.

      I want to caution folks here not to get too worked up over the number of issues and/or length of the Direct Appeal brief or in any and all subsequent appeals filed. (Most states have some form of post-conviction-relief-act which allows for an appeal if evidence of innocence is produced anew, or if evidence of official misconduct is discovered anew. This is the process by which some men rotting in prison for 20 years for a series of rapes they did not commit were finally exonnerated when the science of DNA testing became available AND there were still pieces of evidence preserved properly (e.g. underwear, sheets, etc) which could be tested. Even then, it often took YEARS for the lawyers who represented the wrongfully convicted men to get a court to even ORDER that the testing be done, because the testing was vigourously fought by the prosecutor’s office– for what reason, I can’t quite grasp, because some of those exonnerations have led to finding the true rapist, who sadly had continued to engage in serial, violent rapes while an innocent man lost irreplaceable years of his life behind bars with the company of extremely violent, deviant prisoners around him at all times.)
      ALSO- there are federal appeals that all can file, even when it isn’t a DP case.
      Look up “Petition for Habeas Corpus” if you care to know more.

      I have to get back to actual work!

      Hope all are enjoying the post-verdict-catharsis.

      I wouldn’t be as harsh on the judge as others appear to be.
      It took some extra caution and time, but the verdict was worth every second of extra caution and time, and the liklihood of a successful appeal by this convicted defendant is greatly diminished dut to the extra caution she employed.

      Oh, she’s ready to slap ineffective counsel. Yet, she asked more than once to have Nurmi as her counsel. That won’t fly. He wanted out, and she wanted him. Nurmi has covered his ass, no doubt about it. He has by no means been the first council to say that liking a defendant matters. They would have called Matt To the stand if they thought he could help.

        05/19/2013 at 5:46 pm

        Kristy-
        LEGAL argument is different from FACT(UAL) argument.
        Even if there was a dispute between Arias and Nurmi regarding his representation of her.. that does not, in any way, waive her right to complain–LEGALLY–about his perfromance as a pre-trial, trail, post-trial ADVISOR/COUNSELOR and/or TIRAL ADVOCATE.
        As I opined– I expect a number of IAC arguments to be made by Jodi on appeal
        Not saying they are valid or even worthy of discussion.
        Just saying that these are fairly anticipated appellate argumentsthat Jodi will make.

    For all of you whose taste is in question 😯 Robert, Beans, HJ and any others not converted……………

    Justified has received widespread critical acclaim, particularly for its acting, directing, art direction, and writing, as well as for Olyphant’s lead performance. Justified has been nominated for seven Primetime Emmy Awards as of 2012, with two wins, for Margo Martindale’s performance as Mags Bennett and Jeremy Davies’ performance as Dickie Bennet

    The series has been highly acclaimed by critics. The pilot episode that aired on March 16, 2010 was watched by 4.2 million viewers and was the highest debut show for FX since The Shield.[16] On the review aggregator website Metacritic, the first season scored 81/100,[17] the second season scored 91/100,[18] the third season scored 89/100,[19] and the fourth season scored 90/100, all indicating “universal acclaim”

    Author Elmore Leonard ranks Justified as one of the best adaptations of his work, which includes Get Shorty, Jackie Brown, 3:10 to Yuma and Out of Sight. Leonard also praised the casting of Olyphant as Raylan, describing the actor as “the kind of guy I saw when I wrote his lines.

It was only on for 3 seasons on HBO and once you get over the foul language, it is excellent and based on real characters like Wild Bill Hickock, Calamity Jane, Wyatt Earp, Seth Bullock and Al Swearengen and the real Deadwood, ND in the 1870’s.

      My dear; if someone goes and reads/views something on a recommendation, its a credit to the person suggesting the experience. If, one doesn’t respond the same way as the suggester, its simply different temperaments at work. No need for stance!

      .In my case, no amount of “good reviews” or comments by the author is going to change my own perceptions and analysis Generally I experience film without reading ahead of time any reviews so that I can get my own experience. I frequently attended “previews” of plays on and off Broadway for the same reason. It’s hard to try and have “pure” experiences without the influence of critical or popular thoughts. I’m somewhat of a voracious reader, but I doubt I would continue reading an author i didn’t like reading just because a lot of other people like him or her..

      Anyhow, I may watch some more to see if they tighten ’em up. But I think a decision was made on the style and pace and atmosphere to keep the show “soft”;; there is violence but a lot of Hallmark card atmosphere and a lot of slow talking like life is like a Clint Eastwood spaghetti western rather than like…well..life. But I know many people who don’t share that opinion but I’m glad that it doessn’t affect their enjoyment of watching the show..

    On video 17.. here’s Jodi.. arrested for Murder 1, just been told by the detective he doesn’t believe a word of her ninja story.. she’s been left alone while they organise to have her taken back to jail and start proceedings to get her to Arizona..

    Now… most people would have stomach churning and feeling sick.. what is Jodi doing? sitting in the chair, stuffing her face with whatever has been left for her… making ‘notes’ and looking through stuff on the table.

    How the heck could she eat at a time like that let alone stuff her face like she is? That shows her lack of physical reactions.. quite amazing. then she seemingly cries a bit.. sits up and stuffs her face again scribbles recommence.

    MMD :
    I have always felt that she got away with murder. She may not have carried out the act but I feel she knows way more than she is telling. That is why I will not read her book or watch any of the interviews that she is doing/done. just a feeling in my gut

    I agree with you MMD – will not buy her book! I have always believed that she is guilty but I figured that I would watch the CNN interview and see for myself what she had to say. Unbelievable that she did that interview. Her guilt oozes from her every word and all of her non verbal body language tells. Truly mind boggling that she did the interview with Cuomo, which just strengthens and confirms that she is a BIG liar for all people who watched.

    Senior Moments made some valid comments “Stories that I read about the vindictiveness of the prosecutor, the treatment during questioning and just the idea of being in this situation in a foreign country where she is unfamiliar with the legal system and barely knows the language made her innocence completely believable to me”, that I thought a lot about when Amanda was 1st arrested. But her proven lies were a huge worry for me. Who would LIE (an easily proven lie) which involved blaming an innocent person for the horrific crime of slitting her roommate’s throat?

    Last week I looked up what Eyes for Lies had to say about her because I remember
    that when the crime occurred years ago that Eyes for Lies wrote a post that she was a big
    liar. Here’s a link to all of her articles on Amanda Knox.

Not one of his better films, but I have to say that Alicia Silverstone’s character’s creep factor is right up there with Jodi’s. Has anyone else seen this movie? I hadn’t thought about it at all until I saw Jodi’s face while she was viewing exhibit 205 on the big screen in court. If the defense chooses to show her artwork in court, does it get marked as evidence? Can Juan show the original Dior images if she shows any of those, or any others that are copies? It would be so powerful for him to show side by side images of “her” work and the original pieces, while talking about how she’s a liar and manipulator, yet never mention the “artwork”. Just let the side by sides speak for themselves. I would LOVE to see that!

      • HJ Madison
        05/18/2013 at 5:12 pm

        I think her “art” will be used as a “visual aid” only, so will not be marked as “evidence”. If it is presented, JM will certainly be able to show the original sources. If Jodi is foolish enough to take the stand, he will likely ask her directly about it. One of the down sides to this blog and others is that Jodi may have thought she fooled us all with her skills, until the originals were posted. Lets hope she still considers it worthy, even though the rest of us see it as a traced knock-off!

      • 05/20/2013 at 12:15 am

        If the art work is in fact shown in court, can Juan let them know she is selling them online for $1500-3000? It’s too bad he can’t say something like, if she had any remorse for the murder and for the Alexander family, she would have donated that money for their travel expenses.

        I wonder if he can tell about the survivor t-shirts? Give the jury a little laugh.

        Mom Arias was also recruited/manipulated by her murderess daughter to contact the ENQUIRER about publishing the forged/fake incriminating letters allegedly written by Travis Alexander.

        “Jodi wanted me to get these letters out to the public. I am only doing this because she asked me to,” her mother tearfully told an ENQUIRER reporter.

        “Jodi has several other letters in her possession, but she’s holding off on releasing them.”

    HJ- I’m not sure? I’ve heard conflicting info, so the Mom may very well be on the defense’s list. I do think it’s risky tho, given her police interview and tumultuous relationship with her daughter.

    Seriously, it is risky, but I just don’t see Juan coming after her too hard. Jodi is an adult and it is SO hard to get an adult help. Juan knows this. I see him asking simple clarifyng questions only. (- like where did she buy the brutal spoon ! 😁)

      It depends who Jodi is talking to I suppose, or who she thinks is listening. I agree with FamilyOfLaw who posted earlier it is all about the appellate process now. My guess her chat with Nurmi in jail on Friday focused on the most advantageous way to “work the system”. If she truly wanted “Death” she would request no more appeals. That will NEVER happen!

    Janna :
    Mom Arias was also recruited/manipulated by her murderess daughter to contact the ENQUIRER about publishing the forged/fake incriminating letters allegedly written by Travis Alexander.
    “Jodi wanted me to get these letters out to the public. I am only doing this because she asked me to,” her mother tearfully told an ENQUIRER reporter.
    “Jodi has several other letters in her possession, but she’s holding off on releasing them.”
    According to Mrs. Arias, only electronic copies of the letters exist.
    “Jodi told me that the originals were destroyed,” she said.
    Wouldn’t Mister Juanderful have a hey day with Mom Arias on the stand ??????

    FOL and HJ ….. please share your thoughts/insights about how this could play out in the courtroom if Sandy Arias took the stand.

      Hi Janna – Where did you find this goody? Oh dear, that Mom is just another one of JA’s victims of JA’s dastardly manipulations. Mind you, I’m not a big fan of her courtroom antics, giggling and whispering like she’s in a movie theater… But I did see a desperately sad side of her during the police interview- I don’t think she ever knew what to do with JA.

      Those forged letters were JA’s pride and joy! When they were precluded, that’s when she gave the State an ultimatum, “Give me 2nd Degree, or I’ll drag Travis and his family through Hell”! If Mama does take the stand, I don’t think Juan will bring up the letters, or the police interviews, he’s got this in the bag, and I think he will keep it all very simple. I’m wondering if he’ll mention the FOX post guilty interview when JA is in his cross hairs? What do you think?

      I think JA knows this is over, and all of her maneuvers and behaviors from here on out, will be focused on her Direct Appeal. She’s DONE with her DT, and she is DONE with this jury- how dare they not believe her?!? My guess is, she is probably setting her sights on her new Appellet attorneys. Given that, I have no clue “which Jodi” we’ll see on Monday? I wonder if she’ll stand at the podium (not wanting to be outdone by Sam and Steven) or take the witness stand…? But my $ is on her standing at the podium.

      • ringadingding

        “Which Jodi” we’ll see is a great question. I’ll place my bets on defiant with a chance of self-serving tears. Zero contrition, except if it’s in a way that serves a backhanded slap at Travis and/or his family.

      • Janna
        05/18/2013 at 8:55 pm

        Agreed FOL. The courtroom behavior of Mama Arias lacked sophistication and common sensibility.

        Thank you for explaining the relationship between those cowardly forged letters and stabby’s blackmail ultimatum. I never connected those dots before.

        I would experience extreme gratification and grin like a green-eyed gremlin to have the Fox interview tape entered into evidence by Juan. IMHO the jury SHOULD be allowed to see the interview. It’s relevant. It’s pertinent. It reveals the deep infestation of evil that flows through every blood pumping vessel of Jodi Arias. In my non-Einstein brain, the million dollar question is “why wouldn’t Juan introduce the tape?”

        Whatever stage WOBO chooses to use on Monday, we can be assured of hearing more pompous grandiose lies spewing from her devilish tongue. I think she’ll want to stand at the podium if for no other reason than to mirror the Alexander siblings.

        05/18/2013 at 9:08 pm

        Janna I have heard rumblings about trying to get the reporter in but wonder if they will. My thought is that they might want to talk to him about her arranging the interview in advance while waiting for the verdict and the voice mail she left.

        What do you think????

      • Janna
        05/18/2013 at 9:26 pm

        MMD – Everything you said. The words of the reporter will be FAR MORE credible than listening to CFJA back pedal and spin another layer of lies.

        This is a life or death sentence situation. Arias didn’t tiptoe through the tulips to secure the Fox interview. UNLEASH THE BOMBSHELL Juan!!

      • MMD
        05/18/2013 at 9:38 pm

        Exactly Janna that was my thinking. The jury is tired of JA and they know they can’t believe a word she says whereas this is another way to show her complete lack of remorse. Plus JM will get in exactly what he wants in the way he wants.

    • HJ Madison
      05/18/2013 at 8:00 pm

      IMO, the letters we know about were shown to be fake and withdrawn by the defense. The only time they were mentioned was outside the jury presence when Nurmi used them to enrage Chris Hughes and get him to admit he told Searcy that Nurmi was “a snake”. The letters are off limits and no one will mention them. If mom takes the stand at all, I think she will give a cursory overview of Jodi’s life: good student, few friends, not enough money, parents working too hard, etc., her discipline methods, she thought, were reasonable. She may say she was growing more and more worried about Jodi, but could do little to help her. She loves her, as any mother would, and she knows Jodi will be a model prisoner …. please don’t execute her. I don’t think Juan will ask anything more than clarifying questions. He does not need to and he will only risk looking like a bully if he gets too heavy handed.

    So just throwing my 2 cents in about the Amanda Knox things: I have read her book and the book by her then-boyfriend and have watched the recent interview – the most compelling evidence FOR believing Amanda is that there is NOT a single piece of DNA from Amanda or her boyfriend in Meredith’s bedroom. Nothing – no hair, no blood, no fingerprints, NOTHING – from either one. The guy who raped her and killed her had his DNA everywhere in the bedroom and on Meredith. He was convicted of her murder. I believe she and her boyfriend are completely innocent and were treated extremely badly by the Italian justice system. My 2 cents. 🙂

    • HJ Madison
      05/18/2013 at 8:25 pm

      I agree. She was a young 21 year-old in a foriegn land. She behaved in a seemingly “odd” and naive way following the crime. And, the Italian legal system is, shall we say, “complicated”. IMO

    • ringadingding
      05/18/2013 at 9:23 pm

      I don’t know a whole lot, but after looking at a couple youtube videos and the heated comments, many people describe her the way that we talk about JA. In reading the comments, it’s almost as if these two are interchangeable. I just don’t know. I wonder why anyone who is innocent would lie to police and implicate an innocent man (her boss, Lumumba). It just doesn’t make sense. The man that admitted to being there (Guede) the one whose DNA proved he was there…his sentence was reduced to 16 years (I think Amanda got the most–26 years). It would seem he’s the real murderer. So…again, why would Amanda point the finger at her boss?

      One commenter suggests that Amanda had brought the real killer (Guede) home for the evening, but wasn’t lucid enough to distinguish him from her boss (who, like Guede, is black), and that is why she says she kept thinking she could have been murdered.

      I wish I could read these people better. I watched the Anderson Cooper interview with Sollecito and he seemed sincere to me. Yet, others say he’s a liar and a user.

      • Allison
        05/18/2013 at 9:41 pm

        You really should read her book – these questions you have are all answered. in a nut shell (which doesn’t do it justice) she implicated the boss guy after hours and hours of interrogation where they lied to her telling her that her boyfriend was implicating her, she hadn’t had any sleep, food, and they hit her in the face while screaming at her. You really gotta read her book to get the entire feel of what she went through. The killer got a reduced sentence for (again) lieing about the crime. That commenter suggests is completely wrong. Her boyfriend also was sentenced and and they told him if he lied about Amanda he would get a lighter sentence, but he never would lie to them.
        Amanda is NOTHING like JA.

        05/18/2013 at 10:52 pm

        I agree with ringadingding. Other than her palm print, was there any DNA of JA? If I recall correctly, there wasn’t DNA of Coleman in the Christian/Newsome murders. Plus, if your source is Amanda’s book, that’s like saying reading JA’s book would tell us the truth.

    I’m with you Janna. I did feel badly for her during the Interrogation video but my sympathy for her l-o-n-g ago faded and here are the reasons why:

    I would NOT laugh in court.

    I would NOT wear a ribbon for a cause that my child is lying about.

    I would NOT complain to the judge about the victim’s family wearing ribbons for their brother.

    I would NOT approach a tabloid to sell forged letters.

    I would NOT attempt to tamper with the jury by lying about them – proof of this was provided in the daily court minutes.

      Amen Nancy! I’ve ranted endlessly about this… I wrote an entire diatribe some weeks back. I will never understand her complaining about Travis’s family wearing ribbons! And when she was told that the judge would not agree to have them remove them, she pulled the ultimate nasty sophomoric stunt, by appearing the very next day with her own ribbons!!!!

      The entire Arias entourage is low brow, low class. It’s a very stark contrast to how the Alexander’s and family friends have comported themselves. Every day, the Alexanders show up in court, dressed respectfully, and behave in a dignified manner.

      What are the court minutes your referring to re: lying about the jury? Does this tie back to juror #5’s removal? Or something else?

      Hi John- like MMD said, the FOX post guilty interview was the last straw. During the interview, JA proclaimed she wanted the death penalty “death is the ultimate freedom”- The defense team is sworn to defend her to the best of their ability, she made their argument for LIfe very difficult. Of course, there are some legal minds that believe her attorneys were in cahoots with her doing the interview, and are orchestrating the entire charade to help her when this trial is over, to be used in her Direct Appeal…

    For anyone interested in the Amanda Knox evidence here’s a very interesting article.

    “My legal colleague Some Alibi hammers home in the post below that the trial jury were not fools. They decided for guilt unanimously, based on many compelling evidence points.

    1) Do you know how many hard evidence points there are? Literally hundreds. This is a very evidence-heavy case. And at trial in 2009 the prosecution did an excellent job. Between February and June, in about a dozen one-day sessions, they presented an overwhelming case and tied together all the points.

    2) Do you know how many conclusive evidence points are required for a finding of guilt? Just ONE. If it is definitive enough, a single piece of evidence can decide any case. Some Alibi posted a damning footprint example the other day which BY ITSELF could have seen Sollecito convicted in any UK or US court. There are examples too for Knox.

    3) Do you know how many evidence points were discredited during the trial and the anulled appeal? In fact it was NONE. A spooked defence kept well away from the alibi evidence, the cellphone evidence, the computer evidence, the mixed-blood evidence, the obvious crime-scene re-arrangement, and most eye-witness evidence.

    The annulled appeal in fact focused only on two specks of DNA and one eye-witness account, and even those, as the defenses admitted, were not conclusively undermined. They didnt come close to proving two other killers had even been in the house, although the Supreme Court had already ruled (in Guede’s final appeal) that Meredith had been attacked by three killers.

    My colleague Kermit and I now want to present for you some Powerpoint slides which will introduce you to most of the formidable evidence in the case, in the same way the jury processed it.

    Load the Powerpoint Viewer if not on your system, and click here for the slides. Hang on. This is a big file but they should load in under 60 seconds.

    Finally I would point out a challenge I made for ANY lawyer who believes Knox and Sollecito are being railroaded (for which there is zero obvious reason why) to answer all the open questions Knox and Sollecito wont face.

    Do you know how many spoke up? So far NONE”

    http://truejustice.org/ee/index.php

    The power point slides elucidate a lot of facts of the case which I was not aware and which the mainstream American media has not covered well or at all.

    A Welcome To New Arrivals #1: An Experienced Trial Lawyer Recommends How To Zero In On the Truth
    Posted by Some Alibi

    Welcome

    This briefing was first posted with slightly different opening paras at the start of the annulled Hellmann appeal. New arrivals often tell us this helped them the most.

    If you’ve come to this website because of the Amanda Knox book and interview, then welcome. Like all of us who come to this case, you have one key question: did they do it? The Knox book and interview seriously cherrypick the case, and perhaps haven’t helped you at all.

    On the Internet, you will find people who are passionate in their defence of Amanda Knox and Raffaele Sollecito; and you will find people who are passionate in their support of an exceptionally talented girl who died, of a fine justice system previously untainted by PR, and of the prosecution’s very strong case.

    My own arrival

    Placing my own cards on the table here: as a twenty-plus year practising trial lawyer, I am firmly a part of that latter camp. But it wasn’t always that way.

    It was information – evidence – that changed my views. What became very clear to me, early on, was that very few people in the English-speaking world are aware of anywhere near all of the evidence in this case.

    I had thought I had grasped the core of the case, but I had not. The case is deep and complex, and like many criminal cases, the complete facts behind it have been only sketchily reported in the media. Even less-so in the US and UK.

    Huge swathes of recent developments have not been reported in English at all except here on TJMK. This post and this post for example are extremely key but all those facts can still only be read in English here.

    The unanimous jury

    I am sure that we all agree that no trial jury, in any murder case, given the awesome responsibility of adjudicating on (young) people’s lives for a multi-decade period of imprisonment, condemns people lightly.

    It should be a matter of logic that the evidence presented against the accused must have been deep and satisfied the 6 lay jurors and 2 judges on the case in 2009 for them to pronounce that huge judgement. That doesn’t mean that there couldn’t be the possibility of a mistrial, but clearly the evidence presented must have been substantial.

    In this, we’ve already hit the first problem. Some supporters of Amanda Knox and Raffaele Sollecito will tell you there’s no evidence against them.

    This is patently silly. No jury ever convicts people and sends them to prison for 24 plus years without being quite convinced of the case against them. Miscarriages of justice do happen, but the idea that there is “no evidence” can be summarily dismissed.

    The only question is whether the evidence is sufficient, true and accurate.

    The voluminous evidence

    So is the evidence enough to convict beyond a reasonable doubt? The six lay jurors and two professional judges thought so, clearly. What you realise, when you come to the facts of the case, is that the evidence is based not around a single key event but on multiple points.

    It can be astonishing to realise that the case is based not only on DNA evidence but also on cellphone evidence and computer records and further yet on multiple conflicting and contradicting versions of what happened that night from the mouths of the accused, not to mention falsely accusing an innocent man of responsibility for murder causing his incarceration.

    The wealth of evidence is actually extremely unusual for a murder case. It goes way beyond the volume of evidence resulting in a death sentence in the quite similar Scott Peterson case.

    The Massei Sentencing Report

    What is absolutely new to the English speaking legal world is that the reasoning for the trial conviction can be read in an extremely detailed 440+ page trial report online.

    This trial report is back front-and-center now in light of the Supreme Court’s March decision to anull the first appeal. You can read an effective executive summary by the PMF translation team here.:

    It was my privilege to play an extremely small part in that translation and summary work. People from four different continents with backgrounds in forensic science, law, academia and a host of other disciplines participated in the work.

    The Knox PR campaign

    If you are new to this case, you will likely be shocked how much evidence there is against the convicted parties. Amanda Knox’s family have spent over $1m and involved a professional PR agency called Gogerty Marriot to suggest otherwise in the English-speaking media.

    You might wonder why an innocent person needs a million dollar PR campaign on their part. Make yourself a coffee and read the conclusions at the end of Judge Massei’s report. It will take you about 15 minutes. Up until you read this report, almost everything you watch, hear and read is PR spin and is quite deliberately positioned to make you believe there is no case.

    When you complete it, I believe you will have a very different take. That 15 minutes could change your ideas about everything you thought you knew about the Meredith Kercher case.

    A quick tour of the evidence

    Consider as you read this what is your own possible explanation for each of the following:

    the DNA of Raffaele Sollecito on Meredith’s bra-clasp in her locked bedroom;

    the almost-entire naked footprint of Raffaele on a bathmat that in *no way* fits that of the other male in this case – Rudy Guede;

    the fact that Raffaele’s own father blew their alibi that they were together in Raffaele’s flat at the time of the killing with indisputable telephone records;

    the DNA of Meredith Kercher on the knife in Raffaele’s flat which Raffaele himself sought to explain as having been from accidentally “pricking” Meredith’s hand in his written diary despite the fact Meredith had never been to his flat (confirmed by Amanda Knox);

    the correlation of where Meredith’s phones were found to the location of Raffaele Sollecito and Rudy Guedes’s flats;

    the computer records which show that no-one was at Raffaele’s computer during the time of the murder despite him claiming he was using that computer;

    Amanda’s DNA mixed with Meredith Kercher’s in five different places just feet from Meredith’s body;

    the utterly inexplicable computer records the morning after the murder starting at 5.32 am and including multiple file creations and interactions thereafter all during a time that Raffaele and Amanda insist they were asleep until 10.30am;

    the separate witnesses who testified on oath that Amanda and Raffaele were at the square 40 metres from the girls’ cottage on the evening of the murder and the fact that Amanda was seen at a convenience store at 7.45am the next morning, again while she said she was in bed;

    the accusation of a completely innocent man by Amanda Knox;

    the fact that when Amanda Knox rang Meredith’s mobile telephones, ostensibly to check on the “missing” Meredith, she did so for just three seconds – registering the call but making no effort to allow the phone to be answered in the real world

    the knife-fetish of Raffaele Sollecito and his formal disciplinary punishment for watching animal porn at his university – so far from the wholesome image portrayed;

    the fact that claimed multi-year kick-boxer Raffaele apparently couldn’t break down a flimsy door to Meredith’s room when he and Amanda were at the flat the morning after the murder but the first people in the flat with the police who weren’t martial artists could;

    the extensive hard drug use of Sollecito as told on by Amanda Knox;

    the fact that Amanda knew details of the body and the wounds despite not being in line of sight of the body when it was discovered;

    the lies of Knox on the witness stand in July 2009 about how their drug intake that night (“one joint”) is totally contradicted by Sollecito’s own contemporaneous diary;

    the fact that after a late evening’s questioning, Knox wrote a 2,900 word email home which painstakingly details what she said happened that evening and the morning after that looks *highly* like someone committing to memory, at 3.30 in the morning, an extensive alibi;

    the fact that both Amanda and Raffaele both said they would give up smoking dope for life in their prison diaries despite having apparently nothing to regret;

    the fact that when Rudy Guede was arrested, Raffaele Sollecito didn’t celebrate the “true” perpetrator being arrested (which surely would have seen him released) but worried in his diary that a man whom he said he didn’t know would “make up strange things” about him despite him just being one person in a city of over 160,000 people;

    the fact that both an occupant of the cottage and the police instantly recognised the cottage had not been burgled but had been the subject of a staged break-in where glass was *on top* of apparently disturbed clothes;

    that Knox and Sollecito both suggested each other might have committed the crime and Sollecito TO THIS DATE does not agree Knox stayed in his flat all the night in question;

    the bizarre behaviour of both of them for days after the crime;

    the fact that cellphone records show Knox did not stay in Sollecito’s flat but had left the flat at a time which is completely coincidental with Guede’s corroborated presence near the girl’s flat earlier in the evening;

    the fact that Amanda Knox’s table lamp was found in the locked room of Meredith Kercher in a position that suggested it had been used to examine for fine details of the murder scene in a clean up;

    the unbelievable series of changing stories made up by the defendants after their versions became challenged; Knox’s inexplicable reaction to being shown the knife drawer at the girl’s cottage where she ended up physically shaking and hitting her head.

    In conclusion

    This list is not exhaustive. It goes… on… and on… and on… And yet, those supporting Knox, many of them intent on making blood money, will tell you that’s all made up, all coincidental.

    Really? Does the weight of all that evidence sound made up to you?

    If so, it must be the most over-rigged criminal case in the history of crime. Unlikely beyond all and any reasonable doubt.

    Judge Massei’s report explains why the jury found the defendants guilty. I truly expect you will be astonished at the amount of evidence if all you’ve done is watched a film or read a few press reports.

    For any questions thereafter, please join us and post them on truejustice.org or perugiamuderfile.org . You’ll find here a host of good people who are all working on a totally volunteer basis, in memory of the only victim of this crime.

    Meredith Susanna Cara Kercher. RIP.

      Thank you Nancy. Truly!!!! 🙂 I said in my original comment that my gut felt that if Amanda was not involved in the murder then she knew way more than she was saying and that was why I refused to read her book or watch any of her interviews.

      This sheds so much more light on the case. I always figured that we weren’t getting the full picture and the language barrier only exacerbated it. Throw in a PR firm, money, a manipulated media, tunnel vision and the truth gets hidden. In the meantime the family of the victim of a brutal slaying is left with no answers or justice and the perpetrators get to continue on with their lives and profit from it. Plus we all know that hell will freeze over before she is ever extradited back to Italy! Truly sad!!!

      As an aside I’m sure that many of us on here can relate to gut feelings. There may be no rhyme nor reason to why you feel the way you do, you simply do. I have always found that when I ignore my gut, it is to my detriment. (personal experience only) The only problem I have with gut feelings is when it won’t give me a feeling definitively and on those occasions that truly drives me nuts!!! 🙄 I am a very black/white – right/wrong type of person but let me tell you, I’ve made my share of mistakes. Please don’t get me wrong, I’m fully aware that life is full of shades of gray but usually somewhere is the gray is a tilt to one side or the other somewhere. It’s just a matter of digging deep enough to find it and with years and life experience comes wisdom, hopefully. 😉

      Sorry for the rant and getting off my soapbox again…………….. 😳

    Syn, good afternoon. Wondering if you any thoughts if JA’s response would have been different to VIS since she quite minimally doodled to soothe (maybe as a result of,juror 8’s interview)? Was it horribly difficult/annoying to do this. She seemed to be on meds but it alll could have been the real her in all her glory.

  67. Tracey A
    05/19/2013 at 1:32 am

    OK…on the Amanda Knox stuff. I hate to say that I’m not well versed on her case and the evidence. But I saw her last few interviews on 20/20 and one other show that I just deleted. My only observation (and Nancy B has some great stuff upstairs that I need to review) is that during those interviews…she completely reminds me of JA with her lack of affect. There are points made that she should be crying her eyes out and yet, she can’t seem to shed a tear. It was surreal to watch when you try to contrast that with JA’s demeanor in her on camera interviews.

    • Family of Law
      05/19/2013 at 1:42 am

      I haven’t studied it well at all- When she was still in Italy, I saw a Dateline or Primetime story, and I saw her interview done recently by Cuomo- there’s something about her darting eyes, and flat emotion that really is a lot like JA- and I liken her inappropriate “cartwheel” to JA’s headstand, equally bizarre.

      • NancyB
        05/19/2013 at 10:16 am

        I agree with you both! She does remind me of JA in many ways. Also both her and Raffaele turned off their phones at the same time and for more than 6 hrs and then turned them back on at the same time. This time frame corresponds to the time of the murder and attempted staging and clean up. Phone records substantiate that in the preceding 4 week period of the murder that neither of them had ever turned their phone off at any time. Another similarity is the *multiple* changing stories that Amanda has told from the beginning of the time when Meredith was brutally raped and murdered.

      OMFG! I’m going to have to read this over and over again. This has truly creeped me out. Great post NancyB. I’m gonna have to reread this several more times. It raises the hairs on the back of my neck. In fact, it makes me think of my psychopathic sister and all her “relationships”. It also reminds me of what some on this site have been through in their lives as of late. Consider the reverse effect, it is even more disturbing. TY NancyB…I’m gonna need to reread to get a grip on all the creepy factors that this has raised in me. WOW! Seriously! I’m speechless….

      Wow. Thanks for sharing, Nancy. What fascinating insight. And yes, chilling.

      One of the comments (in answer to the question about why JA didn’t just take the SD card) points to so much of JA’s swift ability to co-opt an identity (in this case, “photographer”) with absolutely no training or study. As someone who knew her said on Dr. Drew, she always looked for the easy way, the short cuts. At any rate, this is the comment in response to why she didn’t take or destroy the SD card:

      “I think the reason Jodi failed to remove the SD card was because 1) She wasn’t a photographer, but a waitress with a camera who would impress people with the title of Photographer. Her photos aren’t really that good & she didn’t take courses or any training. 2) Jodi knew so little about how the SD card & computers in general work, she thought that erasing photos got rid of them. She didn’t know that it only took the link to them off the index. 3) She threw the camera in the washer with bleach because her blood had got mixed with Travis’s in the cracks & crannies, & she wanted to bleach everything that might have her own blood/DNA evidence on it. Remember, she wanted to make it look like she wasn’t even there – cops were supposed to assume that 2 people killed Travis, which is why the 2nd story had 2 people w/2 different weapons in it – to support the way she planned the scene.”

      I would add (and it’s probably already been covered, so forgive) that she only took things that she’d brought with her–the knife and gun. Don’t believe there was a rope at all, but if there was, then she brought that too. What I don’t get is why, if she’s a photographer, she didn’t bring her own camera and use it to take pictures. I could see her using his new camera as an unexpected opportunity, but surely she had her own with her? If so, what happened to it?

      • Lisa M
        05/19/2013 at 10:55 am

        Because if she said, Travis, lets use your new camera, lets break in your new camera he’d be more likely to take the photos and it would seem less like stalking behavior? He already didn’t trust her so if she used her own camera he might get a feeling he was being set up. She also would have said, you can delete any photos you don’t want, so it would have given him a false sense of control over the situation.

      • Lisa M
        05/19/2013 at 10:56 am

        She probably left her camera in the car is my guess.

    • Lisa M
      05/19/2013 at 10:46 am

      Wow Nancy that was a really great read. It answered a couple of questions I had about Jodi. It makes sense to me now why she would be crying while she’s hearing the testimony of Travis’s siblings. She’s just mimicking their behavior like the blog said about a psychopath who would go to funerals to figure out how other people acted grief stricken. I just wish that here had been a sociopath diagnosis instead of borderline disorder. It explains her so much more. But I’m sure the evidence for that would’ve been excluded because it would’ve been too prejudicial so the prosecution had to work with what it had

    • MMD
      05/19/2013 at 11:06 am

      Truly scary that there are other JA type people out there. As Tracey said, it’s really raised the creep factor in me as well. I just hope that with all the coverage that this trial has brought and the education that people have received from Syn and others like her, that more people will be aware of the signs and run as fast as they can and never look back!!

    Dang! Is this sandbox for legal people only? I don’t want to get kicked out for not being lawyer/attorney. Please advise.

    Janna, Janna, Janna 😯 This is Donchais University and we are only as good as the sum of ALL our parts and YOU are an integral part of this learning institution!!! We do have some excellent people who are attorneys or attorney adjacent, but many have no legal knowledge. Everyone brings something unique to the blog which is why it is so great and our awesome Host/President donchais keeps the sandbox free from all trolls and other assorted riffraff.

    Rants are encouraged as well as questions. The more you ask the more you learn and there is a complete wealth of information available from every possible angle available from the great people who comment here. Every single one of us learns something new each day!!!

    Does that answer your question???? 😀

This site & our GREAT leader donchais, n her helpers are the safest, loveable, n most honorable place on the web!!! I’ve never felt so secure to post my comments & not felt “silly” for my input, or what I thought were “dumb” questions. And not be “judged!” Donchais has been a godsend for me to get to know so many wonderful “peeps” all around the globe! And because of this, she only attracts the BEST people to play in her sandbox!! Hey!!!! Everybody is great!!! Kittens eyes are all open, 5 sets of baby blues! Soldier/ Sweet/ Mama’s boy is getting so healthy and strong!!! He let me pit a saddle on him yesterday morning! He’s nowhere near strong enough to be ridden, but he wore the saddle without complaint, it’s a very good sign!

    I’m so glad to hear this FOL and that things are improving with the thunderstorms. It tears my heart out to think of the abuse he went through before he came to you. You have such a massive heart, not to mention a hubby who needs to be cloned 🙂 I’m so glad that you decided to keep Mama’s Boy. His name should be Lucky Boy!!! 😀

      Hubs is a good egg, (but the thought of having TWO of him to tease me? Ugh!!!). He scored BIG “Brownie Points” on Friday, all on his own accord- he cut a hole in the tack room door, big enough for Mamma cat, but small enough to keep out predators! So Mamma can roam freely! Now Mama can visit her buddy at will-

    Boy was I wrong!!! Some of you may remember that about a week ago I posted a link to another great article written by Dr. Kristina Randle. The article was her usual excellent but I was mind blown about the link that she provided in that article that was supposedly written by a self-identified sociopath attorney. Syn and a few others here posted comments that they did NOT believe that article and that it looked like that author had read a lot about the subject and was posing as one. I did not agree with that point of view then but I came across an article by Eyes for Lies and I’ve changed my mind. As it turns out I’m a sucker and several here spotted the phony easily.

    • MMD
      05/19/2013 at 10:46 am

      Well that was painful to watch. First it had Dr. Phil and second it buffered every 2 words. The most I got without buffering was “so you think”. I can see why Syn would disagree but she knows so much more than most of us so don’t feel bad Nancy.

      Good. No pressure, just wanted to get it to you. Yeah, I wrote most of it on microsoft word, but when I boght a new computer the Vista program would not allow me to work on it or cut or copy it. I had to download openoffice.org software, which is like Word, to do anything with it. AS I said, it needs editing, and if its boring or tedious, just drop it. BTW. If you read past 5 pages you will be the 1st to read…

      • 05/19/2013 at 11:27 am

        After the appeal for new trial is done, I will try and tie it all up for 20th anniversary of murders.

        I opened it with open office.. then I put it into my storyist program.. and excellent little program I downloaded from a UK site. Can’t rmemeber how much it cost but it was well worth the money.

        It seems hard to imagine that it has been 20 years since these murders. I had my day planned around the trial, thankfully I was living outside TO at the time so was on ET, and followed the trial with Jim Moret’s panel discussion on CNN every night. That was during the days when they actually knew of what they were talking about and did real news and HLN was simply Headline News.

Also, like you said up there ^ Syn, how long will they drag this out, while Juan and the family are left ripping their hair out in frustration!

      • 05/19/2013 at 2:16 pm

        FOL.. One thing to keep in mind… if Juor #8 is anything to go by.. the jury do NOT believe the paedophilia for one moment… so as hard as it is to put up with that cr@p dribbling out of her mouth.. the silver lining is.. if the jurors on the panel currently are of that same vein.. that is just going to make them more disgusted.. which means it will backfire on her.

        They have found her guilty.. of extreme cruelty.. anything she does more cruel surely will exacerbate their disgust. That’s how I’m going to try to look at it when I have to listen to her dribble.

        Anything short of admission and remorse is going to disgust those jurors. So for me I’m not really that ‘worried’ about what she will say… more what these witnesses might say to pull on the heart strings of the jurors. But the good thing is.. no matter what.. she has been found guilty of extreme cruelty and premediatated/felony first degree murder.

        So in that she has been held to account. As I understand it all that is left is LWOP or DP. LWOP means she cannot get parole right? So at the very least she will live her entire life in jail.

      • MMD
        05/19/2013 at 2:22 pm

        Well hopefully if JA has a brain in her head, and I’m assuming that she has at least one brain cell, she will not trash TA any more as she knows that the jury doesn’t believe her.

        On the other hand, which I think is more likely, if she is strictly done with this jury/trial and is only focusing on her new appellate attorneys, then it’s going to be a nasty and bloody free for all because she’s just that evil 👿

        Either way, it’s not going to be a pretty sight for any of the parties involved. 😦

        05/19/2013 at 2:29 pm

        Who needs itty bitty golf pencils, when they have you to soothe????? Ahhhhh, breathing, yes- you are right! (again!) I did love when Juror 8 said that he never bought any of her lies about Travis being a pedophile- and given their two verdicts, they don’t buy her cr@pola either!
        LWOP not only means she can NEVER get out, it also means her rights to appeal are limited to only one Direct Appeal. If she gets the DP, lil miss frying pan eyes will appeal and appeal and appeal. The good news is, it’s about a 1% chance in Arizona that her sentancing would ever be reversed. It’s lose, lose for JA.

        Which bit@h do you think we’ll see tomorrow? Do you think there’s any chance she will “cry” and beg for mercy?

      • MMD
        05/19/2013 at 2:42 pm

        Nope, she won’t beg for anything. After all it’s all Travis’ fault that she’s even there doncha know, but as far as she’s concerned, she moved on from this trial. imo

        Remember, she’s still winning in her mind!!! (gag me with a very large spoon) imho

        As slimy as her attorneys are, you know they want this to be over quickly – I think they are so done with her, but they have to do their jobs. Unfortunately. I’ll bet they have been hammering it into her that the jury obviously doesn’t believe her and her only chance is to show some humility and remorse, and those are words that just aren’t in JA’s vocabulary. She left them out so she could have edify and de-edify. I don’t know if even her mother could save her, because the jury is made up of regular people and as disgusted as we’ve gotten by her courtroom behavior, they have to have observed and formed opinions as well. If I were a juror, I would also wonder why there aren’t any other friends, family members, co-workers, anyone to stand up on her behalf. I think in the end, it will be her own address to the jury that will do her in. She is so arrogant and lacking in self-awareness, that she just can’t see how she comes across and can’t help her self-serving, manipulating, lying behavior. It’s her chance to do nothing but talk about Jodi. Should be a train wreck.
        Even if she were to express remorse at this point, I don’t think it will be believed.

    Has anyone here served on a DP jury or have inside information? I’m just wondering about the framework for those deliberations. In terms of weighing the penalty, if all they have to go on are the mitigating factors presented by the defense, this would have to be a very quick deliberation. I mean…isn’t the first factor that she was 29, with no criminal history (at least on record) when she butchered Travis? Unless I’m missing something here, I’m failing to see how that’s going to swing a vote.

    • nyccowgirl
      05/19/2013 at 2:41 pm

      I don’t quite understand the process either. Common sense would say that mitigating factors should either be related to the crime (e.g., something that may have caused a reasonable person to do something similar, not as brutal) or other things during or after the crime (e.g., contributions to society such as volunteer work). I don’t see how a long-lost friend who hasn’t been in contact with her years before the crime, art work or the other factors listed are mitigating anything. Shouldn’t the defense attorneys have to connect the dots or is it like the guilt phase where they can throw up anything and see what sticks?

        05/19/2013 at 4:05 pm

    I don’t know whether or not anyone has mentioned this on not. We all know that they Alexanders have been going through absolute hell for the past 5 years and it has affected all aspects of their life. Sam and Steven definitely showed us that with their VIS on Thursday.

    Did you know that since this trial started not only did the grandmother die 2 weeks before jury selection but that Sam has lost 3 friends? Sky Hughes was talking about it on Dr. Drew on either Thursday or Friday night. Since trial began Sam lost a woman, who was a mother figure/mentor to her to cancer, a very close friend to cancer and either the day of or the day before the VIS, the young son of another close friend was killed in a car accident.

    It seems like this family is getting hit from all sides and it’s never going to end for them. I just wish I could make it all better for them somehow as I know everyone else here wishes as well.

      They have been dealt far more than anyone should ever have to bear…

  99. 05/19/2013 at 2:49 pm

    OK.. now just to further this to a logical perspective…. let’s look at the “mitigating circumstances” the defense team managed to conjure.. and seriously.. if this is the best they can do it’s a pretty bad state of affairs for the Jodistein.

    Everyone else feel free to chip in.. I just did this mainly for FOL and her butterflies so it’s straight off the cuff.

    “Mitigating Circumstances”

    1. Defendant was 27 years old at the time of the offence.

    I have no idea the relevance of this. Can someone explain it?

    2. Defendant has no prior criminal history.

    Even if this isn’t only because she never actually got charged for it.. (and likely most if not all the jury believe she committed burglary and theft to get the .25mm) I think jumping to murdering someone in cold blood precludes the lack of prior ‘criminal’ history.

    3. Defendant was a good friend.

    To whom She said Travis was her best friend. He was the kindest person she had ever known. So if that’s being a good friend I think this point is moot.

    4. Defendant lacked support from her family.

    Seems to me the family tried to help her. She didn’t want help because Jodi always knows best. How can you support someone who won’t even concede they need support. Think her attorneys might know how this feels.. why did they try to extricate themselves from the case? Because she will not heed advice or support.

    5. Defendant suffered abuse and neglect as a child and as an adult.

    She said in the original 48 hours interview that she had an ideal childhood. Only when it suited her did she allege any abuse at all.

    6. Defendant tried to make the best of her life.

    There is no evidence of this. She even responded to questions on the stand about getting a job… she said their wasn’t any.. and Juan suggested she could have looked outside waitressing and she basically treated this as a foreign notion. So aside from ‘playing’ at PPL what had she done in anyway to improve herself beyond ‘moving up’ through targeting boyfriends with better social status’?

    7. Defendant consistently tried to improve herself.

    See above.

    8. She is a talented artist.

    Bundy was potentially a talented lawyer, Glen Rogers was a pretty good artist (better than her anyhow) Dahmer was a talented cartoonist.. the list is endless.

    Plus the only thing Jodistein is really talented in is lying.. and that’s not to say she makes up good lies.. just good at trying to present bad lies as fact.

      As to the age- there is a regulation guide to mitigating factors that’s used, one of the factors listed is age. IMO the DT did not formulate the list, SHE did. So the idgit, included her age.

Flores, one of the most patient men in the world!!!!

    • Kathy A.
      05/19/2013 at 4:25 pm

      As to her age being a mitigating factor, usually that’s for someone who is young and naive -maybe a teenager – at the time of the crime who may not have had the maturity and emotional development to fully comprehend what he or she was doing. As Juan pointed out, by the time JA was 27, she had had several boyfriends, had lived out of the home, wasn’t an 18 or 19 year old, and age should not be a mitigating factor. I agree – if this is the best they can do, it’s not a very strong argument. At least Bundy’s legal education was legitimate and Dahmer’s cartoons were his own…I’m surprised she hasn’t been hit with copyright infringement from the two advertisers whose work she traced and sold as her own.

    • Kristi
      05/19/2013 at 4:59 pm

      I so agree with you, Syntara and if its okay, I will rant a little as well!
      27. 47? 100? Who cares….she was old enough to know murder is wrong. No one bothers to cover up a truly accidental death or a real self defense killing.

      Jodi DOES have a history of criminal behavior, just no convictions. Multiple tire slashings, stalking, trespassing, growing pot.

      Good friend? Oh yes whenever I have a really great friend, the first thing I do is call their parents in the middle of the night and demand they get her help! Charles Manson had friends! As we know from the Manson family, its not difficult to convince a small group of lonely, disturbed drug addicts you are wonderful, even when you’re not! So Jodi convinced pothead, heroin addict Patty and Darryl Brewer that she isn’t the devil.

      Childhood: she said in the Fox interview that her mom was a saint. Many of us had less than perfect childhoods. So you go to counseling and work through it. You don’t kill people.

      I see zero evidence Jodi tried to better her life. PPL is a pyramid scheme, like Amway or any other multi level marketing organization. They will take anyone. It’s not like she was hired by a prestigious law firm! It doesn’t even sound like she was a decent waitress if she got fired so much. It appears Jodi was a couch surfing loser who traded sex for room and board unless she was with family.

      Talented artist……so is my Toshiba copy machine. Her “art” is only selling because of her notoriety due to her brutal murder of Travis.

      In my opinion, attempting to improve ones life would be pursuing therapy and treatment on your own, attending college, sticking with a job and moving up in a career, doing volunteer work (doing it in jail when you have nothing else to do doesn’t count).

      I think Jodi is a cold, calculating, narcissist. She views people as objects to be used for her pleasure and discarded when they no longer serve her. She takes no responsibility for her own behavior and feels entitled to everything she does. I thank God and Juan she is off the streets because I have no doubt she would kill again.

        I would have to say motivation, spare time on Jodi’s hands as there is not much to do during non trial days, as well as to show the jury she is trying to better her self.

    Which bit@h do you think we’ll see tomorrow? Do you think there’s any chance she will “cry” and beg for mercy?

    FOL… to be perfectly honest with you.. I don’t think she is a very good chameleon. I alluded to this some days ago.

    Oh don’t get me wrong.. she possess the nature.. I just think she is an epic failure at it. Take Bundy for instance.. he was far far better. He successfully played many many roles.

    Jodi.. her entire life up to jail… seems to have relied solely on one.. and her narcissism allowed her to believe that one was and always would be enough. Which is why she is so bad and portraying remorse or humility. She never bothered to learn how. Then when she needed to.. it was too late because you don’t find much of that in jail so she had nothing to mirror.

    This is what makes her so 2 dimensional. She never ever bothered to create a full rounded set of personas because she was such a spoilt brat who got away with shallow narcissistic affects.. she has only those to draw on.

    It’s actually part of what makes her so fascinating. Her narcissism is indeed her biggest achilles heel in so many ways. Let’s just take the big 3 in this case:

    1. She never needed a good cover story.. why? Because she is smarter than Einstein and was never going to be caught.

    2. She never needed to lawyer up in the interrogation stage. Why? Because she is so good at lying and manipulating she thought she could talk her way out of anything and nobody could give her better advise than she could give herself.

    3. She stuck to the ridiculous ninja story for ages. Why? Because if she told the story convincingly enough times to enough people, she’d deceive everyone because we are all fools to her.

Oh yeah, she IS so smaaaaart! Not.
      I’m in NO way defending her parents, because I abhor the way the Mom has behaved in court, etc- but, as a parent… I have NO idea what I would do if I had a child that was like HER!?! Raising her, and living with her must have been frightening and utterly exhausting!!!

        I am thankfully not in her parents’ shoes, but if her friends were calling Jodi’s mother and telling her she needed help, why wasn’t anything done? There are certain things a parent can do, starting with refusing to tolerate certain behaviors – and it’s why I don’t believe the wooden spoon story. If Sandi Arias beat those kids with a wooden spoon for misbehaving, what do you think she would have done when JA started kicking her? There are such thing as discipline, getting juvenile authorities involved, getting mental health professionals involved, etc. Her parents and her upbringing don’t seem horrible, her parents seem a bit ineffective, but then again, the other kids don’t seem to be as f**ed up as Jodi is. I just don’t get it when parents say there is nothing they can do about an out of control child, and I am a parent myself. I don’t think she has ever been held accountable for anything until now and she is in denial, still thinks she can talk her way out of it.

    • Kathy A.
      05/19/2013 at 7:15 pm

      I think it’s also what makes her so hated – just about everyone can see through her stories and lies and knows they are not very good (apparently with the exception of Darryl Brewer and Matt McCartney), yet she just continues to spew them because we are all inferior to her. Hell, Jodi, if you were going to create a fog defense, why not claim you took Ambien, the sleeping pill that has caused people to sleepwalk and do things they have absolutely no memory of the next day – not murder, but driving, shopping, conversations, things like that – you still would have been lying your ass off but it would have been a little more plausible. And the cops and everyone else are so below your intellect, we’ll believe anything.

      By the way, Ambien can have that effect. I didn’t really believe it until it was prescribed for me and one morning I got up and found some freshly baked peanut butter cookies in the kitchen. I said to my son “How nice! You baked cookies!” He looked at me like I’d lost my mind and said “No, YOU baked cookies.” “Yeah, right,” “You got up at 3:30 this morning and made cookies. You don’t remember?” To this day, I have absolutely no memory of getting up, assembling the ingredients, nothing. Freaked me out so I have never taken it since. 05/19/2013 at 9:17 pm

        MMD, yes honey of course I saw the VISs’. I wouldn’t have missed it for the world…..Just that I was glued to the tv cuz I had to tape it, and watch it when I got home….I was waiting for them to come back, when “all of a sudden” court was cancelled, yet again. I was furious!!! Like all of us were, I just couldn’t even comment…But yes, they both had me bawling big time!!! So sad……. I loved it when Steven said he didn’t want to look at his brothers’ murderer anymore!!! Priceless!!!!! 😎

  106. 05/19/2013 at 3:40 pm

    Okay, up from my nap. @MMD, yeah, I said 5 pages because I did pretty exhaustive research on Simpson’s football career, and when my previous two proof readers, ie, girlfriends reached the sports parts, their eyes would glaze over and reading was done. But I felt that to tell the story I had to tell all the story…

    @NY yes, historical non fiction.

    • 05/19/2013 at 3:51 pm

      I like you have included the sports side of it.. I wish it were AFL not NFL.. cos I don’t know anything about NFL.. but I like the background. Very impressed with your level of detail wondering how much you knew and how much you had to deliberately seek out in research?

      • 05/19/2013 at 4:06 pm

        Syn, I knew nothing. Zero. About foorball, or about Simpson’s role in it.

        wow.. then that’s even more impressive!

    ohh I have a question Ive been meaning to ask you sandboxers!!! You know when Stephen was giving his statement.. and there was a time he stopped.. and .looked at Juan.. and at first Juan didn’t seem to react.. then Juan got up and went over to Stephen’s podium and seemed to do something with the pens.. or I dont know what he did.

    Does anyone know what happened there???

    • 05/19/2013 at 4:21 pm

      Seemed to me like it was at the point he started reading Travis’s confimation. I thought Juan had it, for some reason.

      • 05/19/2013 at 4:22 pm

        hmm I didnt think Juan took anything up with him.. ok time to source it and have another look then. Thanks Bubbs

      i noticed the same thing too. i couldn’t figure it out. he didn’t bring anything up and he wasn’t at the projector for photos. he just went up to the lectern where stephen was, fiddled with something up there and sat back down.

      dr. drew did note that there were other photos submitted with vis but they weren’t shown and i didn’t catch the portion of the show that did show them so don’t know why they weren’t shown in court.

  116. 05/19/2013 at 4:39 pm

    ok its croakerqueen Jodi Arias penalty phase- Day 1 -Part 2 (impact statements) around 9:39 right after he talks about having to go to Travis’ grave site to talk to him. If anyone wants to take a look and give an idea of what they think happens here.

    • HJ Madison
      05/19/2013 at 4:44 pm

      The family had asked to display a photo of Travis’ head stone. Of course, it was denied. Things got going and JM did not have a chance to let the famly know about restrictions prior to the statments. When Steven got to that point he pauses, waiting for JM. JM went up and gave direction to Steven to continue on without the photo.

      • MMD
        05/19/2013 at 4:47 pm

        That makes sense because they showed the picture on Dr. Drew when Sky Hughes was on and showed pictures that were not allowed to be shown.

      • 05/19/2013 at 4:52 pm

        ahhh that makes sense.. I thought it might have been something like that.. as if he was expecting a photo of Travis’ grave. Thank you how did you find that out?

    • MMD
      05/19/2013 at 4:45 pm

    Lisa M :
    Because if she said, Travis, lets use your new camera, lets break in your new camera he’d be more likely to take the photos and it would seem less like stalking behavior? He already didn’t trust her so if she used her own camera he might get a feeling he was being set up. She also would have said, you can delete any photos you don’t want, so it would have given him a false sense of control over the situation.

    I remember that the witness rebuttal about the camera answered a juror’s question something like – there were 90 other photos on his camera – Jodi only deleted her pictures. So I am thinking the camera wasn’t all that new. Wasn’t out of HER mouth that we believe the camera was so new???

    • 05/19/2013 at 5:11 pm

      think it was fairly new… because thats why its strap was still in the plastic bag brand new. I believe she actually helped him choose it probably finding it over the net. Which I find particularly ironic considering what it survived.

In this day and age, why even bother if you’re going to be the less than handful of people who would stake your reputation for Stabby to try to hide and have any form of privacy on such a globally followed case?

Since she has already dismissed this jury as useless for not believing her, I wonder if she will live up to her reputation as WoBo or keep it short. • MMD
        05/19/2013 at 5:54 pm

    • HJ Madison
      05/19/2013 at 5:27 pm

      DT will present witnesses. They will be sworn, Nurmi will ask lots of leading questions. Juan will cross examine, if he wants. The one thing I do not know is jury questions?? Will they be allowed?? THAT will be interesting! We know Patti and darryl are scheduled. We don’t know about mom. And, we don’t know if Jodi will take the stand, as a witness. Then, Juan can present any rebuttal witnesses. We don’t think there are any, but that could change. DT gives a closing, JM gives a closing. DT gets to give final closing. Jodi, if she does a statement and not as a witness, should speak at a podium in front of the jury, before closings … but that too is a bit unclear. The way the rule reads, Jodi could be the very last one speak, after closings are finished.

        Hi HJ- do you know if there was a ruling on the motion filed by the defense to preclude a State’s witness, siting inadequate notice? I have wondered if that was the reason court was canceled? Maybe Juan was pushing for his witness to be allowed to testify, and the defense was granted more time for discovery?

    • Family of Law
      05/19/2013 at 5:27 pm

      “Normal” procedure would be to continue mitigation with the 2 Defense witnesses, then cross from Juan. Then the Defense. Then, IF wobo takes the podium (or stand) she can blather on as loooooong as she chooses. Then….. The heat is back Juan! But this unpredictable crazy trial’s shenanigans …. Who knows! Maybe JA will have her own “Neuticles” tomorrow! Stand up and CONFESS, then BEG for death! LOL!

      Nevertheless, the Alexanders would not have addressed her. Their role was to tell the jury about the impact the loss has had on them and their family. ( Though, shades of Dahmer, I would have enjoyed one of them screaming at her “…. mother fuccer!”

    Have looked all over and found nothing! And who do you suppose it is that would not have already been on a witness list? I think the delay came because the f’ugly one is saying she is going to ask for the DP. The DT went nuts and told the judge they needed more time with her — they want to be prepared for whatever she is going to say. Nurmi visited her in jail on Friday. Plus, there was lots of bullshittery about what Patti would be allowed to say and what JM would be allowed to cross on. IMO

      HJ, I looked at the Maricopa county court minutes, and found nothing. Initially I wondered if the State wanted to call Travis’s Bishop? The Hughes? But none of them seem likely. Yes, it was probably JA spitting a fit about her wish for the DP! I saw the vid of Wurm leaving the jail on Friday, he walked as fast as the surprisingly nimble Arais Gramma! The Patti not wanting to be a camera was an issue too (odd that neither Darryl or Patti want their faces shown, when they’re all over the Internet and TV!)

    Ya know, I can relate to Travis’s weakness for, sex. Also in his wanting to believe in the good in people.

    I recently dated a gal. The warning signs were there from the beginning. But I wanted to believe that it was just upbringing, and that there was good there…It took a long time, and many, many, many betrayals for me to get it through MY thick skull. I found out that if a girl calls 911, behind your back, for no reason, then says you hit her, you’re going down. And it doesn’t matter what you say. That after raiding my bank accounts, hacking my faceook, selling my belongings, throwing away my belongings, giving my belongings away, etc, etc. But I blame myself; my own insecurities for tolerating it.

      There are good women out there, you’re just probably attracting or attracted to the same type over and over again, a habit you need to break, FAST!!!

      FOL, you piqued my curiosity! I have access to some public record sources and here is what I found about the siblings. Big sister Julie lives with husband Eric Zamarron in Hollister CA and they have a 3 year old child. Sister Angela and brother Carl still live with parents in a 1300 sq foot house in Yreka. Looks like other brother Joey rents an apt in Yreka. The Arias parents own the home but it doesn’t look like they have much equity. Remember when the dad said in interrogation that Jodi was always calling mom for money? I bet they really couldn’t afford to give it. Looks like these folks are pretty low income.

    I was not able to find model jury instructions in AZ (same for many states in this phase of the trial).At least from the documents I have found on line. LWOP is not statutorily mandated. Az statute 13-703.-01 (A) If the state is seeking death, then there is the first question as whether the Defendant will be sentenced to death.

    If the jury says no to death then the jury must decide between LWOP or life (25 years if the murdered person was 15 yrs or older and 35 years if the murdered person was under the age of 15 – this includes the unborn.)

    In the penalty phase of a capital trial a jury’s feeling about a defendant is just as important as the logical weighing of aggravators versus mitigators. In this phase, rather than attacking the State’s presentation, def. counsel focuses on showing the jurors that despite the conviction; the defendant does not deserve to die.

    Following penalty phase presentations, the judge instructs jurors on the law regarding determination of punishment. The only verdicts possible are life in prison without the possibility of probation or parole or life (25 yrs) or death. Jury instructions are given before or after the closing statements, depending on procedures where the trial is being held. The State and Defense are allotted equal amounts of time for closing statements, with the State having the final word in most states. Following closing statements, the jury receives instructions and deliberations begin.

    05/19/2013 at 8:03 pm

    Death Penalty Mitigation Statutes Arizona
    Code Section 13-701E
    For the purpose of determining the sentence pursuant to subsection C of this section, the court shall
    consider the following mitigating circumstances:
    1. The age of the defendant.
    2. The defendant’s capacity to appreciate the wrongfulness of the defendant’s conduct or to conform
    the defendant’s conduct to the requirements of law was significantly impaired, but not so impaired as
    to constitute a defense to prosecution.
    3. The defendant was under unusual or substantial duress, although not to a degree that would consti

    tute a defense to prosecution.
    4. The degree of the defendant’s participation in the crime was minor, although not so minor as to
    constitute a defense to prosecution.
    5. During or immediately following the commission of the offense, the defendant complied with all
    duties imposed under sections 28-661, 28-662 and 28-663.

      Good info Nancy! I am sure that age of the defendant means very young, as in a ten year old lacking the presence of mind to process other alternatives in a stressful situation. Hmmm, doesn’t mention artistic ability! Or if the person has friends. Obviously, the real lawyers are being ignored and Jodi is acting out her Perry Mason fantasy. No wonder they want out.

    Doing a hurried drive thru. Been amusing myself in the sandbox, scoopin’ and shovelin’ my way through your whimsical afternoon comments (FOL, MMD, Syn, Bubbles). Ya’ll have mastered the art of sandboxing! I’m being schooled by the very BEST!

    Had college graduation party … shopped for more garden plants … drove son to work … watched buckets of rainfall and lightening with 2 scaredy cats curled up against my leg … going back & forth between loads of laundry … catching up on a few neglected domestic chores.

    Janna must get home in order so she can watch more trial action tomorrow and play in the sandbox.

    Still trying to wrap my head around the “mitigating” factors presented by Arias Defense. Their list of 8 don’t make any sense to me. The jury is assigned to look at these 8 “redeemable” qualities and determine if any would merit leniency in sentencing. Is that right?

    #2 LACK OF CRIMINAL HISTORY —
    Isn’t Wobo wearing a stun-belt because of her negative jail behaviors?

    Syn, I knew nothing. Zero. About foorball, or about Simpson’s role in it.

    Bubble, I could have filled you in BIG time on his football career!!! I watched it since I was very young! Especially him! I didn’t care for him when he played though….Something about him just wasn’t right!! Then I saw the whole ordeal with his ex and Ron, and I didn’t like him MORE!

    Also, Janna, this place, this sandbox, is a place without judgement or meaness. These people I’ve never met I consider my friends, and supporters. It is really quite an amazing thing. And if there is one unifying factor amongst us all, it is Travis Alexander, and his memory…I think he would be proud. I am humbled by his legacy…

    Questions about #2 Mitigating Factor: Lack of criminal history.

    Isn’t Wobo wearing a stun-belt due to behavior problems in jail?

    When she was trying to sneak out those coded messages via magazine, wouldn’t that qualify as witness tampering?

    • HJ Madison
      05/19/2013 at 10:33 pm

      Janna: Jodi is wearing the “stun-belt” in court because she is charged (and now convicted) of a capital offense. Just as she wears civil clothes, her shackles are replaced with the belt so as not to influence the jury. We don’t know who the messages were directed to. We can speculate, but can not know with certainty. Furthermore, witness tampering is the least of Jodi’s worries right now. Had she not been convicted of any crime, maybe…..

        05/19/2013 at 11:51 pm

        Thanks HJ. I thought she’d been wearing the stun belt several weeks prior to conviction?? Wasn’t it Matt McCartney who she was smuggling the message to??

    Family of Law :
    Amen Nancy! I’ve ranted endlessly about this… I wrote an entire diatribe some weeks back. I will never understand her complaining about Travis’s family wearing ribbons! And
    when she was told that the judge would not agree to have them remove them, she pulled the ultimate nasty sophomoric stunt, by appearing the very next day with her own ribbons!!!!
Does this tie back to juror #5′s removal? Or something else?

    Apparently, on January 15th Jodi’s mom tried to have jurors thrown out. Start on page 3! And this was not the only time. Another time the Judge received an anonymous call about Juror # 15 – I forget the content of that complaint – it’s in the minutes somewhere also. I’ve always wondered if it wasn’t Donoman – it’s perfect for her m.o.

    NancyB :

    Nancy: Lest there be be any confusion, the only sentancing options which now remain are Death or LWOP. Jodi was convicted of 1st degree pursuant to 13-1105, Sub A, Para 1. She was older than 18 when the crime was committed. Therefore she is only eligible for Death or LWOP

    13-752. Sentences of death, life imprisonment or natural life; imposition; sentencing proceedings; definitions
    (L12, ch 207, sec. 4. Condtionally Eff.)
    A. If the state has filed a notice of intent to seek the death penalty and the defendant is convicted of first degree murder, the trier of fact at the sentencing proceeding shall determine whether to impose a sentence of death in accordance with the procedures provided in this section. If the trier of fact determines that a sentence of death is not appropriate, or if the state has not filed a notice of intent to seek the death penalty, and the defendant is convicted of first degree murder pursuant to section 13-1105, subsection A, paragraph 1 or 3 and was at least eighteen years of age at the time of the commission of the offense, the court shall impose a sentence of natural life. If the defendant was under eighteen years of age at the time of the commission of the offense or if the defendant is convicted of first degree murder pursuant to section 13-1105, subsection A, paragraph 2, the court shall determine whether to impose a sentence of life or natural life.

      Hey chef, put it in the warmer…The folks posting here these past few days are friends who enjoy the fellowship of other like, or not, minded folks. There is no trial to comment on, and many, like me, usually go into hibernation when there is no Jodi Drama. However, we on this site have gotten to know each other pretty well these past few months and we are a pretty tolerant bunch. We respect each others opinions, whether we agree with them or not,,,This is a worldwide site, and people sleep now and again.

      I say welcome Italianchef, your superior brain is needed. But if you’re gonna be a dickhead then move along. Try Jodiariasisinnocent
