Jodi Arias Murder Trial – Delay, Delay, Delay Again


In what was another disappointment for the Alexander family, yesterday, Judge Sherry Stephens postponed the hearing until September 16.  The postponement is to allow prosecutors to respond to the two motions Nurmi filed last week. images

One motion asks that the court not allow cameras in court or if they are allowed, the penalty phase not be shown live.  Nurmi argues because the first trial was shown it created public outrage against Alyce LaViolette to the point she received death threats.  He also claims Patty Womack, who was to be a mitigation witness was also threatened…all due to cameras in the court!  Both now refuse to testify in round two.

The second motion requests the Twitter accounts and handles of jurors so they can be monitored during retrial.  It is unclear why the motion only addresses Twitter or who would be monitoring the accounts.

In my opinion, neither motion will stand.  If LaViolette, Womack, Nurmi, and Willmott did indeed receive threats, that is wrong and unacceptable.  Dislike them as much as you want, but threats are ridiculous.  Nurmi claims Arias can’t get a fair trial because the defense witnesses have been intimidated.  Cameras are not the problem; it’s people.

The Twitter motion is just nuts.  That would open up all kinds of personal information about the jurors for which they deserve their privacy protected.

I strongly suspect Nurmi intentionally files motions so late in order to get hearings postponed and continue to drag the proceeding out.

The one positive from yesterday was both sides were given some 1500 pages of the court transcript.

Want to bet Nurmi will ask for a continuance because of the volume of the transcript and they need more time to review them?  Any takers?

    Morning donchais. I don’t think that anyone was surprised with the delay.

    I happened on JVM last night for a minute (a minute I will never get back) and ALV was giving an interview and reading the threats she had received. If she was so worried about her safety how was she able to give an interview. From the little that I heard, the worst that they called her was fat. There may have been more but I didn’t watch.

    While I certainly don’t condone death threats, what happened to the big, brave woman who stood up for women and their rights? Seems like it is all being orchestrated by the defense.
    As for Patty, she refused to answer JM’s questions about her drug use and she was on tv ages ago saying she had NOT received death threats.

    At least Wurmi could try some new tricks instead of the same old, same old. As for JA, she is back to tweeting. 🙄

    As for your bet Donchais, a wise woman once called a bet like that a sucker bet so no takers. 😉

      Good morning MMD. Well I am not the bit suprised by yesterday. On September 13th Wurmi will be filing another bogus motion to delay the trial further. As far as LaLa, what can I say. I’m sure she has heard worse in her dealings with raging spouses. What a crock.

    Judge Stevens wants this trial over. Unfortunately, as you pointed out, the defense will continue to file last-minute motions and whine about poor JA. They will say NO witness will testify on her behalf.

    Patty Womack had her own “issues” that Juan Martinez could question her about. She’s said that Jodi’s childhood was normal. Rumor has it she feels bad for Travis’ family. Perhaps she saw the light.

    Alyce LV goes on CNN in a tearful interview and still insists that Jodi lied to her until she told her the TRUTH! She believes in Jodi, but won’t go back on the stand to defend her because of her anxiety, her death threats, because her family doesn’t want her to testify. As a mental health professional who supports battered and abused women, I would think she’d put on her big girl boots and do the right thing by her former client.

    Darryl Brewer got on the stand and supported Jodi during the trial as well. He testified that Jodi changed the day she met Travis Alexander. However, under stiff cross-examination, he had to admit to the gas cans, the Mesa destination. He wasn’t called in the first penalty trial either. However, he did manage to give a press conference the same day. Naturally, he wasn’t under oath then and didn’t have to worry about the truth.

    I know that Jodi’s mother was prepared to take the stand in her support. What mother wouldn’t? Unfortunately, there is the video of her interrogation when Jodi was first arrested. She went on and on about Jodi’s problems with Det. Flores. While the video could be well-used by the defense to say that Jodi was mentally disturbed from the age of 14 (at the least) and suffered from BPD; it’s not the picture the defense wants to paint of their client.

    The defense needs to own that Jodi was not an abused child, nor was she an abused woman. They need the new jury to feel sorry for Jodi. They need to see her as a severely disturbed child who gradually became worse as she grew up. IMHO, pity is the only thing that could keep her alive. It is also the same testimony that could give her the DP.

      No witnesses will testify because she has no friends and never has, just former boyfriends.

      As for the abuse, the defense will never own anything imo as JA probably still has them as well as herself convinced that she was abused. After all, nothing is ever her fault and there is nothing wrong with her, in her mind.

      I’m hoping that there isn’t enough pity in the world to keep her off death row and I’m not even a proponent of the DP.

      I’m sure that interview was planned by Wurmi and co. She still says that she doesn’t believe that JA premeditated the murder and that she was abused and just got carried away.

        probably both. I didn’t particularly like her character but they kind of need her to tell Piper’s backstory in relation to how she interacts with the other characters.

        If she is gone though, they have tons of terrific stories to tell with the other characters.

    I have been on a tv marathon this weekend since no one was around and we couldn’t chat yesterday (and yes I felt cut off from the world yesterday). I’m almost caught up with Dexter, watched all of season 2 of Longmire and am up to date with Rizzoli & Isles. I needed something light after all the dark stuff I’ve been watching. Also finished Broadchurch. Even though I had read too far on Wiki right down to the last half of the final episode I kept thinking no way. So glad it is coming back next week. It just won best drama in the UK.

    These delays are only giving JA more time to aggravate the public. She is not confined to her cell 23 hrs. a day, according to the Phoenix reporter that interviewed her in May. She’s busy responding to her idiot mail – NOT locked down 23/7. Estrella is not like the next prison (name-?) that will be JA’s new home – no game playing there. Unfortunately, the DT’s tactics will continue as long as it takes to keep her out of there and in hopes the pro will back off, which will never happen.

    Unfortunately, Judge Stevens has to put up with their crap. As frustrating as it is with her rulings, I’m sure she does not want this entire trial to come back again. It’s so sad for the family to have to cope with all this nonsense.

    Let’s see what the DT is brewing for the next hearing. How many more motions? There has to be a point when the judge has to say enough, death penalty or not. We’ll see . . .

    Wonder what’s in those 1,500 pages given to the lawyers – an overview?

    After September hearing, I think trial date will be mid-October – THIS YEAR, providing no more motions.

      Morning Jessi. Once she was convicted she was supposed to be on 24/7 lockdown. If JA said differently I wouldn’t put too much stock in it. She can answer her mail with her stubby pencils in her cell. I know that Estrella is not like the prison she is heading to but they do have facilities to keep her on lockdown. I know she is no longer in her pod.

      All I can say is from your lips to the AZ court system’s ears. Judge Stephens HAS to get a pair because you know Wurmi can file motions for years and years and continue to put pennies in his kettle.

        Only my opinion, but I feel that Wurmi is filing these motions only at Wobo’s demand. Honestly – I think he wants to be done with her as soon as humanly possible — but Wobo calls the shots and she’s the one dragging this out. Why a judge can’t just read a motion, rule on it, set a date and get on with it is beyond me. This isn’t Justice for Travis – it’s a Travesty of Justice. Would it be different with another judge???? We’ll never know…..

    One very positive development is that the courts denied Donavan’s request to end her probationary status! It won’t be so easy to replace that convicted felon who was eager and willing to flaunt the breaking of the court rules, at times directly in open court. Between Jodi and her mother, I’m sure they will find a replacement accomplice. I sincerely hope that the new Mitigation Specialist will not aid and abet the passage of notes, papers, and messages as the former MS boldly was caught on video doing on several occasions.

    While I know it would be tough on the jurors, I am in favor of sequestration for this do-over on the sentencing portion. JA has been found guilty, with extreme cruelty, so the prosecution should focus on the premeditation, the butchery, JA’s lies and the fact that she has continued her manipulations during the first trial — even up to her glamour shot media blitz while the juror was deliberating. He needs to quickly convince the new jury of her evil, and then let them get aggravated with the defense if they drag out the trial with numerous psychologists, friends and JA on the stand trying to build sympathy. It’s the only way to get this sentencing done with the least amount of pain for the Alexander family.     I was so glad to see that Travis’ siblings have published his book this past week. Now, if only there was some ability for them to legally bar this evil woman’s ability to continue her own 24/7 reality show as a convicted 1st degree murderess. The book club, the selling for her profit only, of the re-designed tee shirts and her bogus art.

    I don’t see how Judge Stephens could rule in agreement with their motion to deny live stream cameras as courts at every level have consistently ruled and struck down attempts to deny cameras in the courtroom. It’s settled law. But who knows. I hope that Judge Stephens will deny the defense’s change of venue motion. The irony of the twitter motion is beyond incredible. Too bad that victims and/or their families have no legal rights with respect to a speedy trial. Only the defendant has that right.

    Maybe the defense just continues making excuses to delay the trial so they can better establish a mental illness defense. This is all tactical. I recently read an article called “Tactical Ineffective Assistance in Capital Trials”. This defense is using every one of the stall tactics discussed in the article. Her total lack of remorse and refusal to take full responsibility, if reversed, would strongly increase her chances of not getting a death sentence. However, I’m very doubtful that it’s in her DNA to pull that act off.

    ALV had lost all credibility during her guilt phase testimony and would have done more harm than good in mitigation and Nurmi & Wilmott knew that. I think it was implied that ALV would have been called to testify in the mitigation phase of the trial however Nurmi’s opening statement did not mention her (only Womack and Darryl Brewer).

    We know that the Judge had offered to provide additional protection for the mitigation witnesses, by allowing them to testify to the Jury without the cameras and the public present. Yet somehow the DT wanted us to think that ALV was so worried for her safety that she chose to ditch the client whose well being she claimed to have so much at heart?

    After 5 years of searching for mitigation witnesses, the defense came up with a former friend from childhood, who knew Arias for 8 years, and subsequently did not have any contact with her for another 7 years; except for her wedding plus another 5 of Jodi’s imprisonment b) a clearly smitten man-hater who met Arias 2-3 years after the crime, and ‘KNEW HER’ for 44 hours of interviews, never having any further contact with her until she testified c) a former boyfriend who clearly let her manipulate him for all the 4 years she knew him, and whom she dropped like a hot potato when a newer, bigger, better deal presented itself in the person of Travis, and whom he had not heard from until the May 2008 phone call asking for the gas can, and whom he’s seen once only since the breakup, when she came to get the gas cans.

    Those were the 3 people that the Mitigation Specialist, the most underemployed and overpaid person on this defense team, was able to come up with in five yrs! And then 2 of them supposedly changed their minds and ran for the hills?

    Let’s not forget that Jodi herself announced to the world in her 1st post conviction interview with Troy Hayden that her attorneys had informed her that she had NO mitigation to offer. Before the mistrial there had been some blog & twitter discussions that since ALV was a PAID expert witness, she had no legal right to REFUSE to testify, no matter the cause.

    On May 20, 2013, during the argument on Nurmi’s mistrial motion, he stated that “Ms. Arias was advising the court that Patricia Womack was not willing to return to Arizona to testify on Ms. Arias’ behalf because she had been threatened.” He noted that the fact that this had come on the heels of a record being made of the threats made to ALV who he had described as an expert in the field of domestic violence and another key mitigation witness.

    Nurmi again tried to confuse the previous threats to ALV during the guilt phase, with his claims that the mitigation phase had been affected by threats to mitigation witnesses.

    But notice that while he clearly stated that Patty Womack refused to return to Arizona, NOWHERE did he state that ALV was REFUSING TO COME OR CANNOT BE CALLED because she couldn’t refuse to come and he was only throwing her into his argument again to make it sound so dramatic.

    He’s a boldfaced liar trying to make it sound as if threats to ALV had affected the mitigation phase even though there was no allegation that she had refused to come, and in fact, she could not legally refuse to come, as the expert on the case.

    “In Ms. Arias’ case, the Defense mitigation investigation was completed and she was ready to present said evidence at trial up until the point in time when mitigation witnesses [PLURAL] felt too intimidated to come forward.”

    Even though it had not been stated that ALV was to testify in the mitigation phase, it was certainly being implied.

    But “to come forward” implies voluntarily testifying. An expert does not have to “come forward,” they HAVE to appear because they are under subpoena. This was an extension of his prior argument that lay witnesses would not “come forward” to support Jodi because of the environment of intimidation.

    I really think he was trying to confuse the two separate issues because he didn’t think he had enough with just one lay witness who couldn’t be forced to appear because she has no factual evidence that could be compelled. During Patti’s interview with Juan she denied witnessing any parental abuse. She stated that she would not be able to testify to JA having a bad childhood. [Implies her testimony would not be crucial to the Defense.]

    Juan conducted an interview with Patti and she failed to answer his questions regarding drug use of herself and the Defendant. She left the room with Jennifer Willmott and Kirk Nurmi, not her attorneys. When she returned, Womack’s Fifth Amendment right was asserted and she stated it was her belief she should assert them. Juan told the Judge that she faced prosecution for not reporting income from “some photographs” (licensing fees she received from NBC & HLN) and for “use of illicit drugs”. She has some sort of substance abuse problem. Juan also said that she came to court on Thursday May 16 and at that time the court appointed her an attorney, Kenneth Countryman. Juan said “it’s the State’s belief, based on her silence, she would have continued to assert her rights and been excluded from testifying.” He provided a copy of the interview with Patti from May 15 as evidence as to what happened. So, Nurmi cast the net and stated that no one would come forward (VOLUNTEER) because of the environment of intimidation created in the media and by Juan.

    An expert cannot be released from subpoena until the attorney decides he does not need her. Subpoenaed and paid experts do not “come forward” at their own discretion.

    Just more proof that the defense game plan is to delay, delay and delay and to continue to present lots of motions, some of which are not grounded in truth or fact. And it sure seems to be working well for their client. After Monday’s hearing I am confident that no trial will begin prior to 2014. I so hope that I am wrong for Travis’ siblings & friends sake, who have endured so much already. I just pray that on Sept 16th Judge Stephens does not allow the defense team to delay any longer the completion of the trial. Justice delayed any longer will become a travesty and only works in the defense’s favor, IMO.

      So well said NancyB!!!! Ditto to everything you laid out. The DT had 5 long years to find mitigating witnesses and experts to speak on Wobo’s behalf, and clearly, there was no one of any merit then, or now.

      Hope you’ve had a nice summer:). My life has had some plot twists and turns over the summer, but the dust is settled now, and I will be popping in more often.

      Yup, but it’s a slippery slope…unfortunately, our system has become overly protective of the criminal’s rights…Stephens – her first capitol murder case – has bent over backwards to avoid mistrial and has never had a firm hand on the proceedings… at great cost to the victim and his family.

        I agree. If JA had not voluntarily appeared on national media before, during and after the trial, I would think she might have a leg to stand on, but she contributed greatly to the media coverage across the country, not just in Maricopa County. However, let them pick another county in Arizona. It’s an obvious delay tactic, but the facts will play the same way anywhere in the state. What’s the most convenient location for the Alexander family?

    After reading the latest motion for ‘change of venue’ where does Nurmi think he would get a fairer trial? Can he not get all his motions out at one time!!!! The citizens of Arizona ought to be outraged at his tactics to fill his own coffer at their expense. And to blame the cameras in court and the TV stations for the media circus, he might want to take a really hard look in his back yard and reel in his client. JA contributed to the media circus and yet the DT’s seem to have a problem telling her no.

    JA manipulated Travis then killed him when she didn’t get what she wanted now she is trying to manipulate the court to get what she wants in the name if a ‘fair trial’ for sentencing!!!! Really?????? This game needs to be over. The Alexander’s deserve to put their brother and his reputation to rest.

    Did not look like she has cut her hair to donate. What is her hold up?????

        An article I read speculated they were hoping to bolster their argument for a change of venue & banning courtroom cameras by showing the number of times media reps were in contact with their client, which doesn’t make a lot of sense to me as, if I understand it correctly, she can call out but nobody can call in, so she would have had to initiate the contact.

        As for getting their email flooded…… remember way back when Donchais, when my email was going nuts and 1,000’s of emails were flooding into my email and I couldn’t stop it. Being so computer illiterate, everyone here was trying to help me delete them to no avail. It just kept getting worse as every email was coming in 6 times and then repeating again the next time I opened it.

        The lesson of that story was that finally after clearing it all up, individually mind you, I now ONLY receive “New posts via email” and UNCHECKED the “follow-up comments via email.”

        This is just a bit of advice for people who don’t want a gazillion emails especially since I have several WordPress accounts that I get “New Posts” from.

        I found this really helpful, especially when the comments are going fast and furious during the “actual” JA trial and during the “unlimited number” of sidebars that Judge Stephens allows Wurmi and Gidget. 🙄

        Hopefully once we get this trial over-with and Justice for Travis I can also eliminate some of my “google alerts” which also clog up my email.

    Ohio kidnapper held 3 women for nearly 10 years
    Ariel Castro, who was sentenced to life plus 1,000 years on charges of kidnap, rape and murder, was found dead, hanging in his cell at the Correctional Reception Center in Orient, Ohio, late Tuesday.


    Those poor girls. Although I am personally glad that he is no longer breathing the survivors will suffer through such a range of emotions with this latest development. I truly hope that they have the best therapists to help them with this latest event in their long road to recovery.
