Jodi Arias Continuing Saga and News About Martin Mac Neill Murder Trial

What can ya say about the continuing crazy in the Jodi Arias case?  It seems we are beginning to see a flurry of activity.

Dr. Kristina Randall posted Movement in the Jodi Arias Case? on her blog.  She says a reporter for an Arizona newspaper noticed, “the Maricopa County Superior docket shows a settlement conference set for Jodi Arias at 10:30 am on October 24, 2013.”  He went on to say that settlement conferences are used to reach a plea agreement.

Dr. Randall did not name the reporter or newspaper, so I went digging and this is what I found on the court calendar relating to Arias:

So, is Judge Stephens trying to force the two sides to reach an agreement?  Oh, and just because the settlement conference is listed, doesn’t mean it will or has to happen.

It should also be noted, Maricopa County Attorney’s Office – Adult Criminal Trial Process,

SETTLEMENT CONFERENCE
In some cases, the trial Judge assigned to a case will order the parties to meet with another Judge to discuss possible resolutions to a case short of trial. At the conference there is an exchange of views, and the Court will typically suggest ideas to attempt a resolution. The victim has a right to be present and express his/her views whenever the defendant is present. The trial Judge can only participate in such discussions with the consent of both parties.

What it boils down to is, we don’t know what the hearing on the 27 is, we think we know what is supposed to happen on the 4th, and we can only guess about the settlement conference.

Will any of this be streamed?  We can only hope!

Another huge trial is slated to begin October 15.  This time from Provo Utah.  Martin MacNeill is accused of drugging and killing his wife in April, 2007 because of an extramarital affair. MacNeill has pleaded not guilty to charges of first-degree murder and obstruction of justice.

Michele MacNeill was found dead in a bathtub in the family’s Pleasant Grove, Utah, home on April 11, 2007. Medical examiners found a powerful cocktail of drugs — including Valium, Percocet, Phenergan, and Ambien — in her system.

Martin MacNeill talked Michele into getting a face lift. He is both an attorney and a doctor and had the knowledge and access to the prescription drugs.  By the way, both of MacNeill’s degrees are bogus!

This is going to be a blockbuster!

    I’ve got Shanna Hogan’s book on the case, but have lacked the time/energy to read it. I so want her sentenced. IMHO, whatever happens, I hope that she no longer garners attention from the media and has less of an opportunity to play with Twitter the way she does. She needs to know the obscurity of a jail cell for however long she lives.

    I’ve got the dates on my calendar; let’s see if we get to watch any of it. I think the best chance will come with the evidentiary hearing.

    The MacNeill case is a fascinating one. The article you recommended is a fantastic resource along with the videos.

    If anyone wants to do more research, search for his name in the Deseret News and find the earliest article and read backwards.

      I also bought Hogan’s book on the case but I think that for anyone who followed the trial, the book is a total waste. The book is not badly written…..just seems like a BLAND rehash of selected parts of the trial. I have found no insight into Jodi and the book is more or less written for someone who knows almost nothing of the case. (Discovering of the body takes all of 2.5 pages, if that) Don’t waste your money!

    MacNeill case is just so sick and scary. I feel so badly for the kids having lost their mom in such a brutal way!

      Ya know, if Wendy (whom I used to respect) had sent this directly to Juan without involving the public sentiment, I would have no problem. This to me is nothing but another attempt to jump on the media bandwagon. Severely disappointed in Ms. Murphy becoming yet another media whore in a very public case…shame!

Who is she to be telling Juanderful how to do his job…..Hah….where’s her Prosecutorial Credentials?!! To hear her tell it…she knows it all.         When was the last time she prosecuted a high profile murder case??? Nothing is more annoying that a know-it-all! She’s just playing to the public. If it was so important to her why didn’t she send it to him directly and leave everyone else out. She’s been on HLN too much! Following the same format as all the other big mouth talking heads! They think they know it all! The only one we have respect for is Joey Jackson.

      Hi ya…been following a few cases, but none that grabbed me enough to commit to post on, with the fervor I usually work up to. Sandbox still open…have to finish Arias and will prolly get crazy with MacNeill. The madness, obviously, never ends!

        I promised myself I wouldn’t get involved in another case after Arias is over (which is what I said after the Anthony debacle) – but I read the MacNeill article and not sure I can stay away. I feel so sorry for his daughters – especially the one he sent back to the Ukraine — what a piece of work – or another 4 letter word.

    A reporter for an Arizona newspaper tweeted some interesting news about the Jodi Arias case.

    He noticed that “the Maricopa County Superior docket shows a settlement conference set for Jodi Arias at 10:30 am on October 24, 2013.”

    The reporter noted that “settlement conferences are used to reach a plea agreement.” Since there has already been a conviction they may be discussing sentencing options. If so, it’s expected that her lawyers will try to spare her from the death penalty.

    Even though the conference is “on the docket,” there is no guarantee that it will take place. Delays are characteristic of this court. If the conference does take place, it’s unlikely that it will be open to the media.

    The wait continues.

    If you were Travis Alexander’s family, would you forego your desire for the death penalty and settle for life in prison?

    Michael Kiefer digs deeper into what the settlement conference means and the potential outcomes for Arias. For those concerned about her potential release in the event of a life with parole deal, he notes that it is no longer an option. “Even the chance of “release” after 25 years has been eliminated for murders committed after 2012.”

    Kiefer also makes a good point about the appeal process in the event of the death penalty compared to a life without parole sentence. If Jodi Arias is sentenced to death, an appeal is automatic whereas if she receives life, “her appeals would go instead to the Arizona Court of Appeals [as opposed to federal court], then to the Arizona Supreme Court and then back to Superior Court for what is referred to as “post-conviction relief.”

    Debra Milke and Johnathan Doody both had their death-sentence verdicts tossed out of court on federal appeals cases.

    In that case, life without parole all but guarantees that Jodi Arias never leaves prison.

    I purchased Wendy’s last book because I used to have so much respect for her, but it was basically a bait and switch. After hearing what RobertfromRodderdam had to say, I didn’t bother to even read it. Just a total waste of money and I have now learned my lesson.

      I’m totally interested in the MacNeill case if you are. After all the background reading and videos I watched on the case today I’m not only totally disgusted/infuriated but good and hooked.

      It still amazes me what horrific people are capable of doing to each other in this world.

        I like my veggies too but I’d kill myself before I’d submit to eating this garbage for any extended length of time. I don’t always agree with Joe’s politics or antics but sometimes he nails it – if you don’t like it, stay out of jail. It looks really good on Stabby Einstein. MMD, tell me Daisy is doing OK.     I’ve never posted before, but have been lurking for months during the Arias trial.
    First and foremost you have my gratitude for all that you’ve done. You’ve kept my sanity in check but also provided a platform where civil debate and information can be shared. Thank you for keeping the cats out of the sandbox.

      Sounds like a bogus argument if their identities are already known. I wonder how strong the state’s case is if they have to rely on jailhouse snitches – I’m always skeptical of them.

      Jail has certainly done a job on MacNeill as he certainly looks terrible and I must admit, I’m glad that he’s suffering after everything he’s done to his family for years!

      As for snitches, they have ways of working around showing witness faces on camera. If their names are already in the public domain, then the argument seems kind of weak as well as surprising coming from the prosecution.

      I agree with Beans. It makes me wonder how strong their case really is.

    Good morning my sandbox friends!

    I’ve taken the hit and listened and/or read everything I could about a possible plea deal. After a bad night’s sleep, I offer up these bits and pieces gleaned from my “research” on the topic.

    1. If JA takes a plea deal to life, she would have to drop any future appeals.

    2. If it goes to trial and she gets the DP, she will have plenty of appeals available to her. This includes the fact that her defense did not adequately represent her in the mitigation phase. Their local Circuit Court is well known for ordering completely new trials, which is what she would want.

    3. The “evidentiary” hearing was sealed because much of the testimony involved previously sealed motions/documents. This probably includes Dr. Karp, the shrink who was originally supposed to testify at trial and wisely backed out. Jodi, naturally, lied up a storm to her as was brought up in trial. She told Karp about much more abuse than she told ALV.

    4. ALV refuses to testify in the new trial due to her “bad nerves” she never, ever had before and those awful “death threats,” as well, I’m sure, very bad press.

    5. The defense will make the same claim for any other possible mitigation witnesses, setting her on the fast-track for the appeal mentioned in #2. This would set her on a track towards a WHOLE NEW TRIAL! Yuck at the thought of going through that again in a bunch of years from now.

    6. If the defense called Dr. Janeen DeMarte to testify to JA’s Borderline Personality Disorder and mount a mental illness mitigation, it would flop since BPD is not a mental illness and JA is not mentally ill, just deranged. JA does know right from wrong as her alibi-making shows consciousness of guilt.

    While I appreciate the fact that Joe’s Pig Slop is now a staple of her diet, I want to see JA in prison. It’s not as nice and comfy as the jail and the rules are much more strict. She will be amongst her peers, the worst of the worst, whenever she manages to work her way out of death-row-like solitary after a few years.

        She was supposed to be the mitigation witness. When Karp bailed, she was stuck with a job for which I do not think she was fully qualified. She didn’t test her subject, she treated her as if she was an abused woman only telling the truth. IMHO, she knew what she was doing and made an idiot of herself in court.

        When she was on the stand for a couple of days, speaking in general, she got rather a warm reception from the media and I’ve seen the news clips to back it up.

        Once she started taking specifically about JA, she turned into a stooge for the defense.

        That’s why she won’t testify. Just remember, since she’s out of state, she will be difficult to subpoena. If the subpoena were successful, heaven knows if the defense would get the “good stuff” out of her again!

      How can ALV refuse to testify if she is under subpoena? Only in AZ is court a choice 🙄

      I truly can’t see JA taking a plea deal because she has not a damn thing to lose at this point and with her love of media attention, I can’t see her giving that up. Plus even tho she is now living on Sheriff’s Joe’s slop it is probably somewhat more palatable than prison. I’m sure that in her deluded head she figures she can postpone that outcome for years. Anyone else think the same?

      Has anyone heard anything from the Alexander family as to whether or not they have changed their minds about the DP?

        Shanna Hogan believes they aren’t solidly set on DP. What they are set on is a death row type setting where she can’t be belle of the cell block. 23/7 lock down, no contact with other inmates to do her bidding, no being able to taunt, no media or internet contact…yada, yada. I would totally support that myself, however not sure that can happen if not on death row. Not sure legally that can just magically appear as an option. Think it should be one though!!!

        Too bad that would take a lot of legislative initiatives, but that would take years to enact. I do believe we would/should move in that direction. Only seems fair to victims and their loved ones! It ain’t easy being an advocate…been there, done that and the toll is high!

        Donchais, it does take years to enact changes – we are far too easy on criminals up here but the PM is trying to correct that. Our most notorious prison, the Kingston Penitentiary, is closing and all the inmates are being flown out to be housed in other institutions. It opened in 1835 and was a brutal hellhole where the worst criminals were housed side by side with children and everyone was mistreated. I think the fallout from this is what lead us Canucks to lean so far the other way and start coddling convicts – a balance needs to be struck, one where the convicted do their time and victims rights take precedent over the rights of the guilty.

    Donchais, I know this is a off-topic from the JA blog (which I have followed daily since January), but I was wondering if you, or any others in the sandbox, have an opinion about the Amanda Knox retrial. I found it hard to believe her in the original trial, so wasn’t surprised to hear some local “insider info” during a recent professional trip to Tuscany. I was told by a very credible, lifelong resident of Perugia that the wealthy parents of Rafaella Sollecito paid local police to influence what evidence came to trial, and paid Knox’s parents to ensure Amanda did not cut a deal to implicate Sollecito, who wielded the knife. Your thoughts??

I knew about Big Joe and his vegetarian meals last week, and just chuckled about the slop miss Stabby will be eating!! But oh she’s still “winning” huh?You know by the time she gets to DP trial, (if at all) it will be just what the defense wanted in the first place. 2014! I so feel for the Alexanders on this! 🙄 Beyond crazy!!! She will never go for a plea without parole and we all know it! She wants out in 25 years, credited with time served! I hope like hell she doesn’t get out EVER!!!! No more media, twitter, or selling her crappy drawings she calls art! Now, for Wendy,….what can I say… I’m not impressed at all, but very shocked by her.. I mean “c’mon man!” That letter said nothing different that what we all could have written ourselves!         Also heard on JVM tonight that the judge also ruled that the daughter can’t testify about her mother telling her that if anything happened, she should look into her father. Also, the ex-gf who had the tales of his confessions to trying to kill her mother, drowning his brother, drugging/drowning his wife will not come in. Darn it, hearsay again.

        However, I understand. I think there is a great circumstantial case anyway. The daughter who is now a doctor took care of her mother and can testify on everything we read. “Funny” how daddy dearest sent her back to school the day before mummy got so terribly depressed all of a sudden and “committed suicide.”

    Sounds like HLN is following the MacNeill case very closely – possibly major pool camera??? Hopefully Dennis/WAT (as we know with the JA trial ) will be the cameraman. He is the best and WAT, also.

    Yeah, I know HLN can be annoying, sometimes, but they do sound serious about this one.

      IIRC, CNN attorney filed the reply and argued it in court. They seem to have the feed. That means HLN or InSession (if it is still around) will cover the trial.

      Means my poor ears will have to suffer a while longer in the evenings, like it or not!

      I totally agree. Wurmi tried that same motion and was denied but yet the prosecutor Chad Grunander said he expected that ruling. 🙄 It would be nice if the different states could agree on similar rules of evidence. Also, it appears that Utah has a similar work ethic/law as AZ as they are only going 4 days a week. I just hope that Judge Pullan doesn’t allow as many sidebars and delays as Judge Stevens!!!

    The parties have agreed the pretrial hearings/oral arguments scheduled for October 4, 2013 and October 18, 2013 should be closed to the public. The court finds an open proceeding for these pretrial hearings presents a clear and present threat to the due administration of justice, specifically the right of the parties to a fair penalty phase trial by an impartial jury. The court finds there is a compelling interest that overcomes the right of public access, specifically, there is a substantial probability that publication of information provided during these court hearings (through evidence or argument) could taint the jury pool and significantly impact the parties’ ability to effectively present matters at trial. The court also finds that, in light of the intense media coverage of this case, there is no less restrictive means to achieve these compelling interests. Good cause appearing,
    IT IS ORDERED closing the hearings scheduled for October 4, 2013 and October 18,
    2013.

    It’s donchais’ message [posted at # 23] that should be followed. She has asked us to step up, if we can. The World is a busy place, money is tight, and since time is money, this is not an easy thing to do — but it does take more than what is currently available for the victims of a crime, especially crimes of the intensity as that committed by Jodi Arias and [so far as it appears] that committed by Martin MacNeill. The coverage of that case will be just as interesting as the Arias case was and the coverage of the Oscar Pistorius case will be. Anyway, that’s my vote.

    I agree with renae’s post [on 10/02/2013 at 11:57 P.M., currently as # 2]. I spent quite a bit of time yesterday at Barnes and Noble reviewing the book written by Jane Velez Mitchell, and believe the same for her book, as the other by Shannon Hogan.

    When I reviewed the book renae mentioned, I had to put it down because I was so frustrated. In view of the fact that the author is a reporter, I felt that there would be a much better understanding of the facts and a presentation to match the facts, not match what a pathological liar was saying. Then again, Michael Kiefer is a reporter too, and most of his articles about Arias favor her or simply pass over any facts favorable to Travis. He is quoted often on the arias is innocent site when trying to prove her innocence or how terrible Travis was.

    It is my opinion that the books written by two respected women, in a field of bringing the unvarnished news to a trusting general audience, were not deeply researched. It was disheartening to read about Arias supposedly lending or giving Travis money to make his mortgage payment as though Arias would have money or would have had to use her money to give to Travis so that he could pay his bills. It was also upsetting to read about several sexcapades, when the only person that talks about such events is a pathological liar, and there is no corroborating evidence. There have been a few of us at this site who believe that Travis was a virgin when he was slaughtered. From all of the review of the material in the Court record and the additional interviews, it shows that we are right, not the authors of Exposed or Picture Perfect. The research confirms what we believe. Travis may have been involved in the way Arias had inferred, when bringing up the name of a former President of the United States [Bill Clinton], but Travis was a babe in the woods, not guilty of most of what Arias said about him.

    ritanita — I read all of the posts at the web site address you posted for Kristina Randle’s site. One blogger wrote that it was difficult to prove a negative when trying to explain away the purported abuse Arias has alleged she suffered at the hands of Travis Alexander. In the case of Jodi Arias, it may be difficult, but it is not impossible to disprove her stories. As a matter of fact, it is Jodi Arias, herself, who invalidates the abuse stories, “In Her Own Words”. She has provided enough evidence in the Trial record and her interviews to show the abuse never happened. In addition, just because she has tried to repeat the stories of domestic violence does not mean she believes them and is thus delusional, as some may want to portray for a mental illness defense [which would also be too little too late for that type of defense].

    It is very clear that Arias was not abused, and, her supposed faulty recall of the domestic violence incidents, shows that she had no fact-supported recollection of the events (since they never occurred). Usually, women who experience acts of domestic violence have vivid recall capabilities about certain types of abuse. This was lacking in Arias’ stories. In addition, she would alter the story when telling it, depending on the subject she had been discussing with her criminal lawyer or the prosecutor during questioning. There is a reason for this peculiar action. She may have the story memorized, but it seems as though it is never good enough for her.

    When Arias was trying to describe numerous events, it became very noticeable that she could not help herself but had to tweak the event to make it sound better. That seems to be one of her traits. If something comes along that she can add to in order to make herself look more important, more vulnerable, more enchanting or more of whatever adjective will work at that moment, she will use it for her benefit, in a new story telling rant, or to embellish a preexisting story [if that is her only option]. It appears that she can not help herself in that matter. Remember how she embellished her story about getting the gun out of the closet before she shot Travis? She had to add the holster because it was in that published article that Dr. Samuels wanted the Jury to read. There was no need to place the gun [with made-up ownership] into a made-up holster so late in the game, but she did. She just could not help herself. She had to do this because it seems that she would have believed such an embellishment in the preexisting story would have made the story that much better.

    Her embellishments, conniving, white lies, fibs, whoppers, or whatever you would want to call her deceitful conduct doesn’t seem to detract from her power to manipulate. The additions to her stories at a later time do not lose supporters. She can just tell those supporters that she had initially forgotten that part. Not being that important to the story, she can get away with her little additions. However, this habit of hers is what has made it so easy to take her stories apart, to show the falsity of what she reports as certainty.

    The books that have been written about Arias have failed to mention this or have not EXPOSED the activity that Arias entertains. Arias’ letter, printed at Kristina Randle’s web site, addressed the book written by Jane Velez Mitchell, Exposed. Arias wrote, “imagine, if you will, that this book, filled with degrading, embarrassing, spurious details about you, however untrue, is dedicated to someone who used to bully, beat, and abuse you so copiously that your body, mind – especially your mind – and soul still bear the scars of these horrific experiences” and “Imagine also that a portion of the book’s sales are donated to a so-called “Legacy” fund bearing your abuser’s name and founded by people whose burning, twisted desire is to watch you die”. Moreover, she described what had been written about her as “This book is filled with nasty lies about you and half-truths distorted to make you look as inhuman and unsalvageably evil as possible”.

    Lisa Bloom had depicted the author of this book, on its jacket cover, to have “a deeper understanding of this case than anyone”. Nancy Grace wrote the Foreword for the book, promising details that would be provided. However, there was no explanation for the lies, and many of these lies were repeated as fact in the book, as though verifiable and being true. You, donchais, and others were right about this book. I just finished a brief review of it last night, while at Barnes and Noble. This book really did not do anything more than repeat what had been testified to or reveled in the evidence record. There was no meaningful report about the particulars of the case that one would have not known. Although Arias looked as though she was seeing what had been written in the book for the first time, that was not so. Much of what was written in the book had come out of Arias’ own mouth.

    So, you were right. The letter and the information at the web site were an interesting read for many reasons.
