Martin MacNeill Murder Trial – Day 6


Yesterday’s treatment of Rachel MacNeill surely left a bad taste in my mouth.  I surprised she survived, but she did get it through it.  Gustin was intentionally trying to push her buttons and I’m sure the jury saw that.

Judge Pullan on the bench at 8:40 MT.

After reviewing law, he has decided Ada may testify limited to the Children’s Justice Center interview.

Jury brought in at 9:14 MT.

State calls Dr. Gary Dawson.  Toxicologist/pharmacologist.

He goes over his CV.  And, is it lengthy!

Pros is spending way too much time going over science and putting everybody to sleep.  The idea is to get to Michele’s tox report and we’re nowhere close to getting there.

Thank God the Judge calls a break!


He reviewed Michele’s toxicology report and the autopsy report.

He lists the drugs found in Michele blood.

Pretty much Dawson says many of the drugs were CNS (central nervous system) depressants and sedating.

Kinda shows MacNeill knew exactly what he was doing when he did his drug shopping!

Was she drug naive or experienced?  Naive.

They go over a ton of scripts over the years and I have to question, 1 who wrote them and 2. who was taking all of them?  Michele was drug sensitive and didn’t take meds.  Was MacNeill taking them?

Lunch called.

Way too much science and medical info for me to keep up with, lol!


Dawson was interested in finding out why and how there was a reval in the autopsy report.

Lord, def is cherry picking, nit-picking on prior statements again.  This is their whole tactic!  Spencer going line-by-line again through earlier testimony.

Spencer is going to the drugs had nothing to do with Michele’s death had nothing to due with the drugs, but a heart condition, myocarditis.

I’m feeling all this doesn’t prove or disprove anything and has been a waste of time except that she must have been at a pretty low state of consciousness when he drowned her.

Redirect is rehabilitating I think.

Jury questions…

Blood sample was taken 24 hours after the death of Michele, is that typical?  It depends, 24 hours isn’t a long time.

State calls Gypsy Willis.  The mistress.

She has also gone by Jillian MacNeill.

She has been convicted prior.

She met MacNeill on line.  She had several online names.

She developed a relationship with MacNeill.

The sexual relationship was casual. MacNeill had a duplex that she moved into and he gave her a credit card to use and was helping her with schooling costs.

Cell phone records are brought out.  They are covering calls to her cell from MacNeill.

Just prior to Michelle’s death the calls increase.

On the day Michele died, MacNeil, called her the evening the of the death.

The text messaging was prolific leading up to and after Michele’s death.

April 14 there were about 22 texts…the day of Michele’s funeral!

She attended the funeral and offered condolences and said she was there if he needed her.

Judge calls it a day.  Back Tuesday.

    Thanks again donchais for all you do. Luv ya xoxo. It was pretty boring with on the toxicology but we got lucky with finally seeing Gypsy, that cocky little bitch who is so proud of herself. She MUST tell the whole truth for her plea agreement so none of this I can’t recall or it’s been so long ago. Yeah, tell it to someone who’ll believe you.

    I’m just glad that the jury went home with her being the last person on the stand. Could you believe her hanging around waiting to get a word to or a look at MM!!!!!!!!!!!!! I so hope she blows her plea agreement all to hell. She’s never get away with some of those answers with JM.

    I just hope that what was said in the text comes out in court because that is what is going to sink him in my opinion.

      Yes and sink her as an accessory before or after, she bloody knew something wasn’t right. If it was legit any normal person would not be texting/communicating with someone whose wife suddenly died immediately after it happened. You would have to expect some time out from a “casual relationship” grrrr

    Gypsy that lying liar, seemed to have free reign today. Is the prosecutor really going to let her testimony go without confrontation? She is really nauseating to watch. She actually referred to the dress she wore to temple as “appropriate” the day she met Rachael! How can anything be called appropriate when she is being introduced to her married lover’s daughter, especially when that lover murdered his wife/daughter’s mother?

      She is one entitled piece of work! I never liked Nurmi but it makes me smile to see that behind the scenes, he was as sick of her as we all were — with cause. However, I think her written rant shows that she is the problem, not him. BTW – did it bother anyone else that she constantly hyphenated her handwritten words at the end of sentences, as if it was a typed document? Crazy!

    We read through the document and we came to the concensus that 1) She’s FOS! 2) It’s a set-up for her to file her appeal on for ineffective representation and 3) She’s FOS!! 4) Bottom line….she’s going to ask for a new trial in her appeal and 5) SHE’S FOS!!!

    Safely back out of danger .. They’ve all turned on Nurmi, Jennifer is their shining light. It’s Nurmi’s fault she was found guilty with cruelty as he let prosecution get away with things. Sorry, was Jennifer not sitting there also jumping up and down like jack in a box objecting too? Clearly as Nurmi doesn’t jump he was ineffective. Oh and the 9/10 I don’t like her smile was an awkward moment of embarrassment.

      She certainly wasn’t bothered with the comment when she did her “post conviction” interview when she was in such a hurry to get in front of a camera! As a matter of fact she smiled about it with the reporter who intereviewed her! I’m sure he told her he was going to say something to that effect in his closing and how she should act in response to the comment. Their whole show was scripted!! Now she’s using it as a tool to set up her appeal. They’re not kidding anyone! What a bunch of phonies!

    How come in the JA circus trial they had copies of the text messages but in this trial all the Prosecutor is referring to are the phone statements that just shows when the calls were made and to what phone number??? Where’s the meat of those messages? What do they say? WTH???? They could be some clues

        Yes they must be able to get them. If they could get the JA ones from 2004 they must be able to recover from 2007 technology hasn’t gone backwards. State’s witness list has “Custodian/s of records for phone company/ies name/s presently unknown” so they’ve got someone coming !!!

      Different companies keep text messages anywhere from a few days up to a year, depending on the company. Hodi was arrested pretty soon after the murder and her text messages were still available to be retrieved. Scumbag MacNeill wasn’t arrested for years. The murder was in 2007; he was arrested in 2012. Those messages were no longer available by the time he investigated and arrested. They can’t be retrieved; they’re gone. It’s a shame, too, because I’d sure like to see what they said.

    dp – You are cracking me up in the chat room (MM) – way to go!

    As far as this tramp (Gypsy) – the Pros better get some fire and passion or she will run the show on Tuesday. I would have liked the Pro, on the left of the table, to have done the Q’s.

    Miss Piggy was so disgusting with Rachel. Still amazes me how they could get her mental issues into court, but matters about MM couldn’t come in. I do think this Judge is holding his own and being fair, so far. Glad he allowed at least part of Aida’s testimony – that will impact the jury. It must have a tough decision for him.

    Sorry, if I keep complaining about the attorneys, but the lack of compassion and seeming unprepared is so visible. But, who am I to comment on such a difficult job – I did. JM get over there and give them some lessons. I don’t think we’ll ever see another Juan. He’s got some interesting trials coming up in the spring – huge schedule to juggle. I think the one with NG and JVM death threat case is on his docket – look forward to seeing if they will be televised.

    As usual, I must thank Donchais – you are so appreciated by us all!

      While it is frustrating to see Gypsy being coy and vague we must keep in mind that she is the prosecutors’ witness, they can’t be seen as attacking her by the jury.

He has become an expert witness on the matter of executing a person. The inmates can choose between lethal injection or gas. It’s pretty interesting in a sick way the prep work the 24 hours prior to execution. Everything is down to exact clock work. Amazing how much these killers throw around “their rights”! Depending on their appeals will determine how long they sit on death row waiting to be put down. One prisoner execututed this month requested a meatball sandwich for his last meal from Subway. If you’re curious you can go to the Arizona Correctional Department and it will show you all the inmates on death row and the ones executed and believe it or not will tell you what their last meal was as well as their horrific crime that brought them to this point. Lastly I’m so amazed by the Alexander family and their determination,fortitude and love for Travis. No one believes him a monster or abuser! Travis was a beautiful soul.He unfortunately got involved with a twisted,evil and narcissitic individual. Travis is an heavenly angel! To the Alexander family we are here for you. We will see this through with you in hopes JA ends up on death row! Also hope to see a different judge and Juan Martinez stays focused! He’s going to be more effective if he can stay calm.         Wish we could validate your thoughts, but we still wind up on sites where we don’t belong and have no idea how we got there! We use the links you all provide here because we feel they’re safer than us going out there on our own. You should see some of the stuff that’s in our face just by putting in a search word!! Just to give you an idea….one of the ol gals was needing a new mattress set so we put in mattresses in the search line and OMG!!!….you should have seen what came up in the side panels of the window we were looking at!! How embarassing!! One of our grandkids walked in and said, “Gramma…..what are you looking at!!?? We just told her, “Get us off this page!!” Yikes!!

        Your mattress search anecdote gave me a laugh. I had the same thing happen when searching”American Girl” with my then 10 year old daughter. We were looking for clothes for her American Girl doll but most of the images that popped up had no clothes on!

        yes it was a virulent green ( Definitly her colour) jacket on the big screen but on my laptop it was a washed out beigey colour. Looked likke it had been washed many times in the dark load without a colour catcher cloth. Suffice to say she could no longer wear Michele’s jacket cause it didn’t fit.

    Willis started her testimony by saying that she had agreed to testify based on a plea deal given to her by the State. Court records indicate that Willis pleaded guilty to identity fraud, two counts of false or inconsistent material statements, all second-degree felonies and wrongful lien, a third-degree felony in March 2011. Prosecuting attorney Chad Grunander told reporters outside the courtroom that in exchange for her testimony Willis didn’t serve any prison time but was put on probation instead.

      I’m hoping it’s a double whammy – she’s a prosecution witness. They are going slow, hoping to catch her in a lie (perhaps with help from defense) so that they can get her behind bars as deal would be off, possibly getting some truths from her but showing that she would lie for him. Or perhaps I’m trying to rationalize why this prosecution team sucks so bad so far. I know there is only one JM, but come on, aren’t you at least trying to win the case?

        She already started out from the git go down playing their relationship until the Pros gave her an email to read that she had written to a friend of hers. It was as if the Pros was reminding her of her deal to tell the truth or her deal is down the toilet. We hope those emails and text messages they have yet to produce will show that she had full knowledge of what he was up to. If so, then hopefully they’ll charge her with conspiracy to murder after he’s convicted since her deal has nothing to do with murder. We hope what goes around comes around and quick!! It really pissed us off when we saw that picture of her wearing Michele’s blazer!! What a bitch!! Now there’s someone with no morals or a conscience!!

    Posted on October 27, 2013 by Dr KR —

    Recently, Jodi Arias wrote and filed a motion to the Superior Court of the state of Arizona. In this document, Jodi Arias asks the judge to remove Kirk Nurmi as her primary attorney and replace him with another unspecified attorney.

    The basis of her argument is that Kirk has not done his job. According to her, he has instructed his office secretary not to take messages from Jodi and should she attempt to leave a message, the secretary should hang up on Jodi. She also mentions that she hasn’t seen him since the trial ended in May. Clearly Jodi is not happy with Kirk Nurmi. She is however happy with Jennifer Willmott.

    In her handwritten motion to the Superior Court, Jodi mentions a number of failures on the part of Kirk Nurmi. She says that he did not pursue evidence that would have found her not guilty. She mentions a number of other things that she believes Kirk did not do properly and would have resulted in a better verdict for her.

    She also clearly points out that though Kirk attempted to see her at the prison, on two separate occasions, she refused his visits. Obviously, she is not satisfied with Kirk Nurmi. It is important to point out that this is the second attempt by Jodi Arias to have Kirk Nurmi removed as her attorney. The first attempt was denied by the state of Arizona.

    She also mentions that through the course of the trial, she had disagreed with strategies and legal maneuvers on the part of Kirk Nurmi and that Kirk would respond to her by saying in essence that he did not have the time to explain to her everything that he had learned in law school.

    She also claims that under the law she deserves an attorney that “advocates” for her. She states that Kirk Nurmi is not her advocate.

    I watched every minute of her trial and came away with the clear impression that Kirk Nurmi was very much her advocate. When Kirk Nurmi took her case he was a public defender. I don’t think that either Jennifer Willmott or Kirk Nurmi would disagree with the statement that, at this point in their careers, they are not the best attorneys in America. They are both relatively young. They are both relatively low-profile attorneys, local attorneys without a national presence, until this trial. I think they would also both agree that if Jodi Arias had $5 million in the bank, she could have hired better attorneys. If Jennifer Willmott or Kirk Nurmi had $5 million in the bank and one of them were charged with murder, probably neither one would pick the other to represent them.

    This is not a knock on Jennifer or Kirk. They are both good local attorneys but there are better criminal defense attorneys. To complicate things, they were given a case where their defendant had already admitted to committing the charged, very brutal murder. They were given a defendant who had already lied, over and over again, to the police and her then attorneys and to the national media and thus the American public. Kirk and Jennifer had only one defense strategy, had only one way to try and save the life of their client. All they could do is prove or try to prove that Jodi Arias killed Travis in self-defense. That’s it. They couldn’t go out and try to find the real murderer because Jodi Arias had already admitted that she was the real murderer.

    They did the best they could to sell the jury the story of self-defense. To do that they needed the jury to believe that Travis was both an abusive boyfriend and a child molester. In my opinion, having heard every word of testimony given in the courtroom, Travis Alexander was neither abusive nor a pedophile.

    Anyone can accuse anyone of anything. Many husbands who are going through a divorce where custody is involved find themselves accused of molesting their very own child. Many wives going through a messy divorce where custody is involved and perhaps a new boyfriend, are accused of being unfit mothers, being drug addicts and of being guilty of illicit overt sexual behavior in front of their children.

    During a divorce, great emotion can be involved. It can be so bad, so strong, that it is sadly all too common to hear about the soon to be ex-husband, killing the wife or ex-wife’s boyfriend and then killing her and then killing himself.

    At this time of unbelievable tumultuous emotion, I can understand why false allegations are aimed at someone who has already hurt you so badly, intentionally or unintentionally, by requesting a divorce or by seeking custody of the children. I can understand it but I cannot forgive it, nor accept it, nor condone it.

    That’s probably why I never went to law school. I would find it very, very difficult to defend my client at any cost. Based on all the evidence presented at the Jodi Arias trial, I could not have found Travis Alexander to be an abuser of sufficient merit to have deserved being murdered. I most certainly, based on the evidence at the trial, could never have believed him to be a pedophile.

    If I were the attorney representing Jodi Arias, I could not have defamed Travis Alexander by accusing him of things that I did not believe to be true. I know under our American judicial system, the attorney for the defense is required to and expected to be an advocate of the accused. It is an advocacy system. Kirk Nurmi and Jennifer Willmott fulfilled their obligation as attorneys in the American judicial system.

    They advocated so hard, that in my mind they were guilty of immoral conduct, not as attorneys, they did nothing wrong there, but as human beings. I bet if you hooked up both Jennifer and Kirk to a lie detector, and ask them if they really believed that Travis was a pedophile and abuser, you’d find that they really didn’t and don’t believe that he was.

    They advocated for Jodi Arias, then and now. They did their job and I respect them as attorneys, however I don’t have respect for a profession that allows for the professional to accuse a murder victim of horrendous acts without sufficient evidence to merit such defamation.

    Now I get it, I know all attorneys have to do this, that’s their job and they know that from the moment they enter law school. It’s not their fault and perhaps it’s no one’s fault because it just might be true that the best way to produce justice for someone accused of a crime is with this advocacy system. Nonetheless, I find it to be reprehensible that Travis Alexander was accused of having committed horrendous acts and having also been a disgusting, perverted, pedophile.

    Anyone can be accused of anything at any time (said it before but worth saying it again). They accused Travis but it doesn’t mean that their accusations were true. In fact there was insufficient evidence to even merit bringing an accusation, much less proving one true.

    I think that Kirk and Jennifer did a good job defending Jodi Arias, certainly the best that they could do under the circumstances and evidence available to them as defense attorneys. Apparently, the state of Arizona also agreed that they did a good job and proved that by having denied Jodi Arias’s first attempt to have Kirk Nurmi removed from her defense team. I believe, it’s most likely, that her second attempt will also fail.

    Remember, she states in her handwritten motion to the Superior Court of Arizona that Kirk Nurmi did attempt to visit her in prison on two occasions. On both occasions, she refused to see him.

    Having read that entire document, it becomes very apparent that Jodi blames Kirk for all of the things that she believes went wrong. She blames him but she never blames herself. He was wrong, not her. Isn’t that exactly what she did with Travis Alexander? Things went wrong in their relationship and it was never her fault, it was always Travis’s fault. Anything that went wrong, anything that was wrong was due to a problem of Travis’s.

    Even with all of the various incarnations of lies that she provided to the police overtime, she never took responsibility for having done something wrong or simply having been wrong. Even with the fantasy scenarios, the imaginative lies that she provided to the police, none of those fantasies displayed or even implied that she had done anything wrong. She was always the innocent victim. Even in the final scenario that she presented to the police, the last one and the one that she still claims to be true, she did nothing wrong. It wasn’t her fault. She didn’t kill Travis, Travis killed Travis by being a hot head who became enraged when she accidentally dropped his camera. Not her fault.

    In her latest petition to the court, she can see no blame on her part. She did nothing wrong, it was Kirk Nurmi. Not her fault, all Kirk’s fault. Nowhere in that document does she state anything to the effect that “in retrospect perhaps I should have accepted Kirk’s attempted visitations to the prison. After all, he took the time and drove over to see me and I at least should have taken the opportunity to tell him what a bad job he did for me and that I no longer wanted him as my attorney.”

    Nowhere, in her long written document to the court, does she admit to having done anything wrong. Nor does she admit or point out that Kirk Nurmi did anything right. If you read the document, that she submitted to the court, I think you will clearly see that her attack on Kirk Nurmi is a personal attack. She suggests that he really doesn’t care about her, he just cares about the money that he makes defending her. She talks about how incredibly bad he is as a human being for having instructed his secretary to no longer take messages from her and to having instructed his secretary to hang up on her if she attempts to leave a message.

    I think it would be a fair summary of her motion to the court, to say that Kirk Nurmi is a bad guy and a bad attorney. She does not imply or suggest nor state, that Kirk Nurmi is a good guy but nonetheless, a poor attorney.

    If we summarize her testimony in court , this was also her opinion of Travis Alexander. He was a bad guy. He was an abuser. He was a pedophile. Our relationship ended up badly. Not my fault.

    Kirk Nurmi? He was a bad guy. He did bad things as an attorney. Our relationship ended up badly. Not my fault.

I think and hope the Pro is just testing the waters and it will get a lot more intense, JMO.

    What I have heard is that the text contents were not able to be retrieved. I think it depends on what service they used, especially that many years ago. Maybe they’ll surprise us. Wasn’t that a problem in discovery with the JA trial? Years later the Pros were able to find a tech/program to read them, as to what I recall.

    I’m listening to Beth now, and they are discussing if Gypsy could be declared a hostile witness. She replied it could happen and that the prosecution was probably close to it.

    At that point, an idea struck me smack in the gray matter. JURY QUESTIONS! I’m sure this jury, which has asked a lot of very good questions, will probably submit questions about why Gypsy had a plea deal, among other prohibited questions based on the judge’s pre-trial decisions.

    When they don’t hear their questions answered, it’s going to go ding-ding-ding in their minds that it must be damaging to the defense. Whether it is legitimate jury discussion during deliberations, this fact may come out. I’m sure the juror who asked the question would be telling his/her fellow jurors that they asked about WHY Gypsy had made a plea deal and the question wasn’t asked.

    I’m sure hoping the prosecution team has had a little “chat” with her about the poor level of cooperation and that she could end up negating the deal if the prosecutor has to continue to impeach her with her own words on the stand. Actually, I sort of like that he has to impeach her on the stand in front of the jury who will decide if this was a case of murder.

        The prosecutors are stacking up all the evidence. They’re going to connect the dots in their closing argument. That’s where we’ll get the drama, if there is going to be any. I don’t see it as respect for the jury. Sam Pead is no Juan Martinez. That’s why he’s frequently referred to as “the Prosecutor,” instead of by his name. I sure hope he brings his presentation up a notch for the closing. He’s very bland. The lead prosecutor is Chad Grunander. It took five minutes to even find a photo of him online. Neither one is a spitfire.

    This testimony is simply breaking my heart. I can barely stand to listen to Ada. That poor child as well as the rest of her family.

    Too bad this guy can’t suddenly grow a pair, stand up and say “enough, I did it.” and spare traumatizing this child any further.

    His gal ” Gyp” was wearing a 4.5 carat diamond ring he gave her! That tells you just how much he cared about what his kids were going through at the time. She gets a ring and they suffer through depression. What a pair….they deserve each other!! She was so cocky on the stand they probably already have plans together after he gets out (they wish!!)

    One odd thing about this trial is that we don’t know anything about the jury, except that there are six men and five women. (Eleven members of the jury, not twelve.) In almost every trial I’ve followed, the jurors are referred to by number and their backgrounds (approximate age, job description, race, etc.) are published. Not so in this case. They were questioned in the judge’s chambers.
