    If ever anyone deserved the death penalty it is this little manipulative slut. I hope the next go round which should be over by the end of July and prayerfully she will die! They should put it on pay per view and THAT will reimburse the state of Arizona and then some! I WOULD like to know how the jury came down which is a requiste in almost every state but not Az the crazy state.

      Over by the end of July? I hope that is true but it seems they wouldn’t even be done with jury selection by then. Sadly.

      OMFG! My heart breaks for them and YOU as well Donchais. You have much invested in this trial as well. I can’t thank you enough for this forum as heart wrenching as it became today. After the “verdict” came down, I was so stunned that I literally shook with emotion. I’m way beyond heartbroken for the Alexander family and what they have to continue to go through in the coming days.

      The only thing that brings me some semblance of peace at the moment is that JA stands CONVICTED of 1st degree Premeditated Murder AND that this jury did find extreme cruelty.

      Thank you from the bottom of my heart for bringing a great group of people together who can share in the sorrow we all certainly feel.

      I wish you much Peace in the coming days.

      BTW – That incredible video of Travis was posted on the previous thread by Chrissie A. I have no idea where she finds this great stuff, but as always, she comes up with true gems at the most appropriate times.

      Sadly, they have to continue to deal with the Jodi drama no matter what the verdict. My hope for them is that they excise Jodi from destroying their lives any more than she has, so that she doesn’t score another victory she believes she scored in killing Travis.

      Donchais, all I can think is, if we are this upset… They must be inconsolable. The look of pain and shock on Travis’s siblings, was beyond devastating.

    Instead of focusing on this aspect of the trial we really all should remember the most important part… She IS guilty of 1st degree murder! More so than today, I was a nervous wreck during that part of the trial, so afraid that somehow the jury would get it wrong and find her guilty on a lesser charge. When that verdict was read I was elated. That was justice for Travis. I do feel for the family, this needs to end, but ultimately, justice has been served. Sometimes we feel someone doesn’t get what they deserve but I truly think she will. Lets be glad they didn’t hang on the actual charge!!!

        IF the next jury ends up being hung– or even all agree to not give her the DP– and IF the judge then sentences her to less than LWOP (i.e. ELIGIBLE for parole after 25 yrs–which would be 20 since she has already served 5), one can only hope that Travis’ family can help each other to come to an even stronger resolve to be there at each and every parole hearing to let the parole board hear their well-placed objections to her being granted parole. IF they do that.. there is no way she will get a vote for parole, no matter what she does while serving time up to that point.
        I have no doubt that the ALEXANDER siblings will travel to AZ to make certain that Jodi is kept in prison. (This may sound petty, but… –as they say, PAYBACK is a BITCH.)
        They may, in time, even come to see a sentence which provides them an opportunity to ensure that she remains in a PUNISHED position as somewhat cathartic, and dare I hope, even enjoyable, when they see her great big hopes DASHED, again and again and again (after they get over the initial–and very understandable–hurt).
        That being said… one never knows. The next jury could send her to death row without blinking an eye.

        Time is not on Jodi’s side–no matter how the next jury the next jury sees it.

        I, for one, am thankful that this jury UNANIMOUSLY convicted her of PREMEDITATED MURDER.
        THAT is, by far, the most legally significant finding that they could ave made.

        My heart goes out to Travis’ family.
        But I hope they will be surrounded by people who will help them to process this and se the larger picture, which is that his convicted defendant is going to be doomed, no matter what the sentence, because even if she gets the possibility of parole in 2 decades from now, THEY WILL BE THERE to make sure she stays behind prison walls.

        Hi WIS, I feel better after hearing from you. Yes, I too love the thought of JA feeling like she IS winning, only to have the Alexanders unite and fight to keep her locked away. Payback IS a bitch. But I do feel so badly that they did not get the Justice they prayed for today.

        What do you see happening now? I imagine that the DT will fight hard to manipulate this, what’s the worst they could do? I wonder how long it will take to go through voir dire with a new jury? They’ll have a hard time finding people with no bias- this trial has been all over the Internet and TV, not to mention JA’s little media blitz!

      I’m with you, Debra. We shouldn’t forget that. It’s the most important thing, and I really believe that there’s no chance in hell she’ll ever get out of prison, no matter what people are afraid of, there’s just no way she isn’t going to get LWOP at the very least IMHO.

    THANK YOU “MOM!” I think we r all having that “can’t wrap my head around it” feeling! I thank u for such a grand sandbox you have created for us! All the peeps are incredible & you are just true blue of a leader for justice! I bow my head to you, & look forward to continue going to THE University of Donchais (& helpers of course) may you & all my fellow playmates try & get some much needed rest. At LEAST we know she has been found guilty of 1st degee murder, & that’s a big milestone! But the Alexander’s still need our support no matter what!! All of us will not let them down!! Ok, no more rambling! Get some rest! We need you!!

    That was very moving! Travis is definitely an angel in heaven. And he was a Leo. Of course he was, that makes sense. He was a lion, a big achiever with big hopes and dreams and a big heart.

      Yes! And the family. They very well could have agreed to settle a long time ago for the lesser charge. It’s been a long time but by God, she was convicted of 1st degree!!! And have no doubt that we all probably would not know her name (not a bad thing!) but she would have taken that plea, gone to the press as a victim and still spewed all the lies she has told (even though she says she wouldn’t have). AND in a few years would be dating your brother, my son, our friend, whatever as a victim, who plead guilty to save the Alexander family from the pain of a trial. Her killing Travis turned out as she planned but nothing else has. The world knows what she is now.

    I have (yet) another question. (Sorry.) Why can’t she be transferred to the Perryville prison? Why must she remain in Maricopa Jail? She was convicted, that part is not in dispute, and from what I gather, whether she had received Life or Death she would be going to the same facility. Why can’t she wait there? She shouldn’t be in Maricopa anymore because she is convicted, no?

    Bubble–I think your contacting the Sherrif’s Office was the reason she can’t do more interviews. I hope your dental work turned out all right..You are probally in La- La land after that.. I am happy she is sitting in a little jail cell for 23 hrs a day..no tv- no nothing….LWOP or DP..Either way she will be just a bad memory.. The Alexander’s have their strong Faith to get them through this..Can anyone tell me if the same Judge will preside over the next trail??? Did anyone see the age enhanced phto of Jodi?? An old Hag—The bloom is off the rose..

      Yes Im sure he is agonizing about it. I just have one question for u Donchais: I’ve asked this several times on this blog but to my knowledge never received a response. Could Juan have used Jodi’s post verdict interview in his closing for the penalty phase? During her allocution she said she only trashed Travis during the trial, but she trashed him again during that interview! Couldn’t Juan have played that for the jury to show she was lying to them again?

        I heard Donovan on NG… yes, I take the hit and watch HLN for those few nuggets they have to offer.

        When Nancy asked Donovan about how the family was doing, she was annoyed and said that they were in town and the only message they got was that there was a question! I’m assuming, based on the last question when they didn’t show up, that it wasn’t worth the trouble to go to court.

        Too bad, not so sad. The family didn’t show because they didn’t think there was a verdict!

    NG had a phone interview with Donavan tonight who was complaining about the treatment or something about Jodi’s family and them not being there for the” verdict”..She started complaing and NG ripped her a new one

    I don’t know exactly how the retrial of the penalty phase will go with a new jury. But I would hope that it would go something like this —
    – JM quickly gives the summary of the case, including Jodi’s lies on the stand, which resulted in 12 people quickly pronouncing her Guilty of First Degree Premeditated Murder
    – JM then goes through in detail the crime scene photos and ME’s testimony that resulted in 12 people very quickly finding Extreme Cruelty as an Aggravating Factor
    – JM then shows the jury the media interviews where JA gave numerous false stories, including her “Mark My Words” statement, her chipper interview 20 minutes after the Guilty verdict where she still trashed the victim, and her latest round of glamour shot smiling interviews while the jury was deliberating her life or death — showing the other face of JA. Making the clear point that whatever subdued, frumpy JA that shows up for her allocution to them will only be another lie and they should not be fooled.
    – JM then is prepared to rebut things JA may say, like that she donated to Locks of Love 3 times while incarcerated, which was probably a lie considering she has never been shown to have short hair in jail. Again showing she has lied throughout and is lying now to the jury.
    – JM walks the jury through the simple path of her mitigation factors not being substantial enough compared to the cruelty, and without having any kind of “bond” built with JA, these 12 new people can vote for the DP.

    I took a couple of hours to think on all that has occurred. I needed the time as the jury sent a shock thru me. Here are my thoughts unpopular tho they may be:
    The jury convicted her of M1
    The jury said there was special circumstances (or whatever AZ calls it)
    The jury could not agree on the death penalty.
    While the PROS can (and say they will) enpanel another jury to determine penalty, I really think that they would be better presenting ‘the princess (from hell)’ with and offer of LWOP.
    I know it is not what is wanted by the family, however, if she would take it AND sign off on no further appeals, it would probably allow healing to begin.
    The problem is: would she take it? Truthfully, were I her (perish the thought), I would not. I would tell the state to try me again. As I see it, she has little to lose.
    Even if she were to get the DP…….it is being written off the books state after state. (Remember, even though Manson was given the DP there was that little ‘input’ from the Supremes which caused all those death penalties in Calif to be turned into Life sentences)
    How much do we really hear from Manson? How about OJ? (and he didn’t even get life)
    Would I wish that with the ‘life’ sentence she would be subject to the same restrictions as DP?
    Sure, but either way, it will not be easy or pretty for JA.
    Out of sight/out of mind….SHUT HER UP! No attention will be the worst punishment for her.
    Travis’s family deserve peace. Unfortunately, nothing that happens to JA will give them that. Peace is something they will have to find for themselves. They can be proud that they stood up for the brother they love. They can be proud that they held together as a family. They will find peace…….JA, no matter her circumstances, never will.

      Very well said. Yes, Travis’s family needs to find their peace, and needs to rid themselves of the horror that is Jodi, they can’t let her own their lives like she did to Travis. Otherwise she gets multiple kills for the price of 1, for which she most likely relishes in private.

    I agree with everyone who points out that the really important verdict of First Degree Premeditated Murder was won. If, in the new trial, the jury does not vote for death, but Life, then the judge needs to decide between Life or Life w/o Parole, right? If she is separated from the general population so she can’t have her sexual partners and her fan club, I will be very OK with that. In fact, at this point, I might even be willing to accept a negotiated plea of LWOP so that she would not have another crack at the world stage to spew her venom over and over again, and so that the Alexanders would not have to see her, or the pictures, or hear the horrible testimony again. The important part to me is that she NOT BE IN THE GENERAL POPULATION to do all of those fake projects she bamboozled this jury with!

    My thoughts and prayers are with the Alexander Family tonight. My heart just breaks for them. Juan fought hard for this family and I am keeping him in my thoughts as well as Det. Flores and all those who have worked so hard to bring Travis justice. And although unpopular as it may be – the Jury too. They spent 1/2 of a year working to bring a total stranger justice – and they brought us so far. I believe they tried their best and are also disappointed they could not bring a verdict.

    To donchais : I’m sorry. You have invested so very much into this case.
    To everyone here: My heart aches with you and for you.

Sure wish they would transfer IJA out to the Perryman prison now in max close security, and lockdown on any further interviews. Hopefully these matters are within HHSS’ jurisdiction.     The problem that I have is that I truly do NOT believe that they followed the law. What mitigator weighed more then the especially cruel aggravator that all 12 of them had already agreed on??? Book club? Selling T-shirts? Donating hair?? Teaching ASL -sign language??? Teaching espanol? Her families feelings? A recycling program? Come on.

    I wonder what these 4 may think and how they may feel when they see the AZ Central video from 2 days ago with the former guard from Perryville who said that the prison already has each and every one of those programs that SHE was going to introduce for the inmates?

    What mitigation factor was of greater weight then the especially cruel aggravator??? ZIP. Which means they based their decision on some emotional and/or ethereal basis which is such a disappointment that their allegiance to rational thought and adherence to the law were so easily discarded in less than one hour.

      I agree, they couldn’t have understood the “math”. There was NO mitigating factor that outweighed the aggrevation factors. When the verdicts came in 1st degree murder, premeditated / felony and then they found it especially cruel and heinous, I was certain they would at the very least, agree unanimously LWOP. The 4 holdouts were most likely swayed by her age, or her family. The other possibility, a very real possibility is that 4 jurors saw a “mentally ill” woman, and didn’t want to put her to death.

      Wow!! Thanks for sharing this video. I will make sure the rest of our little circle sees this tomorrow! I think it will help them feel a little better. They were so blown away today and the stress was just too much for all of us so we checked out early. LWOP or DP, this pig will be dead one way or the other! This beast will not make it in prison! One of the woman in our circle has a son who did time many years ago (but thankfully turned his life around when he got out!) and she called him today in tears because of the non-verdict decision. Based on his experiences in prison he told us that this “bitch” (JA) (his words!) has no idea what’s in store for her when she gets to the prison facility! He said exactly what was outlined in the video and then some! She will be in a place where the most hard core women lifers are kept and if she thinks she’s going to walk in there with that cockey attitude of hers, they will get to her one way or the other and show her who is in charge!! They will take her down in a heartbeat and make it look like an accident. She WILL get hers eventually because it’s no picnic and she’ll loose that smirk almost immediately. He told us to have faith in Juan because today was not a failure on his part….he now has more ammunition because that fool brought the media to herself so trying to claim a mistrial will be fruitless…he can now use her own words to put her away for good!

      I have to add it was heartbreaking to see the Alexander family and these ol hens just couldn’t take it anymore. We all felt their pain, and we’re going to hang in there and see this thing through with you all. HANG ON ALEXANDERS…IT AIN’T OVER TIL THE FAT LADY SINGS!!

      WE LOVE YOU TRAVIS AND FAMILY!

      OMG I needed this vid and it goes hand in hand with what HJ posted the other day!

      No wonder she was crying maybe someone in jail told her a few home truths after her powerpoint fantasy the day before!! She only cries for herself so it would make sense. Maybe we saw the reaction it was gonna be no matter what the verdict.

        She should be very happy she will most likely be spending the summer where she is now because from this video and from what others have posted sounds like Perryville is hell on earth in more ways that one. I can’t believe a woman prisoner actually died there from the elements. That’s insane!

      Thanks so much. I was so upset about the hung jury that I could hardly sleep last night. I hope the Alexander family sees this video so they will understand that despite the delay, JA getting the Guilty verdict on 1st Degree Murder will ensure that the rest of her life will be a nightmare, if she survives the first year. Seeking such attention as she does, isolation and being treated like the dirt she is will be the best punishment for her, whether on death row or in maximum security for life. BTW – even if she got the least harsh penalty — life — I don’t think she would survive the 20-25 years among that population because of her arrogance.

    Jury foreman on GMA this morning. He didnt believe self defense but did believe that Travis mentally abused her. Its unfathomable to me that anyone could have found Laviolette to have any credibility, but I guess he did. I didn’t comment after the verdict yesterday because I was speechless and devastated for the family that this will continue to drag on for them. Everyone here pretty much summed up what I was feeling. I will say this though, I do not believe she will ever get death. I absolutely do believe that some of those jurors went into this knowing they would never send anyone to their death. I know they said it was a death qualified jury but I don’t believe it was.

      I agree about her never getting DP. Even if people indicate they can give it during jury selection, I think they view that is appropriate for serial killers and if they think she has any mitigating factors, including borderline personality disorder, they can’t go for death. I think, if we see a new jury, they will be presented with different mitigating factors — heavy on the mental issues.

    This really does slay me. My heart broke for the family, but I was happy that at least some jurors stuck to the do. They held their ground for the Alexander family. There is some peace in that. I hate that they have to go through this again and it can take so long….

    BUT HERE IS WHAT I REALLY HATE:
    I HATE that the jury foreman bought into the lie that Travis was mentally abusive. I HATE that when Jodi inevitably finds out that information she will get such pleasure knowing that she convinced someone Travis was a bad person. I HATE that she will run with that information in the next sentencing phase and SCREAM about the mental abuse. But I HATE even more that the Alexander family will feel that jodi won that small victory, and part of Travis’ memory is tarnished by a juror who BELIEVED ARIAS!

    How is that even possible?

    Morning all. I certainly hope that the Alexanders and their friends were able to lean on and dig deep in their faith to get through last night and the nights to come.

    I know that I was absolutely stunned last night and I spent the night having nightmares and seeing the face of Travis Alexander with the ruler beside it on the autopsy table. That picture has always bothered me more than the slashed throat photo and I couldn’t shake it.

    I was pleased to see the video above about what JA can expect in Perryville. Nancy B said that there is no air conditioning there but I can’t believe that is true because that would affect all the workers there as well. They wouldn’t be able to get ANYONE to work there.

    I watched NG last night while still in shock, I know twice in a week when I NEVER watch her, and I love the way DonoMan tried to stand up for the Arias family and say that they had been there both days. Yeah right DonoMan, NG tore you a new one and we all know that you lie as well as JA. The Arias family was only there for show, because they were told to, when they were trying to impress the jury. I don’t think JA can expect any visits from them in prison, just sayin…………………………..

    Justice for Travis and for the Alexander family. You are truly in my prayers!!!

      Good news — JA sits in 23-hour day isolation until the retrial, and hopefully without any new media interviews. Bad news — Alexander’s have to keep their lives on hold even longer. Hopefully while JA gets a taste of what her future life will be out of the spotlight, Travis’s family can get some mental and physical rest and be ready to re-engage later in the year.

        You would think there isn’t a soul alive who doesn’t know about this case, but actually, a month ago the son of a friend, and his fiancé who both attend medical school in Phoenix, visited and I asked them about the case and they knew there was “some big case” going on but had not followed it at all. Last week, at a conference in San Francisco, at a dinner with 4 renowned psychiatrists from around the country, only 1 was really familiar and 2 knew nothing about it. Unbelievable to me because I have been living and breathing this trial, but there will be people in AZ who are not aware of it.

    Like all of you I am so confused as to what has taken place. I am greatfull for the fact that the jury found her guilty of 1st Degree Premeditated Murder. That cannot be taken back. However I scratch my head as to when the Jury found EXTEME CRUELTY… where did they think this trial was going? What decision did they think they would need to make next??? I really appreciate the jurors having strong convictions, however I can’t help but have an uneasy feeling because they came back so QUICKLY saying we cant do this!!?? 2 hours!! WTH! Why oh why would they allow this to end up as a mistrial. I believe that trying to convince someone to move up to DP would have been a lot harder than trying to get someone to move down to life. As sad as it would have been to have them settle for lesser (just my opinion that life is lesser sentence than the ultimate of death), would have been such a better option. I had such faith that this jury was gonna hit a home run. IMO I feel it was more than one person that was holding out, if it were only one they could have told the judge that person was not deliberating and possibly that person could have been replaced with an alternate. I know my thoughts written here are probably no different than what has been posted, I have not read what has already been posted, I just needed to express my thoughts. My heart breaks for the Alexanders. But what they need to try to hang on to is… Good things come to those that wait! Don’t ever lose hope that Justice will come for Travis!♥

        Thank you so much for that count. I had not heard that. I had to remove myself from the chatter after the verdict (or lack there of) just to emotionally vested after all these months just to be left with this horrible sinking feeling. For me, I think the pivotal moment for this last decision was the delay that the defense, once again was able to obtain, after the Alexanders statements. I wish they could have remembered Steven just pleading to let this be over, let me go home! God bless the Alexander’s. Please stay strong!

    Morning everyone! A sad day in Vegas. I’m so out of sorts and have chest pains and that horrible feeling in your heart that won’t leave. I want to remove the pain for the alexanders but I know I can’t.
    I’m going to reach out the only way I can and make another donation. I hope others will too. I want money to b the last thing they have to worry about when coming back for the retrial.
    My sweet 9 year old daughter is taking money from her savings account and making her own donation. We will both write cards to the family as well. I tried to shield her from this horror the best I could but I made the decision to tell her what happened months ago. She needs to know that there are monsters out there who look like regular people. I try hard to never let her see the tv while this has been on, but there’s been times that she’s walked in on me and seen parts. She is very sad about the family and wants justice for dear travis like all of us.
    Glad you guys r here because my sweet hubby just doesn’t get it like u guys. He’s sick and mad and sad about it, but doesn’t understand how I am so emotionally tied and how it’s with me 24/7. I have definitely neglected him and my daughter these past months and I’m going to try to use travis’ legacy to pull myself back up and really get back to my family.i just don’t know when or how. 😦

        Ty HJ! Yes, it is neat how she saw bits of the justice system. There were two times that she saw a shot she shouldn’t have. One was the bloody sink and that freaked her out. The other was poor travis’ sad looking face before he was killed in the shower. I hope she didn’t see more….I tried to b very aware when she was home from school, but at times she walked in the room on me and must’ve seen more…
        U r so right…I need to hug my honeys….but I just want to clam up and be alone. I have no drive at all….I can’t believe this has even happened…it seems impossible….poor family. I’m hoping that when I go write a check and letter to the family and get it mailed off, I will feel a little better. I know money isn’t the answer, but it is all I can offer them besides my prayers and support.i hope their donations keep coming in and by the retrial, they will not have to worry about that aspect.
        Someone said they r going to send their tax refund to them. I am going to talk to my husband and see if he will agree to do the same.

They completely believed she planned this … just like Syn said last night on the last page. And, if she had done this in Canada or Wisconsin we would be jumping up and down with glee knowing she is gone for good.

    Imagine MMD, all of us, if we could never have Haagen Daz again, or snuggle with our puppies, tease DP for living on some desolate rock. Imagine never getting to sleep in ever again, or wearing perfume, or taking a long hot shower …. all that is gone, gone, gone! That is when justice will be served …. really. BrightGirl said it and she is right! These are the things that she will never, ever experience again. And it will be torture for a girl like her.

Just cuz travis sent her a text telling her who he thought she was, that wasn’t abuse. He was right on in how he had her pegged.i love what he wrote. He was exactly right, too. He worded it perfectly in those texts. Unfortunately, him being on to who wobo truly was, led to his murder.she couldn’t live with the fact that someone called her on her psycho behavior.

I think wobo would rather b on lockdown 23 hrs than b around some of the girls in this pod/dorm. They would chew her up and spit her out. Maybe I don’t want her on lockdown anymore. I thought that was the best thing for her, but now id rather see her be harrassed and bullied by these girls.

    I think the part we are having difficulty with (apart from the ubiquitous smirk on her puss — how I’d love to smack it off her, but I digress) is her feeling like she is winning, whether real or imagined, and the fact that we want her to stop breathing the air we (humans) breathe.

    That is exactly what bugs me the most!!!!!!!!!!!!! Infuriates me. I realize I should just think of her as a box which is empty, but a box doesn’t cause the pain to the Alexander family or put them through what they have are continuing to go through!!!!!!!!!!!!!!     So how can foreman say JA was verbally abused. If he used the recorded conversation, nothing there. If the texts, then they could have all been at JA’s hands by her breaking into his accounts.       But the jury didn’t know that. There were 85,000 communications between them and all they knew about was one. And, really, without knowing the cirmcumstance behind that one …. those were pretty harsh words. The jury can’t speculate — even the Hughes said they don’t know what started it. And, there was never evidence that she tampered with actual text, just that she had access.

You have watched every minute of this fiasco, seen every hideous piece of evidence, listened to the endless, vicious lies put forth by the defendant, interpreted the ridiculous antics of a desperate defense team, educated everyone on the finer points of procedure, allowed each of us to rant and rave when our pain and outrage nearly overwhelmed us, and supported not only the family and friends of Travis Alexander, but us, the online community who have but one thing in common — you. When we averted our eyes or stopped listening because we were too offended to look or listen anymore, your dedication did not afford you that luxury.     After watching gma video, I am stunned that the some member of the jury believed she was emotionally and verbally abused – I figured the non-verdict was a struggle of life’s value vrs the crime .. again I seem to be wrong.

    IMO .. this is why they wanted so many men on the jury.. men tend to think of women (especially older men) as non-violent, vulnerable, emotional creatures. imo opinion they needed to find some type of justification as to why what ja did was so out-of-the-box from what they have been told and believed to be true their entire. Had the gender roles in the crimes been reversed , a girl called in a man names in anger , the man stalking, the women dating multiple men while having sex with the man, the man brutally killing the women — IMO there would have been no question.

    One of the news segments did mention that is is very difficult for a jury to render the dp for a female, particularly for men and they do try to stack the jury with as many men as possible for this reason. The last women to get the dp in az was 1930, and even though az juries have very high rate of dp convictions compared to other states there are still only 3 women in death row in az , compared to 122 men. I would like to believe that this is because women truly are less violent (sorry guys) but I think there is also a gender view bias that comes into play – at least a little. I know for a fact that there have been more than 4 brutal murders committed my women since 1930.

        Sure the institution has air conditioning. Just the ‘ranges’ don’t have it. Guards are (mostly) in air-conditioned (plexi-glass enclosed) areas from where they open/close cells + doors etc/

    More then likely there won’t be another penalty trial.

    It’s going to be settled next month when the judge and lawyers meet for the Status Conference on June 20th.

    Here’s the official statement released yesterday by Maricopa County Attorney Bill Montgomery, Martinez’s boss, in regard to the lack of unanimous decisions:

    “We appreciate the jury’s work in the guilt and aggravation phases of the trial and now we will assess, based upon available information, what the next steps will be. As of this point in time, the Court has set a Status Conference for June 20 and we will proceed with the intent to retry the penalty phase. Because, for purposes of a jury determination on punishment, this is still a pending matter, there will be no further comment.”

    The key words are ‘we will assess based upon available information, what the next steps will be.”

    They’re going to come out of that meeting with a Life Without Parole agreement. No more money spent. No more media annoyances. Back to work as usual for the court, the prosecutor, the public defenders office.

    The Bureaucracies will have spoken. No more State money spent on the media circus trial. Arias gets shoveled into to corrections system,where she belongs. The Big Wheel spins and spins, the Little Wheel turns around and around…

        I agree with you truejustice and my heart aches and I do mean aches for this family. They are now placed in the position of needing to integrate the immense agony of this mistrial and all that this represents for them.

        They were so close to finally being able to re-calibrate their individual family lives and begin the *enormous* challenge of beginning the grief process for all that they lost on June 4th 2008. Several family members publicly acknowledged in Jan 2013 that they have forestalled the grief work that’s mandatory for each of them to successfully move on from the astronomic loss of their beloved Travis.

        This was a necessary coping mechanism that was required so that they were capable of providing high level participation in the 5 yr legal process of holding JA accountable. This required ALL of their attention, focus and resources. They were so close to an acceptable finale that they could almost taste it, like all of us and now it’s been ripped away.

        Their *real* lives have been placed on hold and suspended. This long 5 year ordeal has required their on-going presence as a untied voice for Travis. The result has brought several of them to near financial ruin. Mortgages in jeopardy, marriages hanging in the balance and jobs on the line. The physical and mental health issues that have *directly* resulted from this tragedy is another major unresolved issue for some of them.

        I’m devastated that they are continually being victimized by this nasty outcome and that this evil murderer who relishes the media extravaganza’s that the county jail system and the courts have sanctioned. On camera she has been persistent and true to form. These interviews show no evidence of any remorse but instead her continued persistence in taking great delight in trashing Travis, the prosecutor and even this
        family. This family has demonstrated exquisite composure, resolve and grace. Travis, Mum-Mum and their flawed abusive but well loved parents would ALL be so very proud of them.

      Jodi has nothing to gain by agreeing to LWOP. If the judge says that is what she will get if a new jury does not choose death, then Jodi will ask for a new judge and will get one. I wish you were correct, just to put an end to this and move her to prison. But, she will NEVER agree. She loves the limelight too much!

Are you kidding me? I’m very surprised by that. Verbally, okay– I guess I can see if he wants to think that based on what the emails, phone recordings, whatever– as we know of course he was just reacting to her psychopathy, but physical abuse? No evidence! He believed her?!

    You would think there isn’t a soul alive who doesn’t know about this case, but actually, a month ago the son of a friend, and his fiancé who both attend medical school in Phoenix, visited and I asked them about the case and they knew there was “some big case” going on but had not followed it at all. Last week, at a conference in San Francisco, at a dinner with 4 renowned psychiatrists from around the country, only 1 was really familiar and 2 knew nothing about it. Unbelievable to me because I have been living and breathing this trial, but there will be people in AZ who are not aware of it.

    I agree , there will be. My mother didn’t know about it until I told her recently. Of course, we’re not in AZ, but I do think they will be able to find people who, if they know about it, haven’t been focusing on it.
    Not everyone watches HLN!

    Someone on here was talking about flying into Phoenix and as soon as they got off the plane they were asking anybody and everybody if there was a verdict yet, I think it was the guilt phase but not sure, and couldn’t find anyone who was even following the case. People have lives and a lot just really don’t give a damn about the latest court case.

    When my cleaning lady was here the other day she asked me if I knew about anything that was going on around here and I had to admit that I didn’t. I have been so engrossed with this trial that I have either been watching it, sleeping or on here. Haven’t read a newspaper or book for months. I’m sure that there are many people in the Phoenix area who are engrossed with other activities or have some friends like I do, who flatly refuse to watch the news because they feel it is too depressing. They can en-panel another jury no problem, imo.

      My eldest nephew (32) is a High school chemistry teacher in Phoenix. He has seen blurbs of the trial on the nightly news, and the newspaper headlines, but he knew next to nothing about the details. His lifestyle is such that he’s at his school from early in the morning, til late in the afternoon, and spends his free time climbing, biking etc- There must be others like him, highly educated, and too busy with their own jobs and lives to have had the time or inclination to be engrossed or have any bias.

      I do not agree that Juan (or his boss) will offer a LWOP plea deal. Juan is deeply devoted to giving Travis and the Alexanders justice- and the family has made it clear that they want the death penalty. So unless they Ut-urn and tell the State they are willing to settle, I do not see it happening. Quite frankly, even if Juan did something completely out of character, and backed down from the fight, I do NOT see JA signing. SHE wants another shot at the limelight, and have another go at her” lies and cries” – and wants to delay the inevitable for as long as possible.

      I think the issue in seating a jury will be a huge challenge , but not impossible if they follow the procedure they used for a local serial killer trial. They sat that jury using people who may have heard about the case , but did not follow it, or new little and said they could be impartial. But that was pre-trail , not post trial – and not as highly publicized as the Arias case.
      Here in AZ , Every tv station with a news segment has extensively followed the case – but there are the nationals too – cnn, hln, etc. Even the alternative newspapers have had extensive articles. Radio coverage has been a bit more limited but even then if you listen to the radio talk programs you’ve heard quite a lot of information. But I dont think that covers the full scope of difficulty… a jury is hard to seat anyway. A few weeks ago I had to do jury duty (not picked than goodness) and the group used for selection was 80 people. Not one had ever heard of the case. 35 people where dismissed just due to “inability to serve” – stay at home moms with young children, financial burdens (under 2 week trials only get 12 $ day) , carpool driver, teacher, obgyn, planned and paid for vacation schedule conflicts, college student, medical issue, transportation issue etc. One person said the prosecutor worked a case for a family friend, and one’s husband worked at the hospital where the victim was treated.
      While they questioned the remainder of us – there where prior victims of crime, people who had biases related issues in the case etc. — I personally knew of the judge since a good friend of SO was a judge . And there where a slew of other items they were questioning on to determine impartiality. And JA’s case will have to screen for people who are DP qualified, etc.

    comment then question…. after watching the foreman, I too was surprised. And I thought, well, everyone agreed she planned the murder hence the 1st degree verdict (thankfully) BUT, they really believed the abuse story and so justified the killing somewhat so couldn’t give her death. But then you have to realize that 8 voted for DP! so, either those 8 did not let their emotions get in the way and strictly went by the mitigation factors OR, they had emotions as well and flat out did NOT believe her! And possibly, the foreman being one against wouldn’t bend since he was the foreman? Normally it seems the foreman is part of the majority vote and if he was part of the 4 for life, possibly they wouldn’t deliberate any further because as the foreman he would not back down. Kind of a power trip.
    Question…. I know Jodi can prepare for the next phase and tweak her personality…. cry more, seem even more meek, be overly apologetic, whatever. Noone can control how she acts. But am i correct that as far as the testimony and evidence goes, the defense can’t change their tune? I mean, they can’t now claim she is borderline, or mental abuse rather than physical abuse, whatever. This isn’t a new trial. Is that right? BUT, Juan can introduce the interviews? thanks!!

The topic I was thinking of is: In all seriousness, what questions would you like to ask the jury? If we set a limit of 2 or 3 per person, I think it would be manageable. As an example, I was thinking:

    While I would like to say “Did you want to smack the shit out of WOBO for doodling in her precious notebooks all day everyday?”, I would like questions to be posed legitimately, such as “What was your reaction to the defendant constantly writing and drawing and erasing in her notebooks, while seemingly not paying attention to the proceedings?” or “What did you think when the defendant turned her back to the court and faced the wall rather than looking at the photographs of Travis with his throat slit wide open?”

    Would you like to take that on, too?

    I think it’s horrendous that the Foreman found it hard to wrap his head around what Jodi did because of her appearance!!! Absolutely despicable. People should NOT be measured by their gender, race or appearance!!! Why did her appearance even matter??? He was supposed to focus on her actions and presented evidence. Women are not saints – DON’T GET IT TWISTED. His small mindedness is offensively disturbing. Women have the “capacity” to be nurturing, doesn’t mean we use it. That’s why that douche bag Cathy Anthony got away with murdering her daughter (please forgive me, I’m angry…just turned on the television and heard some of HLN’s comments about the Foreman).

    His type of mindset and the mindset of others is what I’m supposed to rely on instead of exacting revenge when some lowlife tramples my life or humanity. I’m absolutely outraged. How do the innocent acquire justice if our panel of peers weigh matters so flimsily? What a disgusting catch 22 – damned if I exact my own revenge and damned if I rely on inexperienced peers.

    Not all of us think the same, and certainly not all members of a jury. I don’t fault people for who they are – experienced or not, we are who we are. It’s just that I feel put in a bind where I’m unable to adequately defend myself at times because I’m relying on peers and laws that leave me victimized. Shortsightedness, and/or indifference, sometimes blinds these individuals to the fact that I’m relying on them for help: to keep me a law abiding citizen, instead of retaliating in blind rage. To restore my faith and hope in humanity, and I can move on with a semblance of dignity and sanctity, feeling my peers and the judicial system have a vested interested in protecting innocent people from savagery.

    These are the struggles Travis, his family, and other victims are faced with. Participating in the judicial system in any capacity is not just a matter of doing civic duty. It’s purpose is keeping peace in our communities and protecting what is sacred – which for some of us is life, our families and freedom. Focusing on race, gender or appearance is insulting.

      The interviewed juror mentioned mental abuse as mitigation.
      Chances are the other three jurors believed that too.
      Therefor you should be blaming Martinez for not doing a better job dispelling that evidence, the jurors received filtered information, he needed to do a better job putting that tape and angry messages in context.

    I am very disappointed in what I heard from the jury foreman. They BELIEVED that Travis verbally and physically abused JA. They clearly bought into some of the LaLa and Dodgy bullshit. If they based this opinion of the texts and emails and sex tape, then they truly had no clue about JA’s manipulations- she turned Travis into the person that became sexually “course” and verbally aggressive. Did they not hear and see that the ONLY person he had this behavior with WAS JA? Also, he said that he couldn’t understand how someone with her slight build could do what she did? Well, SHE DID! Because she unleashed her savage, carnal EVIL! He must have been one of the FOUR.

    MMD — Of the 112 prisons in Texas, only 21 are fully air conditioned; with the exception of the psych and hospital units, the rest are not. However, the work areas ARE air conditioned, so the philosophy is, If you want to be in the AC, get a job! Texas requires everyone to work if they are physically able, and even death row inmates are sometimes eligible to work. I have always said Texas is the one place I wouldn’t want to break the law, because they would just as soon shoot you as look at you. In Texas, if you get the death penalty, you get death; they have the highest number of executions in the US. Now, I guess I’ll have to add Arizona to the list of places I don’t ant to get caught breaking the law.

    This is really cramping my style, having to be careful where I break the law!

    It is beyond despicable! In early April, I found that information and many more seriously criminally negligent incidents against inmates in that prison. I decided to post that link now since the rose colored glasses warden specifically mentions her.

    In the article I found in April there were *many* more important horrific details included in that poor soul’s death. It showed the outside cage and described her rattling the cage walls screaming for water and for help over and over for more than an hour until the time that she finally collapsed. Even when the incompetent staff finally *noticed* her (even though she supposedly was on every 10 minutes documentation d/t her problematic mental status), they waited hours prior to calling 911. Her collapse happened mid day and she wasn’t transported to the hospital until 7PM and then died at12:50AM. The link I found today has a very unflattering picture of her but in the article I found in April it showed another pic of her in orange prison outfit and she looked attractive. It also showed the ugly pic and described that she lost the front tooth in a fight with another inmate a few months prior to her death.

    I’ll admit, I was very disappointed with yesterday’s non-verdict. But after tossing and turning all night, lots of coffee and a little needed perspective, I think we should not lose sight of the most important thing. JA was found Guilty of 1st Degree Premeditated Murder with Extreme Cruelty! if she had received a 2nd degree verdict, I would be psychotic, but that’s not the case. No matter what happens next, at a minimum she spends the rest of her life in a hellhole, because I don’t see Judge Stephens giving her any less than LWOP. The DP is always hard to get and if we focus on that, we lose sight of the fact that Travis’s murderer was found Guilty and her life is OVER, whether dead or alive. Let’s all support the Alexander family, toast the hard work of JM, and not give that b*tch any of our emotional energy except our satisfaction that — Mark My Words — she did not get away with her evil deed.

      But if the state tries her again for the DP And theres another hung jury, doesn’t she automatically get life WITH the possibility of parole? That’s what I thought I read. So unless the next jury either votes for death or life she could get life but not LWOP. That’s the risk isn’t it?

Can’t believe that he found Travis “abusive”;; think he gave himself away with his comment about the “looks” of the defendant.Just another reason for professional jurors. This guy is probably retired, has granddaughters and just can’t see a “girl” being all that evil; it MUST have been caused by Travis. Shaking my head still.

    On Wednesday, the Arizona Supreme Court will decide if it will take jurisdiction over one of Nurmi’s appeals regarding the death penalty.

    Midway through the trial, Nurmi asked the high court to throw out the aggravating factor of cruelty because the judge had allowed it to go forward based on a different theory of how the murder occurred.

    The state had originally claimed that Arias first shot, then stabbed Alexander before slitting his throat; based on that theory, a Maricopa County Superior Court judge ruled there was probable cause to find the crime had been committed in an especially cruel manner, an aggravating factor under state law.

    Right before trial, prosecutor Martinez revealed his new theory that Arias had first stabbed, then slashed, then shot Alexander after he was already dead.

    Stephens, the current judge, allowed the aggravator to be considered nonetheless. The jury found that it applied.

    The Supreme Court could decline jurisdiction and say that it should be brought up in a regular appeal. Or it could set oral argument for this fall and in a long shot, throw out the death penalty.

      Bubble – great idea but I have bad news. Sadly I know this from personal experience. First, you have to get the address EXACTLY correct, including the inmate number. And you must include your full name and address on return (not even initials). Second, mail is opened and censored. I don’t want you getting in trouble. But she has been 4 years in that jail — no doubt some of her former pals will have moved on to Perryville and spread the good news about her.

        the website for Perryville has all the info you need (google the prison) they even let you do a prisoner lookup (complete with inmate numbers). Be careful with the censors,,,,but from what I understand, they just scan them for certain words/phrases. No time to go over line for line

    One thing I’m really fed-up with is the multitude of defense attorney/talking heads who are continually telling us about the “mob mentality” associated with this case. The inaccurate examples of “proof” that they use continue to be ALV & PP. The reaction of the public is *not* mob mentality and I’m sick of that fallacy being promoted through the media by JA’s defense team.

    I happened to see Richard Gabriel (who I can’t stand) on CNN this morning. He served as the jury consultant for Casey Anthony’s defense team. Gabriel told the interviewer that he was “confident that the defense in this case were looking for jurors who were strong and independent and able to resist the public pressure.” Hogwash. He’s such a insincere liar! They were looking for jurors who lacked the ability to tell the difference between good and crap science which includes the testimony of psychological experts. They wanted people who could not engage in probabilistic reasoning, and who lacked the intellectual strength to resist the defense’s obfuscatory tactics.

    Prosecutors work with both hands tied behind their backs, precluded from telling jurors the real facts in a case. Laws have been mangled into games to aid the guilty and the hijinks continue. Defense lawyers hide behind the rule that exempts them from moral responsibility and can say anything they want. Why is it that defense attorneys are not compelled to stick to facts, not whole cloth inventions to escape reality?

    It is one thing to defend the accused. Another, to aid and abet, when those same lawyers are in a position to know beyond a reasonable doubt which client is really a danger to society and should be separated from society. Defense lawyers should never be allowed to fabricate or invent absurd scenarios, as they often do, or allow their clients to do so. Society has an obligation to protect the innocent.

    To be a juror is a highly complicated skill, yet the system does not require people to have any legal education (or skill of any kind for that matter) in order to qualify. A complete idiot could determine the fate of an individual and that is perfectly fine as things now stand with the system. Also, I think that attorneys favor people ignorant of law as prospective jurors so as to more easily manipulate outcomes. The jurors’ absence of experience in thinking abstractly, understanding probability or reasoning from evidence rather than emotion, make them susceptible to specious arguments such as “Are you going to KILL this girl ?” And then repeatedly asking this over and over again.

    During voir dire defense atty’s seek to exclude people with college degrees, situational awareness, and especially military personnel for a purpose. Maricopa County arguably has one of the largest concentrations of retired professionals (doctors, lawyers, accountants, military officers) in the country and now that this trial is over it will be interesting to see how many of them made the jury. Often if you read the voir dire questions that are used and the peremptory dismissals you will see how the jury was stacked. I had hoped to do that at the end of this trial but I’m doubtful that much of anything will be released as so much has been sealed. Most secret trial I’ve ever watched.

    Having served years ago as a juror on a murder trial that also involved a rape and drugs, I can attest to the incredible stupidity displayed by my fellow “jurors”. Think: herding cats. The mind boggles just remembering. I look at it this way… PAY every juror a day rate equivalent to the judges pay. That would keep the smarter ones in the running. Stop tossing peanuts out for “your duty”. If it was all about duty then all the lawyers and judges should get jury pay and only jury pay for their time. Fair wouldn’t you say? You can be certain they’d squeal like pigs.

    This verdict acts to undermine our criminal justice system; when a verdict is not consistent with the *facts* presented during trial our criminal justice system suffers. I personally am offended when a hollow platitude is offered, such as “this is the system we have and we must respect the juror’s decisions.” I do NOT respect decisions that are arrived at with flawed logic, bias, and ignorance of the legal instructions. To me, that indicates a system problem that resulted in a mistaken and defective result.

      They did their job from their filtered perspective of the evidence presented, Nancy.
      If a third of the jury saw it differently then blame it on the prosecutor for not doing a better job explaining it.
      If only One or two jurors wouldn’t vote for death, insulting their logic or understanding has validity. But four of them came to the same conclusion.
      And those were the same four who oted for first degree murder – so their reasoning abilities must have been working OK then.

    Many criminal lawyers, that describe themselves as licensed attorneys [with the local State Bar] for hire as (what has been promoted as) Defense Counsel, have tried to mislead General Public AGAIN. They have been out in force to soothe the anger of the good people of this Nation, who feel the system has robbed them of justice. Yes, the system (infiltrated with those above the Law, calling themselves a class of lawyers) has robbed them personally, because General Public expects justice in America, no matter who has been accused or who has been named the victim. There is ALWAYS supposed to be Justice in the United States of America, because, unlike other Countries, this Country has a charter document and has a foundation upon which the several States have been able to build, which recognizes ALL PEOPLE ARE EQUAL, no matter the status at birth or the status when the crime occurred, that has made an individual either a victim or an accused.

    Certainly, it has to be acknowledged that in the several States of the United States there have been innocent people who have been falsely arrested, maliciously prosecuted, and wrongly convicted. As a matter of fact, there has been a large number who have suffered a fate worse than death. They were not only falsely accused, they were wrongly convicted of crimes that would leave in people’s minds a picture so foul, that it was believed these wrongly convicted were vicious rapist-murderers or were the type that would kill their own children or their own mother (for the benefits of a life insurance policy or other gain). There have been so many truly innocent people who have died under a [wrongful] conviction placing them into the electric chair or a gurney to have an injection of liquid death, that a group, known as the Innocence Project, formed to try to convince the Government of the several States that innocent men [and women] were being killed in the name of the State. This did not go over well with these States, that might have looked at their bottom line and might not have wanted to pay the (wrongly convicted) suffering person for all the time the State stole from him [or her] and what the State had done to their reputations and good name.

    If lawyers do not stop the abuse and police themselves properly, there has to be a manner that the public could step in and convince the State that charges have to be brought against these perpetrators of injustice. That is because the wrongly convicted have been put on death row because of the activity of lawyers that knew the wrong person had been accused. Also, there have been many who have been wrongly convicted because of people like Jodi Arias, who are more than willing to provide false testimony, in order to brag about their worth to the State. There are people like Jodi Arias who become snitches and provide whatever an Investigator wants to hear. They do this just to get their name in the paper or a photo of themselves in the local news broadcast. There are Jodi Ariases working both sides of the fence, and there are lawyers more then willing to use the Jodi Ariases of the world to bolster their cases.

    What has been learned from watching this Jodi Arias Trial is that not only do lawyers put themselves above the Law, but those who are supposed to be your peers, who will be chosen to serve on a Jury, will put themselves above the Law also. (Maybe that is why there are so many wrongly convicted, who have died [from a Jury’s decision] based on a case that offered nothing more than circumstantial evidence that had to be interpreted by Jurors [thought to understand the Law that had been presented].) In the Jodi Arias case, the Jurors were told exactly what their job was supposed to do. They were supposed to weigh the aggravators against the mitigators. They knew that no one had been called to testify for the benefit of Jodi Arias, at the mitigation phase of the Trial. Jodi Arias allocuted, and this was explained by the Judge — that Jodi Arias was only providing the words of a story, since she had not been placed under OATH to tell the truth. Therefore, nothing she could say had any believability, unless (of course) there was something in the testimony that could provide corroboration, from another somewhere else in the Trial).

    The Jury had no corroboration to the statements made by Jodi Arias. Yet, several of the Jurors decided that the defense team had provided some mitigating factors (in the statements made by Jodi Arias, alone) to be weighed against the extreme cruelty that was shown to be an aggravator. These Jurors were treated like they had at least a high school education. While they were not given a test to discover whether they could read (as had been done with Jodi Arias) it was assumed that the Jurors could read. It was also assumed that they understood the Instruction. If they did not understand that particular Jury Instruction, they would have mistakenly thought the story spun, by what the Jury knew was a pathological liar, would have had a basis in truth. The Jurors should have had more sense than to believe anything this woman would have said, due to the fact the Jurors had unanimously discarded her words, in coming up with a unanimous verdict that this evil woman had viciously slaughtered an innocent victim with her demonic action. So, one is left with the presumption that they too, like the lying criminal lawyers of the defense team, had put themselves above the Law in what they would provide. What a shame that people can not just follow the Law and a simple Jury Instruction.

      What the hell does he mean when he says “We were horrified when we found out they called a mistrial”? Was there a miscommunication between the jury and the judge? I have been very supportive of Judge Stephens, but I do think a tougher judge would have resulted in a much different trial. She should have repeated the Allen charge, emphasizing how much time, effort, and money had been invested in this trial. To allow them to give up after less than 14 hours of deliberation is ridiculous. I don’t know if they felt they had to make a decision before the “long holiday weekend” or what, but when the foremen says “We were all exhausted” it sounds to me like they should have gone home and taken advantage of the break, then return and regrouped on Tuesday.

        I agree Schaeffer, I’ve watched some of the Caryn Kelley case online and that judge, (also female) doesn’t let anyone get away with anything. They should have replaced the minority vote who felt the strongest with the alternates and sat it out until they came to a decision. (If that is allowed of course)

      What’s fascinating is that he said they had to take emotion out of it. I totally get that–you don’t want a verdict that’s driven by emotion–but on the other hand…that put them (or whomever he was representing) right on JA’s wavelength. It dehumanized the process, just as she dehumanized Travis. The fact that anyone could think TA abused her emotionally and mentally tells me something was missing in the processing of evidence and testimony…and that something is emotional intelligence, “the subset of social intelligence that involves the ability to monitor one’s own and others’ feelings and emotions, to discriminate among them and to use this information to guide one’s thinking and actions.”
