Martin MacNeill Murder Trial – Day 12

I was glad to see I wasn’t the only one confused yesterday afternoon!!!  Skipping over the 4th inmate really threw a wrench into the works.  To me, it was a lost day for the prosecution because they didn’t accomplish what they thought they would.

Can’t wait to see ‘Dypsy’ again!  (best line of the day IMO!!!)

Jason Poirier gets limited use immunity from the state for his testimony!

State calls Jason Poirier.  He’s got his gangsta garb on.  He and MacNeill were housed in a state facility.

He knew MacNeill was a doctor.  He would read MacNeill’s stories and poetry.

He was in jail for violation of probation and theft charges.

They spoke about MacNeill’s shoes because MacNeill was a trustee he had privileges and said he gets a lot of things.  “I’m getting away with the murder of his wife.”

They spoke again about Michele a few days later.  MacNeill said, I’m glad the bitch is dead.  MacNeill said the relationship was going downhill and Michele said she wasn’t going to let him continue cheating with his girlfriend.

He asked MacNeill if he was serious about his wife and he said yes; look where I’m at.

He then asked to be moved to another unit.

Cross…

You gave an interview in this case?  Yes.

You were truthful?  Yes.

Truthful isn’t your strong suit?  Yes.

You lifted a laptop and lied about it to police?  Yes.

He wrote a letter to the judge saying how hard it was to be in jail and not watch his little girl grow up and asked the judge for mercy.

After your release you continued to sell fake Rolex watches?  No.

A person caught you in July 2012 and to dissuade him from reporting it you told him your aunt was with the police department?  Yes.

You gave her name as Tammy Black who was actually your parole officer?  Yes.

Boy, this guy is a real winner!  Spencer is bringing everything from his past up.  Beating a dead horse.

After you were arrested you met my client?  Yes.

You thought MacNeill was joking about his wife?  Yes, he was always joking.

MacNeill told you he was glad the bitch was dead?  Correct.

You were facing serious charges?  Yes.

While incarcerated you had a number of calls with your wife?  Correct.

You discussed other criminal activities?  Yes.

About drugs and how is wife could obtain them?  Yes.

Your landlord so you could defraud him?  Yes.

Spencer into full on bore mode. He’s into skipping around and taking things out of context.

So far this guy is coming across as credible.  More so than Spencer, lol.

Spencer’s garments are in wad!

Shhh…donchais sneaking up to the podium with Bic lighter and setting all records on fire!!!

Redirect…

Did you think you would get leniency on all your cases?  Yes.

Pros rehabs witness very well!

Says he had to come forward because he was afraid MacNeill would be free to do these things again.

Danger Will Robinson!  Spencer back up and snake alert is high!

All in all, Jason was a good witness.

Jury questions…

What is GPS?  GPS is still part of being monitored.

Judge calls lunch.

We are back.

State calls inmate # 1.

He’s 38 and currently imprisoned since 2007.  Still has 9-10 years to serve for drugs and firearms.

He knows MacNeill from Texarkana computer class till 2010.

MacNeill was on TV and he recognized him on Nancy Grace.

MacNeill told him the Grace show was done because his girlfriend was about to get out.

That meant to him that his girlfriend was also incarcerated.

MacNeill said they can’t prove anything so he didn’t know why they kept running it.

MacNeill told him he gave Michele Oxy and some sleeping pills and got her to get in the bathtub.  He had told him he had to help Michele because he held her down.

MacNeill said authorities couldn’t prove anything.

This was a good on Nancy moment!

Did doc write his girlfriend?  Yes.

He later found out MacNeill had been arrested for the death of Michele.

After speaking with family he decided to come forward with what he knew.

Cross…

I just used a nail gun on my own head!                                                         

Goofy is back to reading lines from certain pages and skipping around again.

MacNeill said he was in prison for writing scripts.

Can anyone say nitpicking?  Raise your right hand!

I just can’t transcribe any of Goofy’s bs!

Says MacNeill just kept dosing Michele to get her relaxed enough to hold her down in the bath.

Says he came forward with what he knew because he thought MacNeill would do the same to his girlfriend.

Mr. Spencer?  Does the home know you’re gone?  Because you are!

Jury out of interest, judge calls for a stretch and bottled water for jurors.

Know what’s really scary?  Spencer is supposed to be the best of defense attorneys in the state!

OMG!  Spencer just doesn’t get and has a ton more!  Just kill me now!

Jury is now hanging from the rafters and the gallery is running out ripping their clothing off.

In regards to Spencer, Mormon or not, stupid is as stupid does!

I surgically want to remove Spencer’s face.

Praise the Lord and pass the ammunition, Judge Pullan says enough!

We begin again at 8:30 MT.

    I find this very strange: up until now in the trial the doc has been completely stone faced. Today though he seemed to be experiencing some sort of emotions. Im not sure what they were, but for the first time he looked vulnerable. When his own daughters were up there he didn’t betray a twinge of emotion but today his eyes looked red and he just looked different, maybe more worried about what he was hearing. I’m wondering if its a sense of betrayal over his jail buds testifying against him. What kind of person betrays no emotion when his own children are calling him a murderer but gets upset when inmates do it?

      Funny, noticed the same. As the inmates came up, he’d slightly shake his head no like they where lying…other than that, not a damn thing! Good catch.

    Just a reminder not to get into trouble in Utah if he is supposed to be the best. May I sew his lips together after you remove his face?? Just in case they are still moving. Love your synopsis of today!!

    I shudder to think Spencer thinks he only has 1/2 hour of cross left! Yes, we get that this inmate, as with the last, thought he could get a deal by testifying. Surprise! With his eerie description of the crime, Inmate #1 kicked the prosecution team up a notch or two. Give another notch up for the similar wording of what MM told him.

    Spencer has gone nowhere but in circles of excruciating boredom.

    Spencer’s got nothing except impeachment as a defense. There isn’t a convict around who wouldn’t want to strike a deal — and NO ONE can possibly remember what they said 2 years, 1 year, 6 months or 3 months ago verbatim. What an absolute waste of time. And Spencer acted like he’d caught #1 in some big friggin lie when he mentioned the difference between oxycontin and oxycodone….”Oh you’ve never called it that before have you?” “You’ve never offered the differences between the two have you.” Who gives a crap!!!!!!!!!!!!!!!!

Geeeezzzz….”I called at 8:00 a.m.” but in your previous testimony you said it was 8:05 a.m. “isn’t that right….you never said it was 8:00 a.m…..isn’t that right….you see that?! OMG….over and over!! We have sat here and said, “make a note Utah criminals…don’t call Donkey Face if you’re in trouble….you’d be better off representing yourself!!

    Donkey Face was going word by word and the more he had inmate #1 talk the more we found out. We have a pretty good picture of how the whole thing “went down”….he he he we have the jail jive down pat! Anyway…..Donkey Face did a good job filling in the blanks for the jury and us. If the jury didn’t take something from the inmate’s testimony, then why bother taking notes as they were with each inmate….because there’s something there to have 4 inmates tell almost the exact same story. One with a few in-depth details. We noticed the “duh”-fence woman looking over at the jury and taking notes. Wonder if she was trying to read their faces as each inmate testified. We can only hope that the forensics along with the circumstanial evidence and the witness testimony will tell the story to the jury without any doubt. This guy WILL do it again if he gets out because knowing he got away with it will only make him feel that much more empowered!! Hopefully he’s a “dead man walkin'” when all this is over!!

    What a babbling, incompetent attorney Spencer is was my overall impression for today. At times, he lost control of the cross of inmate #1 and the witness was asking him the questions! Also, as Ci Ci said, Spencer is trying to impeach the witness over insignificant details. Spencer has also asked very open questions and gotten answers that did not help the defense, bringing into mind the adage that you don’t ask questions that you don’t ask the answer to. Does anyone know how MM ended up with these attorneys?

    We were wondering does the jury have access to the arrest warrant document that was filed? We read through all 57 page of the document and Wow…Wow…Wow!! It’s very telling. After reading through it we can clearly see the Prosecution’s case laid out! If the jurors could read this document when they go in to deliberations they would be able to see all the holes in that murderers statements and his attempts to mislead and cover up his actions. Quite a bit of detail also covering his and Dipsey’s lies and relationship and how they both were secretly in contact with each other via written letters through a 3rd party. When it was brought to the attention of the investigators they went to question her at the prison she denied being in contact with him at which time they presented her with copies of the letters. Only then did she admit to it. Sooooo much information! We hope the jury reads through this 57 page document and add it the inmate testimony, there should be no question that this man is GUILTY!!! His daughters have reason to fear for their lives if he gets out!!

      Also, the report indicates that MM has quite a bit of money somewhere and is living a very comfortable lifestyle (last page of the report)!!

      I sure wish they did, but it’s not going to happen. A great deal of the contents has been ruled on by Judge Pullen as being OUT.

    Ci Ci – I am in total agreement about the 57 page arrest warrant document. It is the total in depth detailed road map of everything that MM & Dipsy did. It covered every base. I do not think that the jurors have access to this document – I don’t think that it’s been brought into testimony/evidence, but I could be wrong about this as I haven’t been able to watch trial testimony every day. I have never before seen such an all inclusive arrest warrant in any other trial. Too bad, the police had not been initially hoodwinked by the phony baloney “pious” Dr. so they could have completed an effective initial forensic investigation.

      One is a co-worker, another is Ada’s teacher. To really make a big case, there is an expert in ergonomics who will explain to us why MM couldn’t get Michele out of the bath tub. Wowzers!

      LOL! I suppose he will also explain why a 100 lb. woman lifted a car off of her husband due to the adrenalin rush. Guess MM wasn’t surprised enough or cared enough to summon up that rush!

        I wonder which example of Michelle in the tub the will use? If she was bent over as MM says I do believe even I could have pulled her out to the floor especially in an emergency. If she was truly as Ada saw her, yes it would be a little more difficult. Previous info was that he had been working out, but then maybe it wasn’t upper body he was concentrating on. This should be interesting information.

    What is with MM’s face ticks and eye movement and blinking as inmate #1 is testifying. Is he becoming nervous. Face movements usually give you away.

      That’s a definite sign of increased stress. I used to get an eye twitch when under extreme stress. Not a one since I retired!

      He seems to be doing okay using her own words against her. There is some serious impeachment to come. That’s why the judge called her and G’s attorney to the bench. PERJURY ahead!

    I think the doctor claimed MS as yet another excuse for why he couldn’t lift Michele out of the tub. Too bad he forgot he had it when he was carrying all that dry wall and running down the basement steps, as Rachel explained.

    Oh, and lest we forget, if Gypsy doesn’t meet with the requirements of her deal with the prosecutors, it’s back to prison she goes. She’s between a rock and a hard place now. I’m expecting a longish break for the lawyers to get through to her on this.

    What….3 witnesses??? This is a set up just in case he is found guilty he can claim ineffective counsel for an appeal! Of course he could have taken the stand himself, but he’s afraid of hanging himself out to dry and ensure a guilty verdict!

      No idea! I couldn’t follow his arguments at all! IIRC, some witnesses have pointed out that he wanted a quick autopsy so that a natural COD could be found and some of his smarmy activities also helped, like tossing the meds. immediately after.

      It varies from state to state. This is THE first Utah trial to be broadcast. I guess we’ll find out when it happens tomorrow.

    Our “Gem” of the day so far….When that Fool Dipsey got up and went up to the bench when the judge asked Counsel to approach and the Judge told her to siddown!! Ha ha ha….hah!! She doesn’t even have enough class to be embarrassed that she made a bigger FOOL out of herself!!

    Get real, buddy. No one, when faced with a family member in crisis, thinks “Gee, how do the ergonomics work in this situation? I have to consider my back, the discs and the vertebrae, and avoid doing any damage. I guess I’ll just have to let them die!”

      That’s what it sounds like the Duh-fence is saying. He didn’t save his wife because he might hurt his back!! He also mentioned the woman who lifted a car off her child in an emergency situation which we all know is due to the rush of adrenilin. Well….MM couldn’t do it because either he had no rush of adrenilin (because he didn’t want her saved and didn’t feel that rush) or he didn’t save her because he might hurt his back?! Good one Duh-fense….either way your client didn’t try to save her!!

    Well that was one banged-up defense! Parents, don’t try to hoist your 35 lb. child out of the bath tub! How many moms do that every day? Parole officer couldn’t add anything. The co-worker gave the prosecution that MM called him as a “professional courtesy” whilst giving CPR, and, the teacher told us what time school got out.

    Bang-dusters!

      Yea….wasn’t that a sorry state of affairs!! The jury must be sitting there wondering “what happened?”…..Donkey Face wasted so much time yakking during crossing of the Prosecution witnesses and then when it’s his turn on deck he just flops there like a fish out of water!! Wow…..!!

      Next time one of our little grandkids wants us to pick them up we’re going to have to tell them, “wait a minute….let me get a mechanical lift!” or “wait….let me go call two neighbors to help me!”
